L Contractor shall protect all construction and landscaping from damage and, when
required, provide guards or covering, Any damage shall be repaired or replaced at
the Contractor's expense. Contractors on the job shall carry the following Insurance:
(a) Worker's Compensation, (b) Public Comprehensive General Liability, and (c)
Property Damage. In an emergency threatemng the safety oflife, work or adjoining
property, the Contractor is hereby instructed to act at his discretion to prevent such
loss or injury and shall maintain the following minimum liability insurance coverage
during the contract period.
COVERAGE
Bodily Injury: $250,000 per Individual, per Occurrence
Property Damage: $ I 00,000 per Occurrence, aggregate
2. The Contractor shall cause to be named as additional insured in such Contractor's
Public Liability, Contractor's Protective Liability and Automobile Liability Insurance
policies the following: (a) D.R. Horton, 1010 South Coast Highway 101, Suite IOI,
Encinitas, CA 92024 (b) Gillespie Design Group Inc., 8910 University Center Lane,
Suite 580, San Diego, CA 92122.
3. Contractor shall not canse this policy to be canceled or permit it to lapse, and the
insurance policy shall include a clause to the effect that the policy shall not, at any
time during the construction period, be canceled or reduced, restricted or limited
until fifteen ( 1 S) days after all additional insureds have received written notice as
evidenced by returned receipts of registered or certified letters.
4. The Contractor agrees to hold the Owner and Landscape Architect harmless from
any claims arising out of his operations of any of his sub contractors, material
supplies, or agents.
5. All local, municipal and state laws, rules and regulations governing or relating to
any portion of this work are hereby incorporated into and made a part of these
specifications and their provisions shall be carried out by the contractor.
6. The contractor shall verify the locations of all existing utilities, structures, and
services before commencing work. The locations of utilities, structures and services
shown in these plans are approximate only. Any discrepancies between these plans
and actual field conditions shall be reported to the owner or landscape architect.
7. The contractor shall protect all existing utilities and features to remain on, and
adjacent to, the project site during construction. Contractor shall repair, at his own
expense, all damage resulting from his operations or negligence.
8. The contractor shall obtain the pertinent engineering and/or architectural plans
before beginning work.
9. Permits for any construction depicted in these plans shall be obtained by the
contractor.
I 0. Contractor shall have a valid contractors license required for the particular work
being done. Contractor shall not allow the license(s) to lapse during the contract
period.

