HomeMy WebLinkAbout2022-01-11; City Council; ; Adoption of Ordinance No. CS-412 – Restrict Overnight Parking on Armada Drive Meeting Date: Jan. 11, 2022 To: Mayor and City Council From: Scott Chadwick, City Manager Staff Contact: Faviola Medina, City Clerk Services Manager faviola.medina@carlsbadca.gov, 760-434-5989 Subject: Adoption of Ordinance No. CS-412 – Restrict Overnight Parking on Armada Drive Districts: All Recommended Action Adopt Ordinance No. CS-412 adding Section 10.40.301 of the Carlsbad Municipal Code to establish no parking zones along both sides of Armada Drive between Palomar Airport Road and Legoland Drive between the hours of 11 p.m. and 5 a.m. Executive Summary/Discussion Ordinance No. CS-412 was introduced and first read at the City Council meeting held on Dec. 14, 2021. On a motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat- Patel, the City Council voted 5-0 to introduce Ordinance No. CS-412. The second reading allows the City Council to adopt the ordinance, which will become effective 30 days after its adoption. Fiscal Analysis The preliminary cost estimate accounts for producing and installing signs with the new restrictions along the west curb line of Armada Drive between Palomar Airport Road and Legoland Drive. Traffic engineering staff determined 19 signs will be needed for the project. Each sign costs $300, which makes for a total of $5,700. There are sufficient funds in the Police Department’s Fiscal Year 2021-22 operating budget to cover the cost of this signs. Next Steps The City Clerk will have the ordinance, or a summary of the ordinance, published in a newspaper of general circulation within 15 days following adoption of the ordinance. Environmental Evaluation The project is exempt from the California Environmental Quality Act under CEQA Guidelines Section 15301(c), which covers the minor alteration of existing facilities, including streets, involving negligible or no expansion of use. CS-412 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADDING SECTION 10.40.301 OF THE CARLSBAD MUNICIPAL CODE TO ESTABLISH NO PARKING ZONES ALONG BOTH SIDES OF ARMADA DRIVE BETWEEN PALOMAR AIRPORT ROAD AND LEGOLAND DRIVE BETWEEN THE HOURS OF 11 P.M. AND 5 A.M. WHEREAS, the City of Carlsbad has received numerous reports of individuals parking vehicles overnight along Armada Drive and leaving trash and human waste along the sidewalk; and WHEREAS, the Carlsbad Police Department met with Covey Commercial Real Estate Service, the property management service for the Carlsbad Ranch Maintenance Association whose members consist of businesses located along Armada Drive, and all businesses represented by Covey Commercial Real Estate Service expressed support for the overnight parking restriction; and WHEREAS, the City Council of the City of Carlsbad has determined that it is in the interest of public safety that an overnight parking restriction be implemented along Armada Drive between Palomar Airport Road and Legoland Drive between the hours of 11 p.m. and 5 a.m.; and WHEREAS, the City Planner has determined that the project is categorically exempt from the California Environmental Quality Act per state CEQA Guidelines section 15301 (c) and that no exception to the exemption as set forth in CEQA Guidelines section 15300.2 applies; NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows that: 1.The above recitations are true and correct. 2.That Title 10, Chapter 10.40, of the Carlsbad Municipal Code is amended by the addition of Section 10.40.301 to read as follows: 10.40.301 Parking restricted on Armada Drive. Parking of vehicles is prohibited between 11:00 p.m. and 5:00 a.m. on the westerly and easterly sides of Armada Drive between Palomar Airport Road and Legoland Drive. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
