Recommended Action
Adopt Ordinance No. CS-398 amending Section 10.40.046 of the Carlsbad Municipal Code to
establish no parking zones along both sides of portions of Avenida Encinas, and Macadamia
Drive and Raintree Drive, between the hours of 11 p.m. and 5 a.m.
Executive Summary/Discussion
Ordinance No. CS-398 was introduced and first read at the City Council meeting held July 20,
2021. On a motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, the
City Council voted 4-0 to introduce Ordinance No. CS-398. The second reading allows the City
Council to adopt the ordinance, which will become effective 30 days after the adoption.
Fiscal Analysis
On July 20, 2020 the City Council appropriated $17,100 from the City Council’s contingency
balance to the Police Department’s operating budget to support the estimated costs of
producing and installing 57 signs with the new restrictions along both sides of Avenida Encinas
and on Macadamia Drive and Raintree Drive. No additional funding is required.
Next Steps
The City Clerk will have the ordinance, or a summary of the ordinance, published in a
newspaper of general circulation within fifteen days following adoption of the ordinance.
Environmental Evaluation
The project is exempt from the California Environmental Quality Act under CEQA Guidelines
Section 15301(c), which covers the minor alteration of existing facilities, including streets,
involving negligible or no expansion of use.
Public Notification and Outreach
This item was noticed in keeping with the Ralph M. Brown Act and it was available for public
viewing and review at least 72 hours before the scheduled meeting date.

ORDINANCE NO. CS-398
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING SECTION 10.40.046 OF THE CARLSBAD
MUNICIPAL CODE TO ESTABLISH NO PARKING ZONES ALONG BOTH
SIDES OF PORTIONS OF AVENIDA ENCINAS, MACADAMIA DRIVE
AND RAINTREE DRIVE BETWEEN THE HOURS OF 11 P.M. AND 5
A.M.
WHEREAS, parking of vehicles is currently prohibited during all hours of the day and night
on the westerly and easterly sides of Avenida Encinas between Palomar Airport Road and Cannon
Road; and
WHEREAS, the City of Carlsbad and Carlsbad Police Department have received numerous
reports of individuals parking vehicles overnight along portions of Avenida Encinas and leaving
trash and dumping grey water on the street; and
WHEREAS, the City Council of the City of Carlsbad has determined that it is in the interest
of public safety that an overnight parking restriction be implemented along the westerly and
easterly sides of Avenida Encinas between Palomar Airport Road and Poinsettia Lane, including
Macadamia Drive and Raintree Drive.
NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows
that:
1.The above recitations are true and correct.
2.That Title 10, Chapter 10.40, of the Carlsbad Municipal Code is amended by the
revision of Section 10.40.046 to read as follows:
10.40.046 Parking restricted on Avenida Encinas.
A.Parking of vehicles is prohibited during all hours of the day and night on the westerly
and easterly sides of Avenida Encinas between Palomar Airport Road and Cannon Road.
B.Parking of vehicles is prohibited between 11:00 p.m. and 5:00 a.m. on the westerly and
easterly sides of Avenida Encinas between Palomar Airport Road and Poinsettia Lane.
C.Parking of vehicles is prohibited between 11:00 p.m. and 5:00 a.m. on the northerly and
southerly sides of Macadamia Drive east of the intersection with Avenida Encinas.
D.Parking of vehicles is prohibited between 11:00 p.m. and 5:00 a.m. on the northerly and
southerly sides of Raintree Drive east of the intersection with Avenida Encinas.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the
City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or
a summary of the ordinance prepared by the City Attorney to be published at least once in a
newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on the
20th day of July, 2021, and thereafter
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 27th day of July, 2021, by the following vote, to wit:
