HomeMy WebLinkAbout2021-09-14; City Council; Resolution 2021-206Sept 14, 2021 Item #2 Page 4 of 32 RESOLUTION NO. 2021-206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT WITH DUDEK, A CALIFORNIA CORPORATION, FOR ENGINEERING DESIGN AND ENVIRONMENTAL PERMITTING OF THE MERWIN DRIVE STORM DRAIN IMPROVEMENTS PROJECT AS PART OF THE CITYWIDE DRAINAGE IMPROVEMENT PROGRAM, CAPITAL IMPROVEMENT PROGRAM PROJECT NO. 6608 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable and in the public interest to design and construct the Merwin Storm Drain Improvement Project, Capital Improvement Program, or CIP, Project No. 6608 (project), which includes the city undertaking engineering design and environmental assessment; and WHEREAS, on April 09, 2021, staff received six proposals from consultants for engineering design of the project; and WHEREAS, a committee consisting of city staff reviewed and rated the proposals based on best- value criteria consistent with Carlsbad Municipal Code Sections 3.28.0S0(D)(2) and 3.28.060; and WHEREAS, staff selected Dudek, a California corporation, as the most qualified consultant for the project; and WHEREAS, staff and Dudek have negotiated the scope of work and associated fee in an amount not to exceed $299,597 to provide professional engineering services for the project; and WHEREAS, sufficient Infrastructure Replacement funds are available to complete the engineering design of the Project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Mayor is authorized and directed to execute the professional services agreement with Dudek in an amount not to exceed $299,597 for design of the Merwin Drive Storm Drain Improvements Project, CIP Project No. 6608, which is attached hereto as Attachment A. 3. That the City Manager is authorized to extend the agreement for up to three subsequent one-year terms. RECITALS A. City requires the professional services of a consultant that is experienced in civil engineering and environmental documentation. B. Contractor has the necessary experience in providing professional services and advice related to civil engineering and environmental documentation. C. Contractor has submitted a proposal to City under Request for Qualifications No. RFQ21-1390TRAN and has affirmed its willingness and ability to perform such work. · NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. SCOPE OF WORK . City retains Contractor to perform, and Contractor agrees to render, those· services (the "Services") that are defined in attached Exhibit "A", which is incorporated by this reference Jn accordance with this Agreement's terms and conditions. 2. STANDARD OF PERFORMANCE While performing the Services, Contractor will exercise the reasonable professional care and skill customarily exercised by reputable members of Contractor's profession practicing in the Metropolitan Southern California Area, and will use reasonable diligence and best judgment while exercising its professional skill and expertise. 3. TERM The term of this Agreement will be effective for a period of three (3) years from the date first above written. The City Manager may amend the Agreement to extend it for three (3) additional one (1) year periods or parts thereof. Extensions will be based upon a satisfactory review of Contractor's performance, City needs, and appropriation of funds by the City Council. The parties will prepare a written amendment indicating the effective date and length of the extended Agreement. 4. TIME IS OF THE ESSENCE Time is of the essence for each and every provision of this Agreement. 5. COMPENSATION The total fee payable for the Services to be performed during the initial Agreement term shall not • exceed two hundred ninety-nine thousand five hundred ninety.seven dollars ($299,597). No other compensation for the Services will be allowed except for items covered by subsequent amendments to this Agreement. If the City elects to extend the Agreement, the amount shall not exceed one hundred thousand dollars ($100,000) per Agreement year. The City reserves the rtght to withhold a ten percent (10%) retention until City has accepted the work and/or Services specified in Exhibit "A". Incremental payments, if applicable, should be made as outlined in attached Exhibit "A''. PREVAILING WAGE RATES Any construction, alteration, demolition, repair, and maintenance work, including work performed during design and preconstruction such as inspection and land surveying work, cumulatively exceeding $1,000 and performed under this Agreement are subject to state prevailing wage laws. The general prevailing rate of wages, for each craft or type of worker needed to execute the contract, shall be those as determined by the Director of Industrial Relations pursuant to the Section 1770, 1773 and 1773.1 of the California Labor Code. f>ursuant to Section 1773.2 of the California Labor code, a current copy of applicable wage rates is on file in the office of the City Engineer. Contractor shall not pay less than the said specified prevailing rates of wages to all such workers employed by him or her in the execution of the Agreement. Contractor and any subcontractors shall comply with Section 1776 of the California Labor Code, which generally requires keeping accurate payroll records, verifying and certifying payroll records, and making them available for inspection. Contractor shall require any subcontractors to comply with Section 1776. 7. STATUS OF CONTRACTOR Contractor will perform the Services in Contractor's own way as an independent contractor and in pursuit of Contractor's independent calling, and not as an employee of City. Contractor will be under control of City only as to the result to be accomplished but will consult with City as necessary. The persons used by Contractor to provide services under this Agreement will not be considered employees of City for any purposes. The payment made to Contractor pursuant to the Agreement will be the full and complete compensation to which Contractor is entitled. City will not make any federal or state tax withholdings on behalf of Contractor or its agents, employees or subcontractors. City will not be required to pay any workers' compensation insurance or unemployment contributions on behalf of Contractor or its employees or subcontractors. Contractor agrees to indemnify City within thirty (30) days for any tax, retirement contribution, social security, overtime payment, unemployment payment or workers' compensation payment which City may be required to make on behalf of Contractor or any agent, employee, or subcontractor of Contractor for work done under this Agreement. At the City's election, City may deduct the indemnification amount from any balance owing to Contractor. 8. SUBCONTRACTING Contractor will not subcontract any portion of the Services without prior written approval ,of City. If Contractor subcontracts any of the Services, Contractor will be fully responsible to City for the acts and omissions of Contractor's subcontractor and of the persons either directly or indirectly employed by the subcontractor, as Contractor is for the acts and omissions of persons directly employed by Contractor. Nothing contained in this Agreement will create any contractual relationship between any subcontractor of Contractor and City. Contractor will be responsible for payment of subcontractors. Contractor will bind every subcontractor and every subcontractor of a subcontractor by the terms of this Agreement applicable to Contractor's work unless specifically noted to the contrary in the subcontract and approved in writing by City. 9. OTHER CONTRACTORS The City reserves the right to employ other Contractors in connection with the Services. 