CARLSBAD THEATER
This is to inform you that I completed a joint inspection of the premises
with Pat Kelly of the Building Department and am prepared to approve a
conditional Certificate of Occupancy. The owner is prepared to invest in a
renovation of the theater if he is sure the City or one of its departments
is not going to hold up a C of 0. Since the bulk of the corrections required
are fire safety oriented, I am willing take the lead on inspections to see
to it that the owner meets all the requirements of all departments
concerned. When I am sure the building corrections are made, I will
contact the appropriate departments to get their approval for opening to
the public.
I have enclosed a copy of the correction notice sent to the owner along
with conditional C of O approval. Please let me know if the arrangement I
propose is satisfactory.

CERTIFICATE OF OCCUPANCY
This is to confirm our conversation earlier this date regarding the Certificate of Occupancy of
the theater. As I explained, The Fire Department Is prepared to approve the C of O under the
condition that the building Is not opened for public use until all deficiencies described herein
are corrected. Failure to comply with this condition will result in a recision of C of O approval
by the Fire Department.
The deficiencies of concern to the Fire Department are listed below. Please consult with other
agencies for any corrections they may require. Correction of all these Items will permit the
building to be used for cinema as an A-2.1 occupancy. The area to the rear of the proscenium
opening is not approved as a "Legitimate stage" and therefore may not be used in conjunction
with entertainment functions or any public event. In addition to cinema use, the portion of the
forestage which projects outward from the proscenium wall may be used for live productions so
long as activity does not extend into that area to the rear of the proscenium wall.
Marquee -replace missing bulbs in light canisters
-Install minimum six-Inch contrasting numerals upon the marquee which depict
the address of the premises.
Lobby -label breaker switches in electrical panel
-remove all locks and or latches other than panic hardware assemblies on lobby
doors
-repair all holes in walls and ceilings
Concession -Replace power cord on popcorn machine
-replace power wire on ticket machine motor
-replace switchplate In ticket booth
-label breakers in sub panel
-repair ceiling in storage room
Understair -remove all combustible storage
-remove attached "lamp cord"
Restrooms -reroute temperature and pressure valve outlet on water heater to floor area
-seal air shafts and provide mechanical ventilation

Auditorium -repair all partition holes
-repair floor Irregularities
-remove lock hasps from rear exit doors
-provide exit path lighting In rear exit passages
-install approved "No Parking" signs in rear alley along curb
-remove dumpster outside adjacent to exit
-repair hole in floor, stage right
Forestage -treat plywood skirt for conformance with UBC flamespread requirements
Understage -remove all combustible material
-repair and cover all open • J-boxes·
Stage -Remove all general storage. Only storage of pipe organ parts will be permitted
behind the proscenium wall
-provide barrier at or near the proscenium opening to prevent unauthorized use
of the stage as stated above.
Projection -repair holes in ceilings and walls
-cover all open "J-boxes"
-provide safety railing for lower level office
-remove acoustic board In viewing room or cover with approved fire resistive
material.
