A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE
CONTINUED OPERATION OF A PERFORMANCE THEATER LOCATED AT
2787 STATE STREET IN THE VILLAGE CENTER DISTRICT OF THE VILLAGE &
BARRIO MASTER PLAN AND WITHIN LOCAL FACILITIES MANAGEMENT

WHEREAS, the Planning Commission did, on Sept. 1, 2021, hold a duly noticed public hearing a!:
prescribed by law to consider Conditional Use Permit No. CUP 2021-0006, as referenced in Planning
Commission Resolution No. 7426; and the Planning Commission adopted Planning Commission
Resolution No. 7426 recommending to the City Council that it be approved; and
WHEREAS, under the authority of Section 19.04.030 of the Carlsbad Municipal Code, the City
Planner has the responsibility to carry out the general administration of CEQA and CEQA Guidelines on
behalf of the city. The City Planner determined on July 13, 2021 the project is exempt from the provision
of CEQA pursuant to CEQA Categorical Exemption Section 15301 -Existing Facilities because !he
project involves the continuation of an existing theater use within an existing building that proposes
no physical expansion and will not have any adverse impacts on the environment; and
WHEREAS, the City Council ofthe City of Carlsbad, held a duly noticed public hearing fo consider
said Conditional Use Permit; and
WHEREAS at said public hearing, upon hearing and considering all testimony and arguments, if
any, of all persons desiring to be heard, the City Council considered all factors relating to the appeal.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the approval of Conditional
Use Permit No. CUP 2021-0006 is approved, and that the findings and conditions of the Planning
Commission contained in Planning Commission Resolution No. 7426 on file with the City Clerk and
incorporated herein by reference, are the findings and conditions of the City Council.
3. That this action is final the date this resolution is adopted by the City Council. The
Provisions of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply:
