GENERAL PROVISIONS/DMSION 1 GENERAL REQUIREMENTS 1.2,1. SCOPE OF CONTRACT 1.2.1.1. The following terms, conditions, and instructions, u well as the Landscape Architect's plans and specifications, the Contractor's contract and shop drawings and any change orders and/or addendum's issued by Landscape Architect shall form the General Contract. 1.2.2. JOB FILE 1.2.2.1. The landscape Architect llhall furni■h the Contractor with all drawings, specifications, revisions ordered by the Landscape Architect, and change orders. The Contractor will furnish his contract, any shop drawings required and a work sheet on which he will note any deviation from the Contract not otherwise covered. The Contractor will keep a field set of drawings, updated weekly, upon which deviations are noted, work sheet, shop drawings and on the job at all times. 1.2.3. PERMITS AND SURVEYS 1.2.3.1. The 011'ller ohall establish all lot line■ and restriction■. All other lines, gradea, and levela shall be established by the Contractor and he shall verify all dimensions, lines, and grades indicated on the drawings, The 01\'ller shall furnish all surveys. Permits and licenses required for execution of the work shall be procured and paid for by the Contractor. 1.2.4. CONTRACTOR'S/LANDSCAPE ARCHITECT'S RESPONSIBILITIES 1.2.4.1. The Contractor shall give efficient supervision to the work, using his best skill and attention. When absent from the job, he shall appoint a supervisor capable of discussing minor matters with the Owner and Landscape Architect on the site. He shall carefully study and compare all drawings, specifications, and other instructions for the work. Any work indicated in a manner which would make it difficult to produce first class work, or any discrepancies of conflicts which appear between drawings and specifications, or between specifications and local ordinances or restrictions, shall be referred to the Landscape Architect for interpretation or correction before proceeding with work. The Landscape Architect shall at his discretion refer interpretations of drawings, specifications, or continuity with local ordinances and restrictious to the Owner and/or Engineer, 1.2.5. CHANGES 1.2.5.1. No change from the General Contract shall be made without authorization from the City Inspector and the Landscape Architect. All such instructions shall be in writing on " "Chllilge Order" form. Unless Contractor notifies Landscape Architect within forty-eight (48) hours upon receipt of a Change Order, such Order shall constitute a part of the General Contract. The Landscape Architect shall have authority to make minor changes. Any changes involving erlra cost, alteration of the overall appearance of the project shall be counter-signed by the Owner. The Landscape Architect may instruct the Contractor to issue Change Orders for any addition, alteration, or deduction he wishes lo make. The contract price shall be adjusted by equitable agreement to cover such changes. If any instruction by Landscape Architect involves extra cost to the Contractor, he shall give written notice to the Owner before proceeding with work. 1.2.6. HIDDEN OBSTACLES 1.2.6.1. Prior to excavation into the ■oil, the Contractor ■hall locate all cables, conduits, sewers, septic tanks, and such other utilities as are commonly encountered underground and he shall take proper precaution not to damage or disturb such improvements. If a conflict exists between such obstacles and the proposed work, he shall promptly notify the Landscape Architect, who will arrange for relocation. Contractor will proceed in lhe same manner if rock layers or any other condition encountered underground makes changes adviaable. 1.2.7. PROTECTION OF LIFE AND PROPERTY 1.2.7.1. Contractor shall protect all construction and landscaping from damage and, when required, provide guard• or covering. Any damage shall be repaired or replaced at the Contractor's expense. Contractors on the job shall carry the following insurance: (a) Worker's Compensation, (b) Public Comprehensive General Liability, and (c) Property Damage. In an emergency threatening the safety of life, work or adjoining property, the Contractor is hereby instructed to act at his discretion to prevent such loss or injury and shall maintain the following minimum liability insurance coverage during the contra.cl period. COVERAGE Bodily Injury -$250,000 per Individual Per Occurrence Property Damage -$100,000 Per Occurrence Aggregate 1.2.7.2. The Contr10ctor shall cause to be named as additional insured in such Contractor's Public Liability, Contractor's Protective Liability and Automatic Liability Insurance policies the following: Gillespie Design Group, Inc. 8910 University Center Lane, ,11580 San Diego, CA 92122 1.2.7.3. Contractor shall not cau1e thi1 policy to be canceled or permit it to lapae, and the inaurance policy shall include a clause to the effect that the policy shall not, at any lime during the construction period, be canceled or reduced, restricted or limited until fifteen (15) days after all additional insureds have received written notice as evidenced by returned receipts of registered or certified letters. 1.2.7.4. The Contractor agrees to hold the Owner l!IIld Landscape Architect harmless from any claims arising out of his operations or the oper10tions of 10ny of his subcontractors, m10terial supplies, or sgenh. 1.2.8. SUBCONTRACTORS 1.2.8.1. The Contractor shall inform the Owner prior to start of work of the names of all Subcontractors proposed, if any; and he shall not employ any to which the Owner may object as incompetent or unfit. Contractor agrees that he is fully responsible to the Owner for the acts or omissions of his Subcontractors. Nothing contained in the General Contract shall create any contractual relation between the 01\'ller and any Subcontractor. 1.2.9. FINAL SITE REVlEW 1.2.9.1. Upon completion of work, Contractor shall notify the Landscape Architect for final site review, at which time the Contr10ctor shall be present. Any assumed or existing variance or omission shall be noted at this time, and the Contractor shall stipulate when and how he will rectify said variance. When these changes, if any, have been carried out and the areas of work cleaned, the job shall be considered completed and the General Contract executed. 1.2.10. RESPONSIBIUTY FOR WORKMANSHIP 1.2.10.1. Neither completion of the job nor fhi.81 payment Kh8ll relieve the Contractors of responsibility for guarantees stated in the Contract, or of responsibility for faulty materials or poor workmanship. The Contractors shall promptly remedy any defects which occur during the guar10ntee period as specified in contract. Notice of observed defects will be forwarded to the Contractor by the Owner in triplicate. Contractor will return two (2) copies to the Owner, noting thereon what action was taken. All questions arising under this article shall be decided by the Owner. 1.2.11. The Landsc8pe Architect sh8ll have general l8ndsc8pe site review and direction of work under the General Contract as related to interpretation of Contract Documents. He is agent of the Owner to the extent provided in the specifications and when in special instances he is authorized by the 01\'ller to 10ct. As interpreter of the landscape construction drawings and specifications as may be necessary on occasion during construction contract, he shall side neither with the 01\'ller nor the Contractor, but use his authority under the Contract to enforce its faithful performance. 2.4. SPECIAL RESPONSIBILlTIES 2.4.1. The Contractor shall commence selection and verify the availability of all necessary materials upon award of contract. 2.4.2. Any deposits necessary lo set aside materials (either by 01\'ller or by Contr10ctor) shall be arranged by the Contractor as soon as possible. 2.4.3. The Contractor agrees, by 1mbmlttlng a bid, that this project will receive a high priority on his work schedule. The only delay considered acceptable are those which can be proven to be beyond the control of the Contractor. 2.4.4. The Contractor shall •ubmit the name and background experience of the proposed foreman of the job. 2.4.5. The Contractor shell secure and pay for all required permits and fees to complete work. 2.4.6. During progress of the work, keep the premises reasonably tree of all debris and waste materials resulting from the work. All debris, toola, equipment, and rubbish shall be removed from the site on completion and before final acceptance of the work. Debris and rubbish shall be disposed of off-site at a legal and e.pproved dump site. 2.6. GENERAL CONTRACTOR'S GUARANTEE 2.6.1.
