HIDDEN OBSTACLES: PRIOR TO EXCAVATION INTO THE SOIL, THE CONTRACTOR SHALL LOCATE ALL CABLES, CONDUITS, SEWERS, SEPTIC TANKS, AND SUCH OTHER UTILITIES AS ARE COMMONLY ENCOUNTERED UNDERGROUND AND HE SHALL TAKE PROPER PRECAUTION NOT TO DAMAGE OR DISTURB SUCH IMPROVEMENTS. IF A CONFLICT EXISTS BETWEEN SUCH OBSTACLES AND THE PROPOSED WORK, HE SHALL PROMPTLY NOTIFY THE LANDSCAPE ARCHITECT, WHO WILL ARRANGE FOR RELOCATION. THE CONTRACTOR WILL PROCEED IN THE SAME MANNER IF ROCK LAYERS OR ANY OTHER CONDITION ENCOUNTERED UNDERGROUND MAKES CHANGES ADVISABLE PROTECTION OF LIFE AND PROPERTY: THE CONTRACTOR SHALL PROTECT ALL CONSTRUCTION AND LANDSCAPING FROM DAMAGE AND, WHEN REQUIRED, PROVIDE GUARDS OR COVERING. ANY DAMAGE SHALL BE REPAIRED OR REPLACED AT THE CONTRACTOR'S EXPENSE. CONTRACTORS ON THE JOB SHALL CARRY THE FOLLOWING INSURANCE: (A) WORKER'S COMPENSATION, (B) PUBLIC COMPREHENSIVE GENERAL LIABILITY, AND (C) PROPERTY DAMAGE. IN AN EMERGENCY THREATENING THE SAFETY OF LIFE, WORK OR ADJOINING PROPERTY, THE CONTRACTOR IS HEREBY INSTRUCTED TO ACT AT HIS DISCRETION TO PREVENT SUCH LOSS OR INJURY AND SHALL MAINTAIN THE FOLLOWING MINIMUM LIABILITY INSURANCE COVERAGE DURING THE CONTRACT PERIOD. THE CONTRACTOR AGREES TO HOLD THE OWNER AND LANDSCAPE ARCHITECT HARMLESS FROM ANY CLAIMS ARISING OUT OF HIS OPERATIONS OR THE OPERATIONS OF ANY OF HIS SUBCONTRACTORS, MATERIAL SUPPLIERS, OR AGENTS. 1.2.8. SUBCONTRACTORS: 1.2.8.1. THE CONTRACTOR SHALL INFORM THE OWNER PRIOR TO START OF WORK OF THE NAMES OF ALL SUBCONTRACTORS PROPOSED, IF ANY; AND HE SHALL NOT EMPLOY ANY TO WHICH THE OWNER MAY OBJECT AS INCOMPETENT OR UNFIT. THE CONTRACTOR AGREES THAT HE IS FULLY RESPONSIBLE TO THE OWNER FOR THE ACTS OR OMISSIONS OF HIS SUB-CONTRACTORS. NOTHING CONTAINED IN THE GENERAL CONTRACT SHALL CREATE ANY CONTRACTUAL RELATION BETWEEN THE OWNER AND ANY SUBCONTRACTOR. 1.2.9. FINAL SITE REVIEW: 1.2.91 UPON COMPLETION OF THE WORK, THE CONTRACTOR SHALL NOTIFY THE LANDSCAPE ARCHITECT FOR FINAL SITE REVIEW, AT WHICH TIME THE CONTRACTOR SHALL BE PRESENT. ANY ASSUMED OR EXISTING VARIANCE OR OMISSION SHALL BE NOTED AT THIS TIME, AND THE CONTRACTOR SHALL STIPULATE WHEN AND HOW HE WILL RECTIFY SAID VARIANCE. WHEN THESE CHANGES, IF ANY, HAVE BEEN CARRIED OUT AND THE AREAS OF WORK CLEANED, THE JOB SHALL BE CONSIDERED COMPLETED AND THE GENERAL CONTRACT EXECUTED. 1.2.10. RESPONSIBILITY FOR WORKMANSHIP: 1-2.10.1. NEITHER COMPLETION OF THE JOB NOR FINAL PAYMENT SHALL RELIEVE THE CONTRACTOR OF RESPONSIBILITY FOR GUARANTEES STATED IN THE CONTRACT, OR OF RESPONSIBILITY FOR FAULTY MATERIALS OR POOR WORKMANSHIP. ALL APPLICABLE STATE AND LOCAL CODES ANO REGULATIONS. CARLSBAD MUNICIPAL WATER DISTRICT RECLAIMED WATER STANDARDS, LATEST EDITION. PART 2: SPECIAL CONDITIONS 2.1. SAMPLES; 2.1.1. THE CONTRACTOR SHALL SUBMIT MATERIAL SAMPLES TO THE LANDSCAPE ARCHITECT UPON REQUEST OR AS CALLED FOR IN THE CONTRACT DOCUMENTS. 