10. INDEMNIFICATION Contractor agrees to indemnify and hold harmless the City and its officers, officials, employees and volunteers from and against all claims, damages, losses and expenses including attorneys' fees arising out of the performance of the work described herein caused by any negligence, City Attorney Approved Version 6/12/18 2 Sept 14, 2021 Item #2 Page 8 of 32 DocuSign Envelope ID: 5D955F00-7766-41 CC-A558-62830345E296 PSA22-1595TRAN recklessness, or willful misconduct of the Contractor, any subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. The parties expressly agree that any payment, attorney's fee, costs or expense City incurs or makes to or on behalf of an injured employee under the City's self-administered workers' compensation is included as a loss, expense or cost for the purposes of this section, and that this section will survive the expiration or early. termination of this Agreement. 11. INSURANCE Contractor will obtain and maintain for the duration of the Agreement and any and all amendments, insurance against claims for injuries to persons or damage to property which may arise out of or in connection with performance of the services by Contractor or Contractor's agents, representatives, employees or subcontractors. The insurance will be obtained from an insurance carrier admitted and authorized to do business in the State of California. The insurance carrier is required to have a current Best's Key Rating of not less than "A-:VII"; OR with a surplus line insurer on the State of California's List of Approved Surplus Line Insurers (LASLI) with a rating in the latest Best's Key Rating Guide of at least "A:X"; OR an alien non-admitted insurer listed by the National Association of Insurance Commissioners (NAIC) latest quarterly listings report. 11.1 Coverage and Limits. Contractor will maintain the types of coverage and minimum limits indicated below, unless the Risk Manager or City Manager approves a lower amount. These minimum amounts of coverage will not constitute any limitations or cap on Contractor's indemnification obligations under this Agreement. City, its officers, agents and employees make no representation that the limits of the insurance specified to be carried by Contractor pursuant to this Agreement are adequate to protect Contractor. If Contractor believes that any required insurance coverage is inadequate, Contractor will obtain such additional insurance coverage, as Contractor deems adequate, at Contractor's sole expense. The full limits available to the named insured shall also be available and applicable to the City as an additional insured. 11 .1.1 Commercial General Liability (CGL) Insurance. Insurance written on an "occurrence" basis, including personal & advertising injury, with limits no less than $2,000,000 per occurrence. If a general aggregate limit applies, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit. 11. 1.2 Automobile Liability. (if the use of an automobile is involved for Contractor's work for City). $2,000,000 combined single-limit per accident for bodily injury and property damage. 11.1.3 Workers' Compensation and Employer's Liability. Workers' Compensation limits as required by the California Labor Code. Workers' Compensation will not be required if Contractor has no employees and provides, to City's satisfaction, a declaration stating this. 11.1.4 Professional Liability. Errors and omissions liability appropriate to Contractor's profession with limits of not less than $1,000,000 per claim. Coverage must be maintained for a period of five years following the date of completion of the work. 11.2 Additional Provisions. Contractor will ensure that the policies of insurance required under this Agreement contain, or are endorsed to contain, the following provisions: City Attorney Approved Version 6/12/18 3 Sept 14, 2021 Item #2 Page 9 of 32 DocuSign Envelope ID: 5D955F00-7766-41CC-A558-62830345E296 PSA22-1595TRAN 11.2.1 The City will be named as an additional insured on Commercial General Liability which shall provide primary coverage to the City. 11.2.2 Contractor will obtain occurrence coverage, excluding Professional Liability, which will be written as claims-made coverage. 11 .2.3 This insurance will be in force during the life of the Agreement and any extensions of it and will not be canceled without thirty (30) days prior written notice to City sent by certified mail pursuant to the Notice provisions of this Agreement. 11.3 Providing Certificates of Insurance and Endorsements. Prior to City's execution of this Agreement, Contractor will furnish certificates of insurance and endorsements to City. 11.4 Failure to Maintain Coverage. If Contractor fails to maintain any of these insurance coverages,· then City will have the option to declare Contractor in breach, or may purchase replacement insurance or pay the premiums that are due on existing policies in order to maintain the required coverages. Contractor is responsible for any payments made by City to obtain or maintain insurance and City may collect these payments from Contractor or deduct the amount paid from any sums due Contractor under this Agreement. 11.5 Submission of Insurance Policies. City reserves the right to require, at any time, complete and certified copies of any or all required insurance policies and endorsements. 12. BUSINESS LICENSE Contractor will obtain and maintain a City of Carlsbad Business License for the term of the Agreement, as may be amended from time-to-time. 13. ACCOUNTING RECORDS Contractor will maintain complete and accurate records with respect to costs incurred under this Agreement. All records will be clearly identifiable. Contractor will allow a representative of City during normal business hours to examine, audit, and make transcripts or copies of records and any other documents created pursuant to this Agreement. Contractor will allow inspection of all work, data, documents, proceedings, and activities related to the Agreement for a period of three (3) years from the date of final payment under this Agreement. 14. OWNERSHIP OF DOCUMENTS All work product produced by Contractor or its agents, employees, and subcontractors pursuant to this Agreement is the property of City. In the event this Agreement is terminated, all work product produced by Contractor or its agents, employees and subcontractors pursuant to this Agreement will be delivered at once to City. Contractor will have the right to make one (1) copy of the work product for Contractor's records. 15. COPYRIGHTS Contractor agrees that all copyrights that arise from the services will be vested in City and Contractor relinquishes all claims to the copyrights in favor of City. 16. NOTICES The name of the persons who are authorized to give written notice or to receive written notice on behalf of City and on behalf of Contractor under this Agreement. CONFLICT OF INTEREST Contractor shall file a Conflict of Interest Statement with the City Clerk in accordance with the requirements of the City of Carlsbad Conflict of Interest Code. The Contractor shall report investments or interests in all categories. Yes ~ No D 18. GENERAL COMPLIANCE WITH LAWS Contractor will keep fully informed of federal, state and local laws and ordinances and regulations which in any manner affect those employed by Contractor, or in any way affect the performance of the Services by Contractor. Contractor will at all times observe and comply with these laws, ordinances, and regulations and will be responsible for the compliance of Contractor's services with all applicable laws, ordinances and regulations. Contractor will be aware of the requirements of the Immigration Reform and Control Act of 1986 and will comply with those requirements, including, but not limited to, verifying the eligibility for employment of all agents, employees, subcontractors and consultants whose services are required by this Agreement. 19. DISCRIMINATION AND HARASSMENT PROHIBITED Contractor will comply with all applicable local, state and federal laws and regulations prohibiting discrimination and harassment. 