GENERAL CONDITIONS SHORT FORM
PART 1 -GENERAL
1.1. DESCRIPTION
1.1.1. All provisions of the "General Conditions of the Contract for
Construction", A.I.A. Document A201, 1976 Edition, shall apply to the
work as if bound herein. Copies ore available at the A.LA. Office,
233 A Street, San Diego, CA 92101.
1.1.2. Under Article 4.18.1 Indemnification of the General Conditions,
delete the words "(other than the Work itself)".
1.2. GENERAL PROVISIONS/DIVISION 1 GENERAL REQUIREMENTS
1.2.1. SCOPE OF CONTRACT
1.2.1.1. The following terms, conditions, and instructions, as well as
the Landscape Architect's plans and specifications, the Contractor's
contract and shop drawings and any change orders and/or
addendum's issued by Landscape Architect shall form the General
Contract.
1.2.2. JOB FILE
1.2.2.1. The landscape Architect shall furnish the Contractor with
all drawings, specifications, revisions ordered by the Landscape
Architect, and change orders. The Contractor will furnish his
contract, any shop arawings required and a work sheet on which he
will note any deviation from the Contract not otherwise covered.
The Contraclor will keep a field set of drawings, updated weekly,
upon which deviotions are noted, work sheet, shop drawings and on
ttie job at all times.
1.2.3. PERMITS AND SURVEYS
1.2.3.1. The Owner shall establish all lot lines and restrictions. All
other lines, grades, and levels shall be established by the
Contractor and he shall verif_y all dimensions, lines, and grades
indicated on the drawings. The Owner shall furnish all surveys.
Permits and licenses required for execution of the work shalr be
procured and paid for by the Contractor.
1.2.4. CONTRACTOR'S/LANDSCAPE ARCHITECT'S RESPONSIBILITIES
1.2.4.1. The Contractor shall give efficient supervision to the work,
using his best skill and attention. When absent from the job, he
shall appoint a supervisor capable of discussing minor matters with
the Owner and Landscape Architect on the site. He shall carefully
study and compare all drawings, specifications, and other
instructions for the work. Any work indicated in a manner which
would make it difficult to produce first class work, or any
discrepancies of conflicts which appear between drawings and
specifications, or between specifications and local ordinances or
restrictions, shall be referred to the Landscape Architect for
interpretation or correction before proceeding with work. The
Landscape Architect shall at his discretion refer interpretations of
drawings, specifications, or continuity with local ordinances and
restrictions to the Owner and/or Engineer.
1.2.5. CHANGES
1.2.5.1. No change from the General Contract shall be made
without authorizofion from the City Inspector and the Landscape
Architect. All such instructions shall be in writing on a "Chan9e
Order" form. Unless Contractor notifies Landscape Architect within
forty-eight ( 48) hours upon receipt of a Change Order, such Order
shall constitute a part of the General Contract. The Landscape
Architect shall have authority to make minor changes. Any changes
involving extra cost, alteration of the overall apl)earance of the
project shall be counter-signed by the Owner. The Landscape
Architect may instruct the Contractor to issue Change Orders for
any addition, alteration, or deduction he wishes to make. The
contract price shall be adjusted by equitable agreement to cover
such changes. If any insfruction by Landscape Architect involves
extra cost to the Contractor, he stiall give written notice to the
Owner before proceeding with work.
1.2.6. HIDDEN OBSTACLES
1.2.6.1. Prior to excavation into the soil, the Contractor shall
locate all cables, conduits, sewers, septic tanks, and such other
utilities as are commonly encountered underground and he shall
toke proper precaution not to damage or disturb such
improvements. If a conflict exists between such obstacles and the
proposed work, he shall promptly notify the Landscape Architect,
who will arrange for relocation. Contractor will proceed in the
some manner 1f rock layers or any other condition encountered
underground makes changes advisable.
1.2. 7. PROTECTION OF LIFE AND PROPERTY
1.2. 7.1. Contractor shall protect all construction and landscaping

