Meeting Date: Dec. 14, 2021 To: Mayor and City Council From: Scott Chadwick, City Manager Staff Contact: Jessica Evans, Associate Planner jessica.evans@carlsbadca.gov, 760-602-4631 Subject: The New Village Arts Theatre District: 1 Recommended Action Hold a public hearing and adopt a resolution approving a conditional use permit to allow the continued operation of a performance theater at 2787 State St. Executive Summary The city approved the New Village Arts theater on State Street for performances in 2006 as a temporary use for three years to gauge the community’s interest in allowing it to become a permanent feature in the downtown area. New Village Arts has a current five-year lease that is set to expire on April 11, 2024. In June 2020, the theater company requested to continue and expand its partnership with the city under a long-term lease agreement. In July 2021, the City Council adopted a resolution to execute a 10-year lease agreement with two, five-year extension options, as the city determined that the theater has been an integral part of the community that promotes culture and the arts, while assisting the city’s efforts to revitalize the retail and dining environment in the Village. When the operators of New Village Arts initially contacted the city in 2020 to discuss opportunities to extend its lease agreement and improve the facility and operations, staff found that a subsequent permit was never filed to make the theater use permanent. The proposed action before the City Council would approve a conditional use permit that will allow the performance theater and ancillary uses to continue to operate in the building as a permanent feature. Conditional use permits in the area covered by the Village & Barrio Master Plan require City Council approval, under Section 6.3.4 of the master plan. Discussion New Village Arts currently occupies the city-owned building at 2787 State St., where it operates a 102-seat theater, box office, mobile concession service counter for the sales and service of snacks and beverages, including alcohol, an artist workspace area (The Foundry), classrooms, offices and retail space. The theater company has operated within this space since 2006 without incident or complaint. However, during discussions over the lease extension, staff Dec. 14, 2021 Item #13 Page 1 of 35 found that a permit was never filed to make the theater a permanent allowable use in the village after the initial three-year temporary period ended. The site is zoned as Village-Center District in the Village & Barrio Master Plan, and the use of the site as a theater, along with associated ancillary uses, would be allowable with the approval of a conditional use permit. The use of the building as a theater will generally remain the same, but New Village Arts has proposed to remodel the interior to reconfigure the existing floor area. The major changes include the removal of The Foundry and the replacement of an art gallery, expansion of the box office and lobby area, relocating public restrooms, and creating a permanent concession service counter. The existing 102-seat theater will remain the same. Exterior improvements to the east and south walls are also proposed. They include removing the existing mansard roof and adding a trellis feature over the sidewalk area, horizontal and vertical wood siding and new windows. The interior and exterior modifications are being reviewed by the city under separate building permits, consistent with the requirements of the Village & Barrio Master Plan, and are not part of this conditional use permit. The approval of the conditional use permit will authorize the continued and permanent use of the property as a theater. The only significant condition being applied to the permit is the limitation that alcohol may only be served in conjunction with theater performances or special events, and that consumption of alcohol shall not be permitted outside of the building (Exhibit 3). Although it is not a condition on the permit or an issue with the theater, how the property complies with the city’s parking standards warrants discussion. According to Section 2.6.6 of the Village & Barrio Master Plan, parking for a 102-seat theatre use requires one space for every five seats, for a total of 21 parking spaces. The theater provides no on-site parking. However, the master plan allows businesses to change from one use to another without requiring additional parking, provided both uses have the same or lesser parking requirements. If the new use has a higher parking requirement than the previous use, 50 percent of the additional parking based on the higher parking requirement shall be provided. The Carlsbad Redevelopment Agency acquired the building in 1997, and in reviewing prior tenants, staff found that the previous occupant, the Bauer Lumber Company, had been required to provide 23 parking spaces. While Bauer Lumber did not provide these spaces onsite, it had a higher parking requirement than the theater. So, under the terms of the master plan, no additional parking is required for this conditional use permit. It is worth noting that the theater has been successfully operating for approximately 15 years without parking issues, and patrons use nearby public parking lots and on-street parking spaces without notable impacts to surrounding businesses. Table C within the Planning Commission staff report provides a listing of the previous uses and their parking requirements (Exhibit 4). Planning Commission hearing The Planning Commission considered the proposed project at a public hearing on Sept. 15, 2021. One comment from the public was read into the record in support of the use. After clarifying questions and discussion, the Planning Commission voted to recommend the City Council approve the project (7-0). The Planning Commission and staff recommend option 1, approving the project. Fiscal