MISCELLANEOUS PERMITS
10. A RIGHT-OF-WAY PERMIT is required to do work in City Right-of-Way and/or
private work adjacent to the public Right-of-Way. Types of work include, but are
not limited to: street improvements, tree trimming, driveway construction, tieing
into public storm drain, sewer and water utilities.

Thank you for your information request regarding setbacks and building separation requirements
in the Pavona residential development. As you correctly reiterated in your phone message of
October 8, 1996, setbacks in Pavona take the form of minimum building separation, rather than
distance to property line. According to the A viara Master Plan (MP 177), the minimum building
separation is IO feet for single story structures, 15 feet between one and two story structures and
20 feet for two or more story structures. All other setbacks must conform with the provisions of
the Planned Development Ordinance (Chapter 21.45 of the Carlsbad Municipal Code) as
opposed to the provisions of the R-1 -Single Family Residential Zone (Chapter 21 .10 of the
C.M.C.).
Therefore, your request to construct a sunroom/studio up to five feet from your property line
could be approved, provided that you meet or exceed the minimum building separation criteria
and all other applicable Building, Engineering and Fire Department requirements. Due to the
unusual nature of the setback requirements within Pavona, I recommend that you submit a copy
of this letter with your building permit application.