20. DISPUTE RESOLUTION If a dispute should arise regarding the performance of the Services, the following procedure will be used to resolve any questions of fact or interpretation not otherwise settled by agreement between the parties. Representatives of Contractor or City will reduce such questions, and their respective views, to writing. A copy of such documented dispute will be forwarded to both parties involved along with recommended methods of resolution, which would be of benefit to both parties. The representative receiving the letter will reply to the letter along with a recommended method of resolution within ten (10) business days. If the resolution thus obtained is unsatisfactory to the aggrieved party, a letter outlining the disputes will be forwarded to the City Manager. The City Manager will consider the facts and solutions recommended by each party and may then opt to direct a solution to the problem. In such cases, the action of the City Manager will be binding City Attorney Approved Version 6/12/18 5 Sept 14, 2021 Item #2 Page 11 of 32 OocuSign Envelope ID: 5D955F00-7766-41 CC-A558-62830345E296 PSA22-1595TRAN upon the parties involved, although nothing in this procedure will prohibit the parties from seeking remedies available to them at law. 21. TERMINATION In the event of the Contractor's failure to prosecute, deliver, or perform the Services, City may terminate this Agreement for nonperformance by notifying Contractor by certified mail of the termination. If City decides to abandon or indefinitely postpone the work or services contemplated by this Agreement, City may terminate this Agreement upon written notice to Contractor. Upon notification of termination, Contractor has five (5) business days to deliver any documents owned by City and all work in progress to City address contained in this Agreement. City will make a determination of fact based upon the work product delivered to City and of the percentage of work that Contractor has performed which is usable and of worth to City in having the Agreement completed. Based upon that finding City will determine the final payment of the Agreement. Either party upon tendering thirty (30) days written notice to the other party may terminate this Agreement. In this event and upon request of City, Contractor will assemble the work product and put it in order for proper filing and closing and deliver it to City. Contractor will be paid for work performed to the termination date; however, the total will not exceed the lump sum fee payable under this Agreement. City will make the final determination as to the portions of tasks completed and the compensation to be made. 22. COVENANTS AGAINST CONTINGENT FEES Contractor warrants that Contractor has not employed or retained any company or person, other than a bona fide employee working for Contractor, to solicit or secure this Agreement, and that Contractor has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift, or any other consideration contingent upon, or resulting from, the award or making of this Agreement. For breach or violation of this warranty, City will have the right to annul this Agreement without liability, or, in its discretion, to deduct from the Agreement price or consideration, or otherwise recover, the full amount of the fee, commission, percentage, brokerage fees, gift, or contingent fee. 23. CLAIMS AND LAWSUITS By signing this Agreement, Contractor agrees that any Agreement claim submitted to City must be asserted as part of the Agreement process as set forth in this Agreement and not in anticipation of litigation or in conjunction with litigation. Contractor acknowledges that if a false claim is submitted to City, it may be considered fraud and Contractor may be subject to criminal prosecution. Contractor acknowledges that California Government Code sections 12650 et seq., the False Claims Act applies to this Agreement and, provides for civil penalties where a person knowingly submits a false claim to a public entity. These provisions include false claims made with deliberate ignorance of the false information or in reckless disregard of the truth .or falsity of information. If City seeks to recover penalties pursuant to the False Claims Act, it is entitled to recover its litigation costs, including attorney's fees. Contractor acknowledges that the filing of a false claim may subject Contractor to an administrative debarment proceeding as the result of which Contractor may be prevented to act as a Contractor on any public work or improvement for a period of up to five (5) years. Contractor acknowledges debarment by another jurisdiction is grounds for City to terminate this Agreement. 24. JURISDICTION AND VENUE Any action at law or in equity brought by either of the parties for the purpose of enforcing a right or rights provided for by this Agreement will be tried in a court of competent jurisdiction in the City Attorney Approved Version 6/12/18 6 Sept 14, 2021 Item #2 Page 12 of 32 DocuSign Envelope ID: 5D955F00-7766-41CC-A558-62830345E296 PSA22-1595TRAN County of San Diego, State of California, and the parties waive all provisions of law providing for a change of venue in these proceedings to any other county. 25. SUCCESSORS AND ASSIGNS It is mutually understood and agreed that this Agreement will be binding upon City and Contractor and their respective successors. Neither this Agreement nor any part of it nor any monies due or to become due under it may be assigned by Contractor without the prior consent of City, which shall not be unreasonably withheld. 26. ENTIRE AGREEMENT This Agreement, together with any other written document referred to or contemplated by it, along with the purchase order for this Agreement and its provisions, embody the entire Agreement and understanding between the parties relating to the subject matter of it. In case of conflict, the terms of the Agreement supersede the purchase order. Neither this Agreement nor any of its provisions may be amended, modified, waived or discharged except in a writing signed by both parties. The Dudek team will attend the award meeting/kick-off meeting with City staff to evaluate current conditions and capture the City and project team's project vision by defining the project critical success factors. The time will be used to coordinate amongst technical disciplines to outline the site opportunities and constraints that will shape the project design. Team Meetings/Meeting Minutes. Dudek will coordinate regular project progress meetings with the City. It is assumed that project progress meetings (project managers and technical meetings) will be held on a monthly basis or as needed depending on the progression of work. The progress meetings are intended to review the scope, budget, schedule, and design plan, as well as completed items of work and upcoming events. Progress meetings are especially significant for this project when critical design elements require review or value engineering services. Informal agendas will be provided by email to City team members. prior to meetings and Dudek will prepare informal meeting minutes by email for review within five business days following the meeting. It is assumed that there will be twelve (12) virtual project progress meetings. Agency Meetings. Dudek will conduct a virtual pre-application meeting with the U.S. Army Corps of Engineers (ACOE), California Department of Fish and Wildlife (CDFW), California Coastal Commission (CCC), Regional Water Quality Control Board (RWQCB), and U.S. Fish and Wildlife Service (USFWS) once an design option has been chosen by the City. Once the virtual pre-application meeting is held, Dudek will conduct an on-site field visit, for agencies that would like to tour the site. Engineering staff will participated in up to 2 virtual meetings to answer design related questions. Public Meetings. Based on City direction, it is assumed that Dudek will not attend or prepare materials for public meetings. 