Executive Summary The City Council approved a minute motion on May 11, 2021 directing staff to come up with solutions regarding overnight parking along Avenida Encinas and the surrounding areas. The motion read as follows: “Motion by Council Member Bhat-Patel, seconded by Mayor Pro Tem Blackburn, directing staff to bring back options on how to restrict overnight parking on Avenida Encinas and the surrounding areas.” It was approved 5-0. Discussion The City of Carlsbad has received several complaints regarding vehicles and motorhomes parking in the 6900 block of Avenida Encinas, near the Waters End neighborhood and just north of Poinsettia Lane. Residents and businesses in the area report that vehicles and motorhomes park for several days at a time, and individuals leave trash and dump grey water on the street. Exhibit B shows the calls for service in this area from May 22-June 22, 2021, which have been greater than in similar areas around the city. Parking is already prohibited at all times along both sides of Avenida Encinas between Palomar Airport Road and Cannon Road under Carlsbad Municipal Code section 10.40.046. On June 9, 2021, the city painted 21-foot single vehicle space markings on the roadway along with signage requiring vehicles to park within the marked stalls on the west and east sides of Avenida Encinas from the entrance to the Carlsbad Poinsettia Coaster Station south to Poinsettia Lane. With this change, spaced marking and signage is now in place on the west and July 20, 2021 Item #4 Page 1 of 35 east curb lines of Avenida Encinas from Palomar Airport Road to Poinsettia Lane, and also along the adjacent streets of Macadamia Drive and Raintree Drive, near the Waters End neighborhood. With the new vehicle space markings in place, there appears to have been a reduction in the number of oversized vehicles parking along Avenida Encinas. Police Department Lt. Steve Thomas met with management from the businesses along this section of Avenida Encinas – Porsche Carlsbad, Volvo Cars Carlsbad, Kaiser Permanente, Benihana, La Quinta Inn, Best Western Carlsbad by the Sea, Motel 6 Carlsbad and Holiday Inn Express & Suites Carlsbad Beach – as well as with representatives from the Waters End neighborhood and Poinsettia Station Apartments to discuss how they may be impacted by a prohibition on overnight parking on Avenida Encinas between the hours of 11 p.m. and 5 a.m. All of the businesses and the homeowner owner associations were in support of restricting overnight parking on Avenida Encinas, Macadamia Drive and Raintree Drive. Options Staff recommend the City Council consider the following options in response to the community and business concerns about overnight parking on Avenida Encinas between Palomar Airport Road and Poinsettia Lane. This item was reviewed by the City Council’s Municipal Code and City Council Policy Update Subcommittee on June 28, 2021. The subcommittee recommended the City Council adopt an ordinance implementing Option 2, described below. Option 1 Amend Section 10.40.046 of the Carlsbad Municipal Code to establish no parking zones between 11 p.m. and 5 a.m. on the west and east sides of Avenida Encinas from 6511 Avenida Encinas – the Poinsettia Coaster Station entrance – south to Poinsettia Lane, including Macadamia Drive and Raintree Drive. Pros •Would eliminate overnight parking in the area of concern raised by residents and the homeowner associations •Will likely reduce littering and illegal dumping in the area Cons •An unintended consequence of restricting overnight parking in this manner may increase vehicle parking in front of the Wastewater Treatment Plant that is located north on Avenida Encinas. No parking on both sides of Avenida Encinas, from 6511 Avenida Encinas to Poinsettia Lane and on Macadamia and Raintree Drives. July 20, 2021 Item #4 Page 2 of 35 Option 2 Introduce an ordinance amending CMC Section 10.40.046 to establish no parking zones between 11 p.m. and 5 a.m. on both sides of Avenida Encinas from Palomar Airport Road south to Poinsettia Lane, also including Macadamia Drive and Raintree Drive. An ordinance implementing Option 2 has been prepared for Council’s consideration. Pros •This would offer the same benefits as Option 1 but cover a longer stretch of Avenida Encinas as well as the area of concern raised by the homeowner associations Con •An unintended consequence of restricting overnight parking in this manner may be that vehicles relocate to another neighborhood. Option 3 Make no amendments to the municipal code ordinance that would prohibit overnight parking. Pros •Will not displace anyone in the community. Cons •Does not address the community concerns. Staff do not have a recommendation on the options. Options 1 and 2 both address the concerns raised by the community. Fiscal Analysis The preliminary cost estimate accounts for producing and installing signs with the