2.2. PRIME RESPONSIBILITY: 2.2.1. THE PRIME LANDSCAPE CONTRACTOR SHALL ACCEPT COMPLETE RESPONSIBILITY FOR ALL SUBCONTRACTORS AND PERFORM SUCH WORK AS COORDINATION AND SUPERVISION AS MAY BE REQUIRED TO COMPLETE THE WORK; SUCH AS SCHEDULING, CORRECTING ERRORS AND OMISSIONS, INITIATING CHANGE ORDERS AND BILLINGS, NORMALLY ASSOCIATED WITH THE FUNCTION OF THE PRIME CONTRACTOR, TO COMPLETE THE SCOPE OF THE WORK. 2.3. LANDSCAPE ARCHITECT'S FUNCTION: 2.3.1. THE LANDSCAPE ARCHITECT SHALL HAVE GENERAL LANDSCAPE SITE REVIEW AND DIRECTION OF WORK UNDER THE GENERAL CONTRACT AS RELATED TO INTERPRETATION OF CONTRACT DOCUMENTS. HE IS AGENT OF THE OWNER TO THE EXTENT PROVIDED IN THE SPECIFICATIONS AND WHEN IN SPECIAL INSTANCES HE IS AUTHORIZED BY THE OWNER TO ACT. AS INTERPRETER OF THE LANDSCAPE CONSTRUCTION DRAWINGS AND SPECIFICATIONS AS MAY BE NECESSARY ON OCCASION DURING THE CONSTRUCTION CONTRACT, HE SHALL SIDE NEITHER WITH THE OWNER NOR THE CONTRACTOR, BUT USE HIS AUTHORITY UNDER THE CONTRACT TO ENFORCE ITS FAITHFUL PERFORMANCE. 24 SPECIAL RESPONSIBILITIES: 2.4.1. THE CONTRACTOR SHALL COMMENCE SELECTION AND VERIFY THE AVAILABILITY OF ALL NECESSARY MATERIALS UPON AWARD OF CONTRACT. 2.4.2. ANY DEPOSITS NECESSARY TO SET ASIDE MATERIALS {EITHER BY THE OWNER OR BY THE CONTRACTOR) SHALL BE ARRANGED BY THE CONTRACTOR AS SOON AS POSSIBLE. 2.4.3. THE CONTRACTOR AGREES, BY SUBMITTING A BID, THAT THIS PROJECT WILL RECEIVE A HIGH PRIORITY ON HIS WORK SCHEDULE. THE ONLY DELAYS CONSIDERED ACCEPTABLE ARE THOSE WHICH CAN BE PROVEN TO BE BEYOND THE CONTROL OF THE CONTRACTOR. 244. THE CONTRACTOR SHALL SUBMIT THE NAME AND BACKGROUND EXPERIENCE OF THE PROPOSED FOREMAN OF THE JOB. 2.4 5 THE CONTRACTOR SHALL SECURE AND PAY FOR ALL REQUIRED PERMITS AND FEES TO COMPLETE THE WORK. 2.4.6. ALL MATERIALS SHALL BE OF STANDARD, APPROVED, AND FIRST GRADE QUALITY, AND SHALL BE IN PRIME CONDITION UPON ACCEPTANCE. 2.4.7. THE WORK SHALL BE PERFORMED WHEN WEATHER CONDITIONS PERMIT PROPER AND SATISFACTORY RESULTS. 2.4.8. THE LANDSCAPE ARCHITECT RETAINS OPTION TO REQUIRE THAT THE CONTRACTOR RECEIVE A SITE OBSERVATION OF EACH OPERATION AND MATERIAL PRIOR TO, UPON, AND AFTER INCORPORATION INTO THE WORK. 2.5 CLEAN UP: 2.5.1, DURING PROGRESS OF THE WORK, KEEP THE PREMISES REASONABLY FREE OF ALL DEBRIS AND WASTE MATERIALS RESULTING FROM THE WORK. ALL DEBRIS, TOOLS, EQUIPMENT, AND RUBBISH SHALL BE REMOVED FROM THE SITE ON COMPLETION AND BEFORE FINAL ACCEPTANCE OF THE WORK. DEBRIS AND RUBBISH SHALL BE DISPOSED OF OFF-SITE AT A LEGAL AND APPROVED DUMP SITE. 2.6. GENERAL CONTRACTOR'S GUARANTEE: 2.6.1. THE CONTRACTOR SHALL UNCONDITIONALLY GUARANTEE ALL WORK PERFORMED AND MATERIALS AND EQUIPMENT FURNISHED UNDER THE CONTRACT AGAINST DEFECTS IN MATERIALS AND WORKMANSHIP FOR A PERIOD OF ONE YEAR FROM THE DATE OF FINAL ACCEPTANCE BY THE OWNER AND THE CITY OF THE COMPLETED WORK, EXCEPT WHERE NOTED IN THESE SPECIFICATIONS. SECTION 02810 -POTABLE WATER IRRIGATION SYSTEM PART 1 -GENERAL 1.1. 1.1.1. 1.2. 1.2.1. 1.2.2. 1.3. 1.3.1. 1.4. 1.4.1. 1.4.2. 1.4.3. 1.4.4. 1.4.5 RELATED DOCUMENTS: DRAWINGS AND GENERAL PROVISIONS OF CONTRACT, INCLUDING GENERAL AND SUPPLEMENTARY CONDITIONS AND DIVISION-1 SPECIFICATION SECTIONS, APPLY TO WORK OF THIS SECTION. DESCRIPTION OF WORK: THE WORK CONSISTS OF FURNISHING LABOR, TOOLS, MACHINERY, MATERIALS, AND PROCESSES REQUIRED TO COMPLETE THE SPRINKLER IRRIGATION SYSTEM DESCRIBED HEREIN AND SHOWN ON THE DRAWINGS. QUALITY ASSURANCE: SUBCONTRACT WORK TO A SINGLE FIRM SPECIALIZING IN IRRIGATION WORK. CONTRACTOR SHALL POSSESS ALL LICENSES AND PERMITS REQUIRED TO PERFORM THE WORK OF THIS CONTRACT INCLUDING A C-27 LANDSCAPING LICENSE. SUBMITTAL$: THE CONTRACTOR SHALL FURNISH THE ARTICLES, EQUIPMENT, MATERIALS OR PROCESSES SPECIFIED BY NAME IN THE DRAWINGS AND SPECIFICATIONS.