1.2 Project Management Tasks Monthly Status Reporting and Tracking. Dudek will provide a project progress report each month with our invoice that will include tasks completed for the reporting period, tasks anticipated for the next period, schedule status and updates and a summary of the project budget expenditure to dates. Monitoring/Controlling. Project schedule, budget and progress are monitored by earned-value schedules and budget t racking. The tracking system uses the project Work Breakdown Structure (WBS), combined with the project schedule to map the estimated projected accumulation of cost from beginning to end, referred to as the Base Line. As the project advances, the project manager communicates with the team on a regular basis to evaluate each task for completion and compares total earned value to project billings to establish a highly accurate budget status at any point in the project. Proactively managing the project schedule and budget from the onset of the project provides the project manager with the early warning indicators necessary to manage the work effort and protect the project budget. Each deliverable will receive a timely quality assurance/quality control (QA/QC) review by the QA/QC manager or equivalent reviewer. Ele ment 2 -Investigations 2.1 Right of Way Verification. Dudek has teamed with San Dieguito Engineering (SDE) who will research and prepare mapping showing right-of- way, property boundary, and easement information and verifying the ownership. It is assumed the City will provide the pertinent title report(s) however, if needed the Dudek team can include procuring the title reports in the scope. This will be a critical step to defining the limits of the project work or if additional right-of-way to accommodate temporary or permanent impacts will need to be accounted for in the design and environmental review process. 2.2 Design Options Analysis. The design options analysis will look at the constraints to determine various design options for the project. During this phase, all reports, supplemental data maps, previous survey data, City's general plan and GIS information will be reviewed to determine the preferred design option. The desktop study will provide a high level assessment of potential fatal flaws and benefits of the design options reviewed. This task includes preliminary research on the existing drainage systems and other utilities within the potential storm drain alignment. A desktop geotechnical study will be performed to discuss geotechnical opportunities and constraints for the design options. It is assumed the City will provide geotechnical information for the surrounding area. The design options analysis would look at the biological and permitting implications and other environmental concerns of each design option, as well as the constructability and feasibility. Hydraulic analysis will not be performed as part of this task. A preliminary analysis will be conducted to evaluate the potential for historical, cultural & archeological resources to inform the design options analysis. Three design options are proposed to be reviewed: ■ Design option 1-Reroute the storm drain from the inlets in Merwin Street to discharge to the northeast into Agua Hedionda Creek. ■ Design option 2 -Maintain the desilting basin and its related infrastructure located at the Merwin Drive storm drain outlet. The desilting basin is located within the Evans Point detention basin. Review if minor improvements to the desilting basin and detention basin (improving the inlet/outlet function) are feasible. • Design option 3 -Re-route Merwin Drive Storm drain outlet to the north through the 20-foot sewer and access easement to discharge into the detention basin or into Agua Hedionda Creek. In order to evaluate the constraints, Dudek will conduct an aquatics resources delineation of waters under the jurisdiction of the U.S. Army Corps of Engineers (ACOE), California Department of Fish and Wildlife (CDFW), Regional Water Quality Control Board (RWQCB), and California Coastal Commission (CCC) within each design options impact footprint and a 100-foot buffer. The aquatics resources delineation will provide baseline information to evaluate permitting options for each design option. During the aquatics resources delineation, Dudek will also map the vegetation communities present. To properly assess the design options, the land survey and mapping will be conducted as part of the design options analysis process. SOE will provide survey and base mapping services. SDE's services will include conducting topographic survey based upon aerial survey using the City datum (NAS 83 & NGVD 29) and City standards and will show one-foot contours and prominent surface features. SOE will prepare a base map showing the topographic survey with record boundary and right-of-way information. All AutoCAD data will be provided at final design or by City request earlier in the design process. Includes coordination and review time for Dudek engineers. The Historical, Cultural & Archeological Resource Investigation task will be completed as· part of the Permitting and Environmental Processing task. Element 3 -Engineering Se rvi ces The Engineering Services task effort will va,y depending on the design option selected The scope is set up to distinguish between the different levels of effort for each design option. 3.1 Existing Conditions Assessment. The Dudek team will review any additional data related to the selected design option, as well as other pertinent data that will inform the design process for the selected design option. This will include all reports, supplemental data maps, the City's general plan and GIS information. 3.2 Utility Research and Coord ination. The utility research performed in the design option analysis phase will be further investigated to for the selected design option And, if needed, potholing services will be performed by Underground Solutions to locate utilities that may impact the design and constructability. The potholing locations will be surveyed. This task will also include coordination with utility agencies to receive information on utility locations and size to avoid potential conflicts. • Design option 1 -It is anticipated that ten (10) potholes will needed to locate existing utilities. Potholing effort will require traffic control plans and permitting through the City. This design option is anticipated to include coordination for multiple utilities including water, sewer, and dry utilities. • Design option 2 -No potholing is anticipated to be needed. Utility coordination for this design option is anticipated to be minimal. • Design option 3 -It is anticipated the five (5) potholes will needed to locate existing utilities. Traffic control may be required for entering/exiting the access road. This design option is anticipated to include coordination focused on utilities in the access road, mainly sewer. Deliverable: Potholing report will be submitted to the City. This will include survey for the potholing investigation. SDE will prepare also plat and legal documents that may be needed for temporary construction easements or permeant easements. Design option 1 -It is anticipated the two (2) legal descriptions and Plat maps will be prepared for permanent easements and/or temporary construction easements. It is assumed two (2) days of supplemental field survey will be performed. Design option 2 -No legal descriptions and Plat maps are anticipated to be needed. It is assumed one (1) days of supplemental field survey will be performed. Design option 3 -It is anticipated the one (1) legal descriptions and Plat maps will be prepared for a permanent easement. It is assumed two (2) days of supplemental field survey will be performed. Deliverable: Legal descriptions and Plat maps will be submitted to the City. 3.4 Construction Documents. Based upon the selected design option, Dudek