new restrictions along both sides of Avenida Encinas and on Macadamia Drive and Raintree Drive. Next Steps The Office of the City Clerk will prepare the ordinance for adoption at the next regular City Council meeting. Once adopted, the city clerk will publish the ordinance or a summary of the ordinance in a newspaper of general circulation within 15 days. The ordinance will be effective 30 days following its adoption. Public Notification This item was noticed in accordance with the Ralph M. Brown Act and was available for public review at least 72 hours prior to the scheduled meeting date. We at Volvo Cars Carlsbad wouldn’t have any objections to the city creating a no overnight parking zone in front of the dealership as long as it’s after hours such as 11:00 PM to 5:00 AM. I believe creating a no overnight parking zone will have a positive effect on the security of the dealership. Lately our street has become an overnight parking destination for many RV’s that tend to crowd our driveway entrances creating a hazard as you’re unable to see around them pulling out of the driveway. Lately we’ve also noticed we’re encountering quite a few more people that seem to have mental health issues and homeless people sleeping on our property. I don’t see any negative effect this will have on our operations. Please feel free to reach out to me if you have any more questions. The community is also surrounded by several other densely populated residential communities within walking distance including: Poinsettia Station, Poinsettia Cove, Hanover Beach Colony, Lakeshore Gardens, and San Pacifico. What these communities have in common is they are home to hundreds (perhaps thousands) of families with small children, elderly people, single women living alone, and other vulnerable populations. The recent increase in crime in the area is cause for great concern. It would be gravely remiss and irresponsible to ignore this problem. Ignoring the problem will lead to innocent children and adults being the victims of violent crime, molestation, kidnapping, and murder. The hotels along Avenida Encinas and the transient overnight parking are the cause of the crime. Theft is at an all-time high, with car break-ins, bike thefts, and garage thefts occurring several times a week, if not daily. If a resident leaves their garage door open, they have to fear that someone will walk right into it to steal items in the middle of the day. Cars are being broken into so that people can steal garage door openers and target the home for more serious burglary. As you know, in 2019, a 64 year-old Carlsbad woman was violently murdered by stabbing in her home by a transient homeless couple who fled the scene in the victim’s stolen car. Recently, a man in his 20s was assaulted in Carlsbad by a homeless person who stole his wallet. A single, elderly woman in Carlsbad was confronted in her home late at night by a mentally ill woman who broke in to her home in a delusional state. She entered the home after stabbing someone down the street. Another woman recently confronted a man who entered her kitchen in the middle of the day though her back door. Approximately two years ago, a felon who was staying at one of the hotels on Avenida Encinas hid from police inside of a Water’s End resident’s garage. In order to apprehend the suspect and take him out of the person’s home, police were forced to pull their weapons and arrest him in front of children and other community residents. This is an incident that caused trauma and fear in young children of the community. In the past month, one concerned resident on our board has had to intervene with two different homeless men hiding in the bushes inside our community gates. Both men were under the influence of illegal substances and not in a mental state to make sound and reasonable judgements. People who are under the influence of methamphetamine and other drugs routinely experience paranoia and delusional thinking. In some cases, they may experience hallucinations. In this altered state of mind, a person can easily perceive a threat when there is none, substantially increasing the likelihood of violent crime, assault, and murder. This is very concerning considering Water’s End is home to hundreds of young children who routinely play outside within the gates of our private community. As discussed in the town hall meeting at the Water’s End community park recently, the Motel 6 in particular, across the street from Water’s End, is a hub for drugs, prostitution and sex trafficking, and residents who have felony records. Many local crimes have been traced back to residents of that hotel. The Carlsbad police spend a lot of time policing that area and Water’s End residents are very grateful to July 20, 2021 Item #4 Page 7 of 35 all law enforcement that work so hard to protect our community safety and the safety of our children. In addition