Analysis The recommended actions do not require any funding. On July 21, 2021, the City Council executed a 10-year lease agreement with New Village Art that contains two, five-year extension options with an annual lease payment of $1. In addition, the City Council appropriated $613,000 from the Capital Construction fund to reimburse New Village Arts for the installation of solar panels and a portion of the exterior improvements of the building, and to fund a construction management contract with the city. Additionally, the city has collected fees totaling $2,457 for the conditional use permit. Dec. 14, 2021 Item #13 Page 3 of 35 Next Steps Staff will ensure that the project conditions are satisfied and that the permit complies with all applicable regulations. Environmental Evaluation The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act per section 15301 - Existing Facilities, of the CEQA Guidelines because The project involves the continuation of an existing land use within an existing building that proposes no physical expansion and will not have any adverse significant impacts on the environment. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the CEQA Guidelines do not apply to this project. A notice of exemption will be filed by the City Planner upon final project approval. Public Notification and Outreach This item was noticed in keeping with Ralph M. Brown Act and it was available for public viewing and review at least 72 hours before the scheduled meeting date. The project is subject to City Council Policy No. 84 – Development Project Public Involvement Policy. On April 6, 2021, the applicant mailed an early public notice to property owners within 600 feet of the project site and posted a public notice sign on the property. On Aug. 3, 2021, the applicant mailed a project description with a comment card to property owners within 600 feet of the project site and to occupants within 100 feet of the site. These actions satisfy the requirements of the City Council policy. The theater was originally approved by the city in 2006 under an administrative permit (RP 06-12) as required at the time by the Carlsbad Village Master Plan and Design Manual. The theater was initially considered to be an interim use as New Village Arts Theatre wanted to gauge community interest and support for a live performance theater in the village area. The permit approval identified that the permit would be valid for no more than three years. Since a permit was never filed to make the theater permanent, the theater has been operating without a valid permit. The current Village and Barrio Master Plan (VBMP) requires that theaters in the VC District obtain a Conditional Use Permit (CUP) approved by the City Council. Approval of the requested CUP will validate the existing performance theater use that has operated at the site since 2006. The performance theater and ancillary uses in the building include a 102-seat performance theater, box office, concession service counter, artist workspace, classrooms, offices, and accessory retail. The applicant is proposing interior and exterior modifications that are being reviewed under separate building permits, consistent with Section 6.3.2 of the VBMP. The existing 102-seat theater area will remain in the current configuration. Other areas will be remodeled and reconfigured. Proposed exterior improvements include removing the existing mansard roof on the south and east portion of the building and adding a trellis feature over the sidewalk in this area. Horizontal and vertical wood siding are also proposed on the south and east elevations. Additional windows and openings are proposed along the Christiansen Way and State Street elevations to enhance pedestrian interest and further activate the project frontage. New signs for the project will be evaluated and approved under a separate permit submitted to the Planning Division. III. ANALYSIS The proposed project is subject to the following ordinances, standards, and policies: A. Village-Barrio (VB) General Plan Land Use Designation; B. Village-Barrio (V-B) Zone (CMC Chapter 21.35), Village Center (VC) District of the Village and Barrio Master Plan (VBMP); C. Conditional Use Permit Regulations (CMC Chapter 21.42); and D. Growth Management Ordinance (CMC Chapter 21.90), Local Facilities Management Plan Zone 1. The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable regulations and policies. Village-Barrio (VB) General Plan Land Use Designation The subject property has a General Plan Land Use designation of Village-Barrio (VB) and is within the Village Center (VC) District of the Village and Barrio Master Plan (VBMP). As discussed in Table B below, the project complies with the Elements of the General Plan. Since the Conditional Use Permit is for land use approval only, an analysis of development standards specific to the VC District, as well as the area-wide standards within the VBMP is not required. Any proposed interior or exterior tenant improvements will be evaluated for consistency with the VBMP under separate permits. Parking No parking is available on-site because the existing building covers the entire property. In the Village and Barrio Master Plan area, non-residential building space may be converted from one use to another without additional parking, provided both uses have the same parking requirements set forth within Section 2.6.6.B. of the VBMP. If the new use has a higher parking requirement than the existing use, 50 percent of the additional parking based on the higher parking requirement shall be provided. Since historical land uses in this building (retail/museum) had the same or higher parking requirement as the theater, no additional parking is required as demonstrated in Table C. However, no parking agreement currently exists, and the theater has been successfully operating for approximately 15 years