Subject: Adoption of Ordinance Restricting Overnight Parking on Armada Drive Between Palomar Airport Road and Legoland Drive
Recommended Action
Support staff’s recommendation to add section 10.40.301 to the Carlsbad Municipal Code to
establish no parking zones between 11 p.m. and 5 a.m. along both sides of Armada Drive
between Palomar Airport Road and Legoland Drive.
Discussion
The City of Carlsbad has received several complaints regarding recreational vehicles and
passenger vehicles parking overnight and for extended periods on Armada Drive. Businesses,
represented by the Carlsbad Ranch Maintenance Association II, in the area report that
recreational vehicles and vans park on Armada Drive overnight, using the parking islands and
promenade as a trash receptacle, kitchen and bathroom.
The Carlsbad Ranch Maintenance Association II (Association) sent a letter to Carlsbad City
Manager Scott Chadwick and the City Council, dated Sept. 28, 2021, concerning the Armada
Drive Promenade. (Exhibit 2.)
The letter from Covey Commercial Real Estate Service, the property management service for
the Association, stated, “Over the last couple months, we have received numerous complaints
from the Carlsbad Ranch Owners Association regarding Armada Drive being used by RVs and
vans for long term parking and use.”
Amongst the primary concerns expressed in the letters received from the Association members
was that Armada Drive Promenade has deteriorated into a health and safety hazard to all who
use the area. The letters from the Association all stated the following, “This once beautiful
vantage point to view the Pacific Ocean and Flower Fields has degraded into an unsightly
encampment of RV’s and vans. Every morning upward of a dozen vehicles can be seen having
camped overnight, blocking most of the public parking, using the parking islands and
Promenade as their trash receptacle, kitchen and bathroom. The eyesore and stench have
become unbearable, and certainly not in keeping with the intended use for this area.”

Over the past six months the Carlsbad Police Department has responded to twelve parking
complaints on Armada Drive and one municipal code violation.
On Oct. 7, 2021, Police Department Lieutenant Steve Thomas met with a representative of
Covey Commercial Real Estate Service, to discuss how the represented businesses may be
impacted by a prohibition on overnight parking on Armada Drive between the hours of 11 p.m.
and 5 a.m.
All of the businesses represented by Covey Commercial Real Estate Service were in support of
restricting overnight parking on Armada Drive. Businesses represented by Covey Commercial
Real Estate Service include; Lego Land, Gemological Institute of America, CB Ranch Enterprises,
Grand Pacific Palisades Resort and Hotels, Grand Pacific Carlsbad Hotel Westin Sheraton, Joe
Lamond NAMM President and CEO, Carlsbad Ranch Lot 15, Regent Properties and M & A
Gabaee.
The proposed ordinance would establish no parking zones between 11 p.m. and 5 a.m. along
both sides of Armada Drive between Palomar Airport Road and Legoland Drive.
Financial Analysis
The preliminary cost estimate accounts for producing and installing signs with the new
restrictions along both sides of Armada Drive between Palomar Airport Road and Legoland
Drive.

Next Steps
Following the Traffic and Mobility Commission’s review, staff will present the proposed
ordinance to City Council and recommend that City Council adopt the ordinance establishing no
parking zones between 11 p.m. and 5 a.m. on Armada Drive between Palomar Airport Road and
Legoland Drive.

ORDINANCE NO. .
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ADDING SECTION 10.40.301 OF THE CARLSBAD
MUNICIPAL CODE TO ESTABLISH NO PARKING ZONES ALONG BOTH
SIDES OF ARMADA DRIVE BETWEEN PALOMAR AIRPORT ROAD AND
LEGOLAND DRIVE BETWEEN THE HOURS OF 11 P.M. AND 5 A.M.
WHEREAS, the City of Carlsbad has received numerous reports of individuals parking
vehicles overnight along Armada Drive and leaving trash and human waste along the sidewalk;
and
WHEREAS, the Carlsbad Police Department met with Covey Commercial Real Estate
Service, the property management service for the Carlsbad Ranch Maintenance Association
whose members consist of businesses located along Armada Drive, and all businesses
represented by Covey Commercial Real Estate Service expressed support for the overnight
parking restriction; and
WHEREAS, the City Council of the City of Carlsbad has determined that it is in the interest
of public safety that a parking restriction be implemented along the westerly and easterly sides
of Armada Drive between Palomar Airport Road and Legoland Drive between the hours of 11
p.m. and 5 a.m.; and
WHEREAS, the City Planner has determined that the project is categorically exempt from
the California Environmental Quality Act (CEQA) per state CEQA Guidelines section 15301 (c) and
that no exception to the exemption as set forth in CEQA Guidelines section 15300.2 applies.
NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows
that:
1. The above recitations are true and correct.
2.That Title 10, Chapter 10.40, of the Carlsbad Municipal Code is amended by the
addition of Section 10.40.301 to read as follows:
10.40.301 Parking restricted on Armada Drive.
Parking of vehicles is prohibited between 11:00 p.m. and 5:00 a.m. on the westerly and
easterly sides of Armada Drive between Palomar Airport Road and Legoland Drive.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the
City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or
a summary of the ordinance prepared by the City Attorney to be published at least once in a
newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
