Dear Mr. Dewhurst:
Mr. Orenyak has forwarded your letter of April 22, 1985 to me for review of
the sewer fees charged for the rehabilitation of 2802 State Street. Speci-
fically, .you were charged for 1.14 additional equivalent dwelling units over
and above the previous uses. The computations are correct and the charge
is appropriate based on our current code. I have attached the pertinent
code sections and I have highlighted part of Section 13.10.020 which apply.
You did indicate that the previous appliance shop had more fixtures attached
to the sewer system and, therefore, you believe its load on the system was
greater than the current application. During the 60's and early 70's the
accepted method for computing sewer permits was on the basis of fixtures,
however, this was changed to more accurately reflect uses and, in the case
of commercial or offices, the standard is 1,800 square feet per equivalent
dwelling unit. I would also point out that when fixture count was used, the
connection fees were at $50 and, over time, increased to $250 per fixture.
The previous uses appear to have been created by add-ons which did not require
plumbing or building permits and, therefore, were not included in our system.
Mr. Orenyak has indicated that he has initiated action to refund the $1,800
licence tax fee which was collected in error, to you. The sewer fee was a
correct assessment and, therefore, a refund is not appropriate.