will prepare 30-percent, 70-percent, 90-percent, 100-percent and final construction documents for the storm drain. improvements. These plans will utilize all surveying, topographic, and hydrology information gathered for the site and any other results from the investigations task. Electronic copies will be delivered in PDF. 3.4.1 Drainage Report Drainage analysis will be based on the County of San Diego hydraulic design manuals as well as City standards and previous drainage reports. • Design option 1 -A drainage report will be prepared. Hydrology from previous reports will be used for the study and the storm drain hydraulics will be evaluated and designed for the 100-year 6-hour storm event. The report will be updated as needed for the four plan submittal. • Design option 2 -It is anticipated a drainage memorandum as an addendum to the original basin design and will be provide drainage calculations for any new basin elements. • Design option 3 -A drainage report will be prepared. Hydrology from previous reports will be used for the study and the storm drain hydraulics will be evaluated and designed for the 100-year 6-hour storm event. The report will be updated as needed for the four plan submittal. 3.4.2 MS4 Permit Requirements A preliminary review wi ll be conducted of the proposed project 30-percent design submittal to assess the applicability of the City's BMP Design Manual. Based on the current design options, it is assumed this project will not require a SWQMP as it will either replace pavement for a utility trench or will have no impervious areas created or replaced. The Storm Water Standards Questionnaire (Form E-34) and Standard Project Requirements Checklist (Form E-36) will be provided and it is assumed only one submittal of the forms will be required. City comments from the 30 percent plans will be included along with a response to comments matrix. Deliverables: • Digital files of full size plans (scalable) • Draft reports (Drainage, Geotechnical) 3.4.5 100-Percent Design Submittal Drawings shall have all plans and section complete and all details completed. All City comments from the 90 percent progress submittal will be addressed or resolved prior to the 100-percent submittal package. Deliverables: • Digital files of full size plans (scalable) • Draft reports (Drainage, Geotechnical) 3.4.6 Final Submittal The drawings and specifications shall be stamped and signed by a professional engineer of the appropriate engineering discipline, as well as landscape architect registered in the State of California. In addition, the Final submittal will address or resolve all City comments from the 100-percent progress submittal package. Deliverables: • Digital files of full size plans (scalable). The plans will be incorporated in the engineering plans as part of the overall set of plans. The 30% submittal will include the proposed planting palette and general notes. The 70%, 100% and Final Design submittals will include planting and irrigation plans, legends, details, final notes, specifications, and cost estimate. Dudek will prepare the final irrigation plans to address the installation of temporary irrigation systems to support the establishment of the restoration/landscape planting areas within the proposed disturbance areas. Any irrigation systems/components intended to be permanent would be designated as such on the plans. Dudek will design the irrigation systems to utilize a water source point of connection off a potable water meter location, as directed by the City. It is assumed that the City will provide the actual physical water source point of connection for the irrigation system and that the system will be designed to connect to that point of connection. The irrigation system will be designed to be operated via an automatic irrigation controller, either through an electrical connection or via a solar controller, as directed by the City. Irrigation installation notes will be included on the irrigation legend sheet. Irrigation details will be included on separate sheets. Irrigation specifications will be provided to supplement the engineering specifications in booklet format. The restoration/landscape plans described herein will only address the areas of onsite disturbance from the storm drain work. If additional mitigation areas are required elsewhere, ei_ther onsite or at an offsite location, then those plans would be considered an additional service to be addressed separately under a contract amendment or other arrangement with the city. Design option 1 -It is anticipated that under this design option the landscaping in the pocket park area, at the end of Merwin Drive, would be impacted by the storm drain work and that the existing ornamental landscaping would be disturbed to facilitate the pipeline installation and would need to be repaired/restored after the storm drain work is completed. Dudek habitat restoration/landscape architecture staff would assist Dudek engineers with determining the best alignment and storm drain installation technique to help minimize impacts to existing mature trees and hardscape improvements within the park. Planting and irrigation plans would be prepared to restore the park landscaping. If hardscape restoration and improvements are necessary, Dudek landscape architects would assist the engineers with preparation of plans to show the proposed improvements. It is also assumed that restoration plans will be needed at the tie-in/daylight point of the new storm drain where it outfalls into Agua Hedionda Creek. Planting and irrigation plans would be prepared for the areas of disturbance associated with the outfall location. It is assumed that the majority of the revegetation effort would involve southern willow scrub habitat. Design option 2 -It is anticipated that under this design option the existing detention basin (i.e., Evans Point Detention Basin) would be disturbed in order to install the necessary storm drain improvements and regularly maintained. Dudek habitat restoration/landscape architecture staff would assist Dudek engineers with determining the least impactful method to achieve the storm drain improvements. Revegetation landscape planting plans and irrigation plans would be prepared to help restore the areas of disturbance outside of the planned maintenance areas, and surrounding the discharge point into Agua Hedionda Creek. It is assumed that Merwin Drive Storm Drain Improvement -Scope of Work 6 Sept 14, 2021 Item #2 Page 21 of 32 DocuSign Envelope ID: 5D955F00-7766-41CC-A558-62830345E296 DUDEK this revegetation effort for the areas outside of the regular maintenance areas would include freshwater marsh, as well as bordering southern willow scrub habitat. Design option 3 -It is anticipated that under this design option the storm drain would be located within/under the existing unvegetated access road, and that the tie-in/daylight point of the new storm drain would be at an outfall location along the bank of Agua Hedionda Creek. Planting and irrigation plans would be prepared for the areas of disturbance associated with the outfall location and any other areas of temporary disturbance from the storm drain improvement work. It is assumed that the majority of the revegetation effort would involve southern willow scrub habitat. 