Thank you for submitting a preliminary review for the subdivision of a 1.27-acre property into four lots
proposed at 3140 Highland Drive. The project site is currently developed with a single-family residence,
commonly known as the Culver-Myers-Capp House, and several detached accessory structures.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: R-4 (Residential), 0-4 units/ac.
b. · Zoning: R-1-10000, One-Family Residential (10,000-square foot minimum lot size)
2. The project requires the following permits:
a. Minor Subdivision (MS) -for the subdivision of four or fewer parcels.
3. R-1-10000 (One-Family Residential) Zone Requirements. Pursuant to CMC Section 21.10.090,
minimum lot area, the proposed subdivision meets the minimum lot size of 10,000 square feet for
each of the four proposed lots. The historic structure will need to meet the development standards
of the R-1 zone (Carlsbad Municipal Code (CMC) Chapter 21.10), which include but are not limited to:
a. Front Yard Setback: 20 Feet

b. Side Yard Setback: 10 percent of the lot width
c. Rear Yard Setback: Twice the required side yard
d. Lot Coverage: 40 percent
4. Minor Subdivisions. The proposed subdivision appears to meet the requirements of CMC Chapter
20.28 including the requirements of a panhandle-shaped or flag-shaped lot.
5. Historical Analysis. The single-family residence is likely a historical resource and was identified in a
prior City of Carlsbad Cultural Resources Survey prepared by Roth and Associates, February 18, 1990,
which can be found online at:

In accordance with the city's Tribal, Cultural, and Paleontological Resources Guidelines discretionary
projects involving buildings, structures, and facilities 45 years or older are required to evaluate their
historic significance under the California Environmental Quality Act {CEQA). Since the minor
subdivision is a discretionary action that is subject to CEQA, a historical analysis report will need to be
submitted to determine if the structure is historically significant pursuant to the CEQA and to evaluate
the impacts of the proposed minor subdivision. The report shall be consistent with the city's Tribal,
Cultural, and Paleontological Resources Guidelines, which can be found online at:

All necessary application forms, submittal requirements, and fee information are available at the Planning
counter located in the Faraday Building at 1635 Faraday Avenue or online at
https:ljwww.carlsbadca.gov/departments/community-development/planning. You may also access the
General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Please
review all information carefully before submitting.
Land Development Engineering:
1. Process a tentative parcel map to create the new lots.
2. Complete a Stormwater Standards Questionnaire. This questionnaire will guide you and the City in
determining what type of reports and storm water mitigation must be completed to satisfy state and
City storm water quality requirements. The questionnaire can be printed from the following website

Preliminary analysis suggests that the project is a Priority Development Project and must comply with
PDP stormwater requirements of the BMP Manual. A Storm Water Quality Management Plan
{SWQMP) must be prepared and submitted at time of application.

In accordance with city standards, a common area(s) will be required for po\lutant control BM P's. The
common areas can be defined by an additional lot(s) or through easements. BMPs on each lot (i.e.
single-family residential lot) of the subdivision to be maintained solely by each individual property
owner is not allowed.
3. Improvement plans for the construction of sewage facilities to serve lots 1 and 2 shall be processed
prior to recordation of the parcel map. If these facilities are not construction prior to recordation of
the parcel map, the owner shall enter into a subdivision improvement agreement.
4. Dedication of right-of-way W!II be required along Highland Avenue to create a half width of 30-feet.
5. Dedication of right-of-way will be required at the property corner of Highland Avenue and Oak Avenue
to create a city standard radius.
6. The following shall be required as part of the tentative map process
a) A-preliminary hydrology study will be required to determine the pre-developmentand post-
development discharge flows. Provide preliminary recommendations to mitigate any
increase in flows.
b) A preliminary Geotechnical study that identifies feasibility and recommendations for the
proposed project including design recommendations for proposed pollutant control BMPs
and hydromodificat_ion facilities.
c) A recent Preliminary Title Report (PTR) will be required with formal project application
submittal. ·
d) Show the proposed sewer lateral and water service to serve each lot.
e) Show complete property boundary data on the site plan, including bearings and distances.
f) Show locations of all existing public utilities within Highland Avenue and Oak Avenue,
including water main, fire hydrant, water services, water meters, sewer main, sewer laterals,
and their appurtenances. Reference the drawing numbers of the city approved
improvement plans and identify materials and sizes.
7. On the site plan, show and identify all existing surface improvements (curb, gutter, sidewalk, paving,
manholes, inlets, streetlights, adjacent driveways, vaults, transformers, etc.) at the project frontage
and within 100 feet.
8. Show the locations of all existing and proposed buildings, walls, fences, and permanent structures
onsite and within 100 feet of site.
9. Provide multiple cross-sections of the site to demonstrate differences in grade, including adjacent
properties. Provide a typical street cross section of Highland Avenue and Oak Avenue, showing
existing improvements.

10. Indicate the volume of grading (cut, fill, import, export, remedial) proposed for the project in cubic
yards.
11. Show spot elevations, grading, and method of drainage for the site, including storm drains, gutters,
swales and basins.
12. Show proposed pad elevations for each lot.
13. Please be advised that in order to make a more in-depth review of the proposed development, a more
complete design of the project is required.
14. If grading of the lots is proposed, processing of grading plans is required prior to recordation of the
parcel map.