without a parking agreement for off-site parking. C. Conditional Use Permit Regulations (CMC Chapter 21.42) The proposed theater is a land use which is allowed in the Village Center district of the Village and Barrio Master Plan subject to the approval of a Conditional Use Permit by the City Council. No special regulations are listed for theaters in the Village and Barrio Master Plan. Chapter 21.42 of the Carlsbad Municipal Code requires that four findings be made in order to approve a conditional use permit. All findings can be made for this project as discussed below: 1. That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives of the general plan, including the Village and Barrio Master Plan, in that the proposal to continue operations of an existing performance theater and accessory uses contribute toward the goal of maintaining and enhancing the Village as a center for residents and visitors with commercial, cultural and entertainment activities. Furthermore, the theater is consistent with the goal of providing a variety of uses that attract visitors and residents from across the community by creating a lively, interesting social environment in the Village. The project supports walkability and mobility by locating near residential and commercial land uses. Additionally, the proposed project is located adjacent to the Carlsbad Village transit station, which provides rail and bus service throughout the day. Dec. 14, 2021 Item #13 Page 18 of 35 2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located in that the Village Center (VC) District of the Village and Barrio Master Plan (VBMP) allows for a variety of permitted and conditionally- permitted uses, including theaters. The surrounding properties are also located within the VC District of the VBMP and include uses such as restaurants, retail, a brewery tasting room and a bus and train transit center. In addition, several multi-family residential developments are located within a quarter-mile radius of the property. Given the variety of the surrounding land uses, the continued operation of a performance theater within the existing building will not be detrimental to existing uses or uses permitted in the VC District of the VBMP. 3. That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the City Planner, planning commission or city council, in order to integrate the use with other uses in the neighborhood, in that the project proposes to continue the existing theater use within the existing building on the northwest corner of Christiansen Way and State Street in the Village Center (VC) District of the VBMP. Since the building takes up the entire lot, no on-site parking is feasible. Furthermore, in the Village and Barrio Master Plan area, non-residential building space may be converted from one use to another without additional parking, provided both uses have the same parking requirements set forth within Section 2.6.6.B. of the VBMP. If the new use has a higher parking requirement than the existing use, 50 percent of the additional parking based on the higher parking requirement shall be provided. Since historical land uses in this building (retail/museum) had the same or higher parking requirement as the theater, no additional parking is required as demonstrated in Table C above. All interior and exterior improvements that are not part of this permit have been, or will be, evaluated for consistency with the VBMP during the building permit process. 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that the surrounding streets have adequate capacity to accommodate the 110 Average Daily Trips (ADT) generated by the project. In addition, State Street and Christiansen Way are fully improved with pavement, curb, gutter and sidewalks. D. Growth Management The proposed project is located within Local Facilities Management Zone 1 in the Northwest Quadrant of the city. Since no new land uses are proposed, the continued operation of the existing performance theater will not have any additional impacts on public facilities. Furthermore, the project site will continue to be served by State Street and Christiansen Way, which are fully improved public streets with curb, gutter and sidewalk. IV. ENVIRONMENTAL REVIEW The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301, “Existing Facilities,” of the State CEQA Guidelines as the project involves the continuation of an existing land use (theater) within an existing building which will not have any adverse significant impact on the environment. A Notice of Exemption shall be filed with the County Clerk upon approval of this project. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. DEVELOPMENT PROJECT PUBLIC INVOLVEMENT POLICY The proposed project is subject to the Early Public Notice and the Enhanced Stakeholder Outreach processes outlined in City Council Policy No. 84 – Development Project Public Involvement Policy. The policy requires applicants of certain development projects, such as the proposed Conditional Use Permit, to provide an opportunity for, and to consider input from interested and affected stakeholders prior to project consideration by city decision-makers. On April 6, 2021, the applicant mailed an early public notice to property owners within 600 feet of the project site and posted a public notice sign on the property. City Planner Neu introduced Agenda Item 2 and stated Senior Planner Goff would make the staff presentation (on file in the Planning Division). He stated the property owner, Dr. Bruce Baker is a convicted tax cheat and does not want the development next door to his property. COMMISSION DISCUSSION: Commissioner Stine stated the tree on site will be preserved, he understands the concern of the neighbor about densification and stated it is within the current housing laws to allow more units, he is impressed with the project and indicated that it is well designed.