3.5 Geotechnical Engineering Investigation. The geotechnical engineering investigation will include a review of any available prior geotechnical and design engineering studies, As-Built documents, published geologic and geotechnical information as well as geologic field mapping of the site conditions. A subsurface investigation will be conducted to evaluate the existing site condition for the preferred design option. The data reviewed and collected is intended to provide the project team the geotechnical information necessary for design and construction of the proposed improvements. A written report will be provided summarizing our field observations and subsurface and groundwater characterization to support the preferred design options. Design option 1 -The geotechnical engineering evaluation for this design option will include: • Coordinate site access with Dudek and the City of Carlsbad, mark out the proposed exploration locations, and notify Underground Service Alert {USA) to review the locations of the subsurface explorations relative to below-ground utilities, and clear the locations of existing utilities prior to the start of work. • Obtain a City of Carlsbad Right-of-Way permit-Form E-11 {we understand that the City will waive the permit and review fee) for the explorations. • Advance two {2) 6-to 8-inch diameter geotechnical borings with truck mounted drill rig to a depth of approximately 10-feet below ground surface. Traffic control will be provided during our field work, where required. We propose to conduct these borings within Merwin Drive, which is a residential cul-de-sac. If possible, an additional two hand auger borings will be conducted near the mature trees along Cannon Road. • Log the borings and collect bulk soil samples of the upper five feet for laboratory testing and analyses. A Group Delta Engineer or Geologist will supervise the field work. • Backfill the borings in accordance with the City of Carlsbad Standards and return the ground surface to the original condition. • Collect selected soil samples during the subsurface exploration for laboratory testing to characterize the engineering properties of the existing soils with respect to temporary excavations. The laboratory testing will be completed according to ASTM International, California Building Code, and Caltrans standards, or other appropriate testing procedures at our accredited laboratory in San Diego. ■ Provide a written report summarizing our field observations and subsurface and groundwater characterization, as well as geotechnical parameters for the drainage channel improvements. Design option 2 -This design option does not involve any utility improvements for which a subsurface investigation would be necessary. A geologic reconnaissance of the site will be conducted by a Certified Merwin Drive Storm Drain Improvement -Scope of Work 7 Sept 14, 2021 Item #2 Page 22 of 32 DocuSign Envelope ID: 5O955F00-7766-41CC-A558-62830345E296 DUDEK Engineering Geologist and a letter report summarizing our conclusions and recommendations with regards to the existing site conditions and the proposed improvements will be provided. Design option 3 -The geotechnical engineering evaluation for this design option will include: • Coordinate site access with Dudek and the City of Carlsbad, mark out the proposed exploration locations, and notify Underground Service Alert (USA) to review the locations of the subsurface explorations relative to below-ground utilities, and clear the locations of existing utilities prior to the start of work. ■ Obtain a City of Carlsbad Right-of-Way permit- Form E-11 (we understand that the City will waive the permit and review fee) for the explorations. • Advance six to eight small diameter geotechnical borings with a hand auger. We propose to conduct these borings along the access road which extends south from El Camino Real between the residential homes and open space. • Log the borings and collect bulk soil samples of the upper five feet for laboratory testing and analyses. A Group Delta Engineer or Geologist will supervise the field work. • Backfill the borings and return the ground surface to the original condition. Some disturbance may remain. Excess drilling excavation spoils will be thin spread on-site in approved areas. • Collect selected soil samples during the subsurface exploration for laboratory testing to characterize the engineering properties of the existing soils with respect to temporary excavations. The laboratory testing will be completed according to ASTM International, California Building Code, and Caltrans standards, or other appropriate testing procedures at our accredited laboratory in San Diego. • Provide a written report summarizing our field observations and subsurface and groundwater characterization, as well as geotechnical parameters for the drainage channel improvements. Deliverable: A geotechnical report will be submitted to the City. Element 4 -Permitting and En vironmental Processing 4.1 Regu latory Permitting 4.1.1 Biological Review. This scope of work includes conducting a survey for least Bell's vireo and special-status plants, including narrow endemic species identified by the City's HMP, for one design option and will use data collected during Task 2.2 where feasible. Least Bell's vireo survey requires 8 separate visits and the focused survey for special-status plants will take visit. Once the aquatics resources delineation and vegetation mapping are complete and the design option is selected, an evaluation of special-status species with potential to occur within the impact footprint will be prepared and additional surveys may be required beyond those included in this scope of work. Dudek will prepare an appropriate report that includes an impacts analysis based on the project design, an assessment of the significance of the impacts, City HMP consistency analysis, and applicable and feasible mitigation measures. Proposed mitigation requirements for potential impacts to sensitive resources will be discussed in terms of the required updates from previous analyses, along with the current regional planning efforts and state and federal laws and guidelines. The scope and cost for biological review does not vary by design option. Merwin Drive Storm Drain Improvement -Scope of Work 8 Sept 14, 2021 Item #2 Page 23 of 32 DocuSign Envelope ID: 5D955F00-7766-41 CC-A558-62830345E296 DUDEK 4.1.2 Regulatory Permitting. Dudek will conduct a virtual pre-application meeting with the U.S. Army Corps of Engineers (ACOE), California Department of Fish and Wildlife (CDFW), California Coastal Commission (CCC), Regional Water Quality Control Board (RWQCB), and U.S. Fish and Wildlife Service (USFWS) once an design option has been chosen by the City. Once the virtual pre-application meeting is held, Dudek will conduct an on-site field visit, for agencies that would like to tour the site. Dudek will prepare applications, coordinate submittal of applications, and facilitate regulatory agency review. Dudek will complete and apply for a Nationwide Permit to the ACOE, a 401 Water Quality Certification to the RWQCB, and Section 1602 Stream bed Alteration Agreement to the CDFW. If state or federally endangered species are present on site, it is assumed that an informal streamlined Section 7 and Section 2080.1 would be completed by the agencies. To support the permit application documentation Dudek will prepare a Habitat and Mitigation and Monitoring Plan (HMMP) to meet resource agency permitting standards, The HMMP will address the preferred design option and will describe the project, the anticipated impacts, the proposed mitigation, and the restoration/revegetation implementation, maintenance and monitoring program to address project impacts and regulatory permit requirements. Additionally, if geotechnical investigations are required in the creek or adjacent wetlands, permits from the ACOE, CDFW, and RWQCB will be required, which Dudek permitting staff will assist with. Design option 1 -It is anticipated that this design option would quality for a Nationwide Permit 7 (Outfall Structures) with the ACOE. Design option 2 -It is anticipated that this design option would qualify for a Nationwide Permit 3 (Maintenance) with the ACOE. Design option 3 -It is anticipated that this design option would quality for a Nationwide Permit 7 (Outfall Structures) with the ACOE. 4.1.3 Coastal Development Permitting Advising The City has a Local Coastal Program (LCP) certified by the California Coastal Commission (CCC); however, any locally