1.2.7.2. The Contractor shall cause to be named as additional

1.2. 7.3. Contractor shall not cause this policy to be canceled or

1.2. 7.4. The Controctor agrees to hold the Owner and Landscape
Architect harmless from any claims arising out of his operations or
the operations of any of his subcontractors, material supplies, or
agents.
1.2.8. SUBCONTRACTORS
1.2.8.1. The Contractor shall inform the Owner prior to start of
work of the names of all Subcontractors proposed, if any; and he
shall not employ any to which the Owner may object as
incompetent or unfit. Contractor agrees that he is fully responsible
to the Owner for the acts or omissions of his Subcontractors.
Nothing contained in the General Contract shall creole any
contractual relation between the Owner and any Subcontractor.
1.2.9. FINAL SITE REVIEW
1.2. 9.1. Upon completion of work, Contractor shall notify the
Landscape Architect for final site review, at which time lhe
Contractor shall be present. Any assumed or existing variance or
omission shall be noted at this time, and the Contractor shall
stipulate when and how he will rectify said variance. When these
changes, if any, hove been carried out and the areas of work
cleaned, the job shall be considered completed and the General
Con tract executed.
1.2.10. RESPONSIBILITY FOR WORKMANSHIP
1.2.10.1. Neither completion of the job nor final payment shall
relieve the Contractors of responsibility for guarantees stated in the
Contract, or of responsibility for faulty materials or poor
workmanship. The Contractors shall promptly remedy any defects
which occur during the guarantee period as specified in contract.
Notice of observed defects will be forwarded to the Contractor by
the Owner in triplicate. Contractor will return two (2) copies to
the Owner, noting thereon what action was taken. Afl questions
arising under this article shall be decided by the Owner.
1.2.11. COMPLIANCE WITH BUILDING CODES
1.2.11.1 Whenever the term "Building Code" or "Code" is used on
the drawings or in the specifications, the term means the following:
1.2.11 .1. 1. Uniform Building Code -latest edition.
1.2.11.1. 2. The Standard Specifications, Codes, and Regulations of
the City of San Diego.
PART 2 -SPECIAL CONDITIONS
2.1. SAMPLES
2.1.1. Contractor shall submit material samples to the Landscape
Architect upon request or as called for in the Contract Documents.
2.2. PRIME RESPONSIBILITY
2.2.1. The Prime Landscape Contractor shall accept complete
responsibility for all Subcontractors and perform such work as
coordination and supervision as may be required to complete the
work; such as scheduling, correcting errors and omissions, initiating
change orders and billings, normally associated with the function of
Prime Contractor, ta complete the scope of the work.
2.3. LANDSCAPE ARCHITECT'S FUNCTION
2.3.1. The Landscape Architect shall have general landscape site
review and direction of work under the General Contract as related
to interpretation of Contract Documents. He is agent of the Owner
to the extent provided in the specifications and wfien in special
instances he is authorized by tne Owner to act. As interpreter of
the landscape construction drawings and specifications as may be
necessary on occasion during construction contract, he shall side
neither with the Owner nor t:he Contractor, but use his authority
under the Contract to enforce its faithful performance.
2.4. SPECIAL RESPONSIBILITIES
2.4.1. The Contractor shall commence selection and verify the
availability of all necessary materials upon award of contract.
2.4.2. Any deposits necessary to set aside materials (either by
Owner or by Contractor) shall be arranged by the Contractor as
soon as possible.
2.4.3. The Contractor agrees, by submitting a bidt that this project
will receive a high priority on his work scheaule. he only delay
considered acceptable ore those which can be proven ta be beyond
the control of the Contractor.
2.4.4. The Contractor shall submit the name and background
experience of the proposed foreman of the job.
2.4.5. The Contractor shall secure and pay for all required permits
and fees to complete work.
2.4.6. All materials shall be standard, approved, and first grade
quality, and shall be in prime condition upon acceptance.
2.4.7. Work shall be performed when weather conditions permit
proper and satisfactory results.
2.4.8. Landscape Architect retains option to require that Contractor
receive a site observation of each operation and material prior to,
upon, and after incorporation into ttie work.
2.5. CLEAN UP
2.5.1. During progress of the work, keep the premises
reasonably free of oil debris and waste materials resulting
from the work. All debris, tools, equipment. and rubbish
shall be removed from the site on completion and before
final acceptance of the work. Debris and rubbish shall be
disposed of off-site at a legal and approved dump site.
2.6. GENERAL CONTRACTOR'S GUARANTEE
2.6.1. The Contractor shall unconditionally guarantee all work
performed and materials and equipment furnished under the
Contract against defects in materials and workmanship for a
period of one year from the date of final acceptance by the
Owner and City of the completed work, except where noted
in these specifications.

2. Any contractual obligations that subcontractor may enter
into w/ owner /general contractor are hereby included into
these plans. When conflicts occur between plans and
subcontract, the stricter shall apply.
3. These plans and dimensions are approximate only, and
field conditions may cause minor variations of whom owner,
general contractor, and landscape Architect shall be notified
by subcontractor in writing.
4. No drinking fountains or public facilities are present in
the design area.
5. The connection to existing reclaimed water service to be
provided by the City of San Diego.

CARPENTRY
1. All lumber shall be Douglas fir, No. 2 grade or better, unless otherwise indicated.
2. All lumber shall be milled, resawn, unless otherwise indicated.
3. All connectors, anchors and accessories, including nails, shall be fabricated
structural steel and shall be hot dipped galvanized.
4. All surfaces shall be painted with one (1) coat of exterior primer and two (2) coats
of weather-resistant Alkyd enamel. Color finish shall be as indicated on plans.
5. All gates shall be self-closing with steel stops.
PLANTING NOTES
1. A. THE PLANTING PLAN IS DIAGRAMMATIC. ALL PLANT LOCATIONS ARE APPROXIMATE. PLANT SYMBOLS TAKE
PRECEDENCE OVER PLANT QUANTITIES SPECIFIED.
B. QUANTITIES SHOWN ON THE PLANTING PLAN ARE APPROXIMATE ANO ARE FOR THE CONVENIENCE OF THE

CONTAINERS FOR A MINIMUM OF 6 MONTHS ANO A MAXIMUM Of TWO YEARS. PLANTS SHALL EXHIBIT HEAL THY
GROWTH ANO BE FREE OF .DISEASES AND PESTS.