to the hotel, there is a sharp increase in overnight parking/camping along Avenida Encinas. The transient overnight campers add to the crime in the area. They commit crimes within walking distance of where they are parked (our community) and then make a clean get away in their vehicles. They procure drugs and prostitution services from the nearby hotel, adding to the problem the hotel has already created. They tell others who want to partake in the same illegal activity to come to Avenida Encinas to camp right next to our homes. This transient community increases the likelihood that our children will be exposed to drugs and gain access to them. It also increases the likelihood of children being the target of other crimes such as molestation, rape, kidnapping, and being sold into the sex trade. No one knows the background of the transient campers. No one knows if they are registered sex offenders, felons with violent criminal backgrounds, or law-abiding citizens camping near the beach. But, based on what the community has witnessed, it seems the likelihood is very high that drug addicted individuals who commit crimes such as assault, molestation, and theft are camping on the street, not law abiding citizens. Residents who live in Waters End along Avenida Encinas are constantly awoken to violence on that street and around the hotels. The crime, drug use, and prostitution/sex trafficking in the area leads to fighting, violence, and police involvement. The transient campers often yell and cause disturbances late at night, urinate and defecate in the bushes, and leave trash and used hypodermic needles behind, thus creating a health hazard. Serious diseases can be spread easily as a result. As tax paying citizens of Carlsbad who work hard to afford our residences, we want to make sure our community is safe for ourselves, our children, the elderly, and other vulnerable residents who cannot defend themselves against the crimes perpetrated by transient criminals drawn to the area due to the easy access to drugs, prostitution/sex trafficking, and theft. We need to protect our children from the threat of kidnapping, molestation, assault, drugs and violence. We need to protect our property, our safety and our health. We are asking that the City of Carlsbad help us by putting into action plans to intervene with this criminal activity including: 1. Prohibiting overnight parking on Avenida Encinas 2. Putting in place a program similar to Chula Vista to target the crime at the Avenida Encinas hotels 3. Housing homeless social service programs in an area that is not near residences and schools and not at a hotel that is already overrun by crime such as the hotels on Avenida Encinas. Thank you for seriously considering these issues. The community is asking that they not be ignored; we need help to keep our neighborhood safe. I wanted to let you know that the La Quinta Inn and Suites fully backs your decision to paint the curbs red along Ave Encinas and along our cul-de-sac. This homeless situation has affected us so negatively with our guest and business relationships. It also defaces the beautiful area that is Carlsbad, California. I have attached multiple negative reviews that I have received from valued guests with very extensive complaints on the homeless situation at the hotel as a reference. The overnight parking in the area is out of control. Option 2 ensures that the overnight parking in the area isn’t literally just kicked down the road a bit. Granted, the people parking (camping) overnight may find other areas in the city in which to park. If and when that happens, we should then do the same at that location. Until then, please do the most to protect this area where we know the overnight parking is out of control now. Thank you. The overnight parking in the area is out of control. Option 2 ensures that the overnight parking in the area isn’t literally just kicked down the road a bit. Granted, the people parking (camping) overnight may find other areas in the city in which topark. If and when that happens, we should then do the same at that location. Until then, please do the most to protect this area where we know the overnight parking is out of control now. Thank you. AVENIDA ENCINAS OVERNIGHT PARKING {city of Carlsbad RECENT CHANGES •On December 9, 2020, the city painted space markings and installed signage limiting oversized vehicles from parking on the west and east curb lines of Avenida Encinas between Palomar Airport Road and the Poinsettia Coaster Station. •On June 9, 2021, the city painted space markings and installed signage limiting oversized vehicles from parking on the west and east curb lines of Avenida Encinas from the Poinsettia Coaster Station to Poinsettia Lane, and along Macadamia Drive and Raintree Drive. All supported restricting overnight parking on Avenida Encinas, Macadamia Drive and Raintree Drive.