approved project within 100 feet of any wetland, estuary, or stream is appealable to CCC. Based on the preliminary information and review of the City's Post LCP Certification Permit and Appeal Jurisdiction Map, it appears that each of the potential design options would be appealable to CCC because they likely will extend within 100 feet of wetlands and Agua Hedionda Creek. Therefore, for all three design options we assume that the City would issue the CDP pursuant to the City's certified LCP, but CCC and members of the public would have an opportunity to review the local action and appeal the City's decision. Adequately resolving coastal resource issues and addressing CCC staff's comments early in the process will help to avoid CCC appeal of any City-approved CDP. Dudek coastal planners will assist the project team by evaluating the project's consistency with applicable LCP policies to identify potential issues, and participating in discussions of the proposed design, including the design options analysis, impact determinations, and proposed mitigation. with the goal of providing overall strategic and policy advice. Based on this consistency analysis, Dudek coastal planners will also participate in one virtual meeting with resource agency staff, including CCC staff, and one site visit, if necessary (Task 1.1 Agency Meetings). As appropriate, based on CCC staff feedback, Dudek will assist the Merwin Drive Storm Drain Improvement -Scope of Work 9 Sept 14, 2021 Item #2 Page 24 of 32 DocuSign Envelope ID: 5D955F00-7766-41CC-A558-62830345E296 DUDEK project team to make project modifications to demonstrate the project's consistency with LCP coastal resource protection policies. Based on direction in the RFP to "obtain all necessary permits that are not issued by the city" this scope assumes that the City will prepare the CDP application and perform tasks necessary to obtain the local CDP. Dudek can provide services related to preparation and processing of the City CDP subject to an additional scope and hours. In addition, should an appeal be filed, Dudek can support the City through CCC appeal process subject to an additional scope and hours. The scope and cost for coastal permitting support services does not vary by design option. 4.2 Environmental Documentation/CEOA In the selection of a preferred design option from a CEQA perspective, a solution that minimizes environmental impacts is the key consideration. To leave the current conditions as is and to do no improvements is not considered a viable option. The findings from this design option analysis phase will be incorporated into the technical reports and Initial Study/Mitigated Negative Declaration (IS/MND) to be prepared for the selected design option. The proposed technical analyses to be prepared would include Air Quality and Greenhouse Gas Emissions, Cultural and Paleontological Resources, and Noise. The preparation of these technical analyses, as well as preparation of the IS/MND would evaluate the potential environmental impacts of the selected design option. The previously prepared scope and cost for environmental documentation would not substantially vary by design option; however, for the purposes of this design options analysis phase, a high-level summary of each design option has been provided below for each environmental technical area. 4.2.1 Air Quality and Greenhouse Gas Emissions Dudek will prepare a combined technical memorandum assessing the air quality and greenhouse gas (GHG) emissions impacts of the selected design option utilizing the significance thresholds in Appendix G of the CEQA Guidelines and the San Diego Air Pollution Control District's (SDAPCD's) emissions-based thresholds as the basis. After reviewing all available project materials, Dudek will prepare a request for any outstanding data needed to conduct the analysis. For the Air Quality Assessment to be prepared for the selected design option, Dudek will estimate emissions associated with construction of the selected design option using the California Emissions Estimation Model (CalEEMod). The analysis of short-term demolition and construction emissions will be based on scheduling information (e.g., overall construction duration, phasing and phase timing) and probable construction activities (e.g., construction equipment type and quantity, workers, and haul trucks) developed by the City and/or standardized approaches. It is assumed that construction of the project can be modeled in one CalEEMod construction run. Based on initial review of project objectives, 1) use of a stationary source is not anticipated (e.g., emergency generators), therefore it would not require a SDAPCD permit; 2) it is assumed the improvements to the existing City-owned earthen drainage channel would not increase the operational air quality emissions; and 3) it is assumed that project-related traffic would not generate substantial concentrations of criteria air pollutant emissions because the project will not generate a net increase in vehicle trips. These assumptions would apply to all identified design options, and operational impacts would be qualitatively evaluated for the selected altnerative .. For the Greenhouse Gas Emissions Assessment to be prepared for the selected design option, Dudek will estimate the GHG emissions associated with construction of the selected design option using CalEEMod based on the same construction scenario utilized in the air quality analysis. Construction emissions will be amortized. Merwin Drive Storm Drain Improvement -Scope of Work 10 Sept 14, 2021 Item #2 Page 25 of 32 DocuSign Envelope ID: 5D955F00-7766-41CC-A558-62830345E296 DUDEK Consistent with the assumptions in the air quality analysis, it is assumed no net change in long-term traffic volume; therefore, the selected altneratives's operational impacts will be qualitatively evaluated. The emissions from the selected design option will be compared to the screening threshold within the City's Climate Action Plan (CAP) and it is expected that none of the proposed design options would be subject to the updated CAP checklist. For the Energy Assessment to be prepared for the selected design option, Dudek will assess if the selected design option would 1) result in potentially significant environmental impact due to wasteful, inefficient, or unnecessary consumption of energy resources, during construction or operation, and 2) conflict with or obstruct a state or local plan for renewable energy or energy efficiency. The selected design option will be assessed for construction energy consumption to the extent estimation methods and project-specifics are available. The energy analysis will be prepared consistent with the air quality and GHG assessments. Design option 1-It is anticipated that under this design option, ground disturbance will be required to facilitate the pipeline installation from the inlets in Merwin Street to Agua Hedionda Creek. Construction equipment for potholing and proposed improvements would be required. Construction associated with Design option 1 would occur closest to sensitive receptors (existing residences). Design option 2 -It is anticipated that under this design option, the existing desilting basin (located within the Evans Point Detention Basin) would be disturbed in order to install the necessary storm drain improvements. Although no potholing would be required for this design option, it is anticipated that Design option 2 could result in the most amount of ground disturbance due to the volume of sediment that has collected in the desilting basin that would be removed. Design option 3 -It is anticipated that under this design option the storm drain would be located within/under the existing unvegetated access road, and that the tie-in/daylight point of the new storm drain would be at an outfall location along the bank of Agua Hedionda Creek. Construction equipment for potholing and proposed improvements would be required. 