10. LANDSCAPE CONTRACTOR SHALL MAINTAIN A MINIMUM OF 2% DRAINAGE AWAY FROM ALL BUILDINGS, STRUCTURES, AND
WALLS. FINISHED GRADES SHALL BE SMOOTHED TO ELIMINATE PUDDLING OR STANDING WATER.
11. FINISHED GRADES SHALL BE ONE (1) INCH BELOW THE TOP OF CURBS, SILLS, AND WALKWAYS IN ALL AREAS. WHERE
SOD IS LAID NEXT TO THESE IMPROVEMENTS-FINISH GRADE BEFORE LAYING SOD SHALL BE 1-1/2' BELOW THE TOP.
12. THE LANDSCAPE CONTRACTOR SHALL LEAVE SITE IN A CLEAN CONDITION, REMOVING ALL UNUSED MATERIAL, TRASH,
AND TOOLS.
13. LANDS[APE COONTRACTOR SHALL MAINTAIN ALL PLANTINGS FOR A PERIOD OF SIXTY (60) DAYS AFTER COMPLETION.
ALL AREAS SHALL BE KEPT CLEAN, WATERED, ANO WEED FREE.
14. AT COMPLET!OIN OF ALL WORK OUTLINED IN THESE PLANS, THE LANDSCAPE CONTRACTOR SHALL CONTACT OWNER
AND ARRANGE FOR A WALK THROUGH TO DETERMINE THAT ALL ASPECTS OF WORK ARE COMPLETED. WORK MUST BE
FULLY COMPLETED ACCORDING TO ALL PLANS AND SPECIFICATIONS ANO MUST BE COMPLETED IN A GOOD
WORKMANSHIP MANNER ANO MUST BE ACCEPTED BY THE OWNER IN WRITING PRIOR TO THE BEGINNING OF THE
MAINTENANCE PERIOD.
THE MAINTENANCE PERIOD SHALL IN(lUDE THE FOLLOWING SCOPE OF WORK,
A. DAILY WATERING OF ALL PLANT MATERIAL.
B. WEEDING AND REMOVAL OF ALL WEEDS FROM GROUND COVER AREAS.
C. REPLACEMENT OF ANY DEAD, DYING, OR □AMAG£D TREES.
□. FILLING AND REPLANTING OF ANY LOW AREAS WHICH A Y CAUSE STANDING WATER.
E. FILLING AND RECOMPACTION OF ERODED AREAS.
F, WEEKLY REMOVAL OF ALL TRASH, LITTER, CLIPPINGS, AND ALL FOREIGN DEBRIS.
14. PRIOR TO END OF MAINTENANCE PERIOD, LANDSCAPE CONTRACTOR SHALL CONT ACT OWNER ANO ARRANGE FOR A
FINAL WALK THROUGH. OWNER MUST ACCEPT ALL MAINTAINED AREAS IN WRITING PRIOR TO END OF MAINTENANCE
PERIOD.
15 A ALL GROUND COVERS SHALL BE GUARANTEED BY THE CONTRACTOR AS TO GROWTH AND HEAL TH FOR A PERIOD
OF SIXTY (60) DAYS AFTER THE COMPLETION OF MAINTENANCE PERIOD ANO FINAL ACCEPTANCE. ALL SHRUBS SHALL
BE GUARANTEE□ BY THE CONTRACTOR AS TO GROWTH AND HEALTH FOR A PERIOD OF NINETY (90) DAYS AFTER
COMPLETION OF MAINTENANCE PERIOD ANO FINAL ACCEPTANCE. ALL TREES SHALL BE GUARANTEED BY THE
CONTRACTOR TO LIVE AND GROW IN AN ACCEPT ABLE UPRIGHT POSITION FOR A PERIOD OF ONE (1) YEAR AFTER
COMPLETION OF THE SPECIFIED MAINTENANCE PERIOD AND FINAL ACCEPTANCE.
B. THE CONTRACTOR, WITHIN FIFTEEN 115) DAYS OF WRITTEN NOTIFICATION BY THE LANDSCAPE ARCHITECT,
SHALL REMOVE ANO REPLACE ALL GUARANTEED PLANT MATERIALS, WHICH FOR ANY REASON FAIL TO MEET THE
REQUIREMENTS OF THE GUARANTEE. REPLACEMENT SHALL BE MADE WITH PLANT MATERIALS AS INDICATED OR
SPECIFIED ON THE ORIGINAL PLANS, AND ALL SU[H REPLACEMENT MATERIALS SHALL BE GUARANTEED AS
SPECIFIED FOR THE ORIGINAL MATERIAL GUARANTEE.