4.2.2 Cultural and Paleontological Resources Dudek will complete a cultural resources inventory to comply with CEQA and City regulations. The study will begin by conducting a search of the South Coastal Information Center (SCIC) database. The records search will cover the project area and a one-mile radius of the project area. In addition to a review of previously prepared site records and reports, the records search will also review historical maps of the project area, ethnographies, the National Register of Historic Places (NRHP), the California Register of Historical Resources (CRHR), the California Historic Property Data File, and the lists of California State Historical Landmarks, California Points of Historical Interest, and Archaeological Determinations of Eligibility. Dudek will request a search of the Sacred Lands File at the California Native American Heritage Commission (NAHC) to identify any known tribal cultural resources in the area and will send outreach letters to request information on tribal cultural resources in the area. This process is to inform the cultural resources inventory and does not constitute consultation with tribes. The City is responsible for formal consultation with local Native American tribes under California Assembly Bill (AB) 52, therefore, Dudek will refrain from contacting individual tribes pertaining to consultation. Following background research, Dudek will conduct a pedestrian survey of the project area for cultural resources (including prehistoric and historic archaeological resources and built environment resources) with a Luisefio Native American monitor. We assume that no cultural resources will be identified that require formal documentation on Department of Parks and Recreation (DPR) 523 series resource records, whether archaeological or built environment, and as a result, no significance evaluations are included. Dudek will prepare a draft Negative Cultural Resources Survey Report for the selected design option, formatted according to CEQA and City of Carlsbad guidelines. The report will discuss the potential for project construction to impact cultural resources, pursuant to CEQA and Carlsbad regulations. Additionally, Dudek will complete a paleontological resources inventory. Dudek's qualified paleontologist will complete a records search at the San Diego Natural History Museum to determine the location of any previously recorded fossil discoveries. The records search will also provide information necessary to develop paleontological sensitivity determinations for the project area. Dudek's field technician conducting the pedestrian survey of the project area will be dual qualified for archaeology and paleontology. The survey will focus on areas of the project with moderate to high sensitivity. Dudek will prepare a paleontological resources letter report for the selected design option, that will include all necessary information, including records search results, field survey results, and initial paleontological sensitivity determinations, and provide recommendations for future management considerations or treatment. It is assumed that any existing geotechnical and paleontological resource reports will be provided to Dudek, and that no resources are identified during field work that require formal documentation and/or recovery. Design option 1-It is anticipated that under this design option, ground disturbance will be required to facilitate the pipeline installation from the inlets in Merwin Street to Agua Hedionda Creek. Potholing would be required under this Design option, however, ground disturbance would primarily occur within previously disturbed areas. Pending the results of the cultural resources inventory and the City's Native American consultation, archaeological and/or Native American monitoring during this ground disturbance may be recommended. Design option 2 -It is anticipated that under this design option, the existing desilting basin {located within the Evans Point Detention Basin) would be disturbed in order to install the necessary storm drain improvements. Although no potholing would be required for this design option, it is anticipated that Design option 2 could result in the most amount of ground disturbance due to the volume of sediment that has collected in the desilting basin that would need to be removed. Pending the results of the cultural resources inventory and the City's Native American consultation, archaeological and/or Native American monitoring during this ground disturbance may be recommended. The existing ambient 01:1tdoor sound environment will be quantified with up to a total of four (4) noise level measurements at sample noise-sensitive receiver locations adjacent to the project site. Project-attributed construction noise and groundborne vibration levels will be predicted with methods and tools at Dudek discretion. If potentially significant impacts assessed vis-a-vis relevant City standards and guidance per CEQA are predicted, conceptual mitigation measure options will be proposed to reduce construction noise /vibration impacts to less than significant levels. Considering the nature of the project, operational noise impacts would not occur. Design option 2 - It is anticipated that under this design option, the existing desilting basin (located within the Evans Point Detention Basin) would be disturbed in order to install the necessary storm drain improvements. Although no potholing would be required for this design option, it is anticipated that Design option 2 could result in the most amount of ground disturbance due to the volume of sediment that has collected in the desilting basin that would be removed. Considering the nature of the project, operational noise impacts would not occur. 4.2.4 Preparation of Initial Study/Mitigated Negative Declaration As described above, Dudek will prepare the IS/MND for the selected design option based on findings from the technical reports, regulatory permitting requirements, engineering services outlined under Element 3 above, and this design options analysis. The IS/MND will be prepared in conformance with the criteria, standards, and provisions of CEQA, the California Public Resources Code Section 21000 et. seq., and the state CEQA guidelines. Dudek will conduct the environmental analysis of the selected design option based on the data, background information, and technical studies collected and prepared as part of this work effort.. Element 5 -Pre p aratio n of Sp ecificatio ns and Estimates Dudek will prepare a list of bid items and quantities for inclusion in the project specifications (front end and technical) that will be prepared by the City. A construction cost estimate will be prepared as part of this task for each design submittal, increasing in detail as the project design progresses and will be set up to so the bid descriptions match the cost estimate. It is assumed the geotechnical engineer will review the project specifications provided by the City at the 70% and 100% submittal. El em ent 6 -Const ructio n Support Services Dudek will support the City during the construction phase by providing services as needed by the City, including submittal review and addressing requests for information. The Dudek team will respond to design related RFls and submittals and attend a pre-construction or project coordination meeting. Once the project has been deemed complete, Dudek engineers will review the redline construction plans and will prepare the record as-build plans for archive by the City based on a standalone set of contractor redlines that do not include significant reference documents. Updated data will also be provided for th.e City's graphical information system. It is assumed that no geotechnical RFls or site visits will be required. It is also assumed that the bid support services will not be needed for this project.
