Subject: Mayoral Appointment of Two Members to the Planning Commission
Districts: Citywide
Recommended Action
Adopt resolutions appointing two members to the Planning Commission.
Executive Summary
Commissioner Carolyn Luna was initially appointed to the Planning Commission in February
2018 to fill the expired term of Commissioner Goyarts for a term ending in April 2022.
Commissioner Luna is eligible for reappointment. This term will expire in December 2026 to
coincide with the Mayor’s term.
Commissioner Roy Meenes was initially appointed to the Planning Commission in February
2018 to fill the expired term of Commissioner Siekmann for a term ending in April 2022.
Commissioner Meenes is eligible for reappointment. This term will expire in December 2026 to
coincide with the Mayor’s term.
Although terms for Commissioner Luna and Commissioner Meenes were originally scheduled to
end in April 2022, the terms have been shortened to end in January 2022. On Sept. 25, 2018,
the City Council adopted Resolution No. 2018-178 that approved the transition plan of making
new appointments to the Planning Commission to terms beginning in February. By having the
Commissioners’ terms begin in February, they will be able to attend the League of California
Cities’ Planning Commissioners Academy shortly after being appointed.
The City Clerk’s Office received 17 applications from residents wishing to serve on the Planning
Commission. In keeping with City Council Policy No. 88, the Mayor recommended the following
four residents to advance in the process and interview with the full City Council:

Discussion
The Maddy Act (California Government Code Sections 54970-54974) requires that on or before
December 31 of each year the legislative body shall prepare a local appointments list that
contains the appointive terms of board and commission members which will expire in the next
calendar year. The name of the incumbent appointee, the date of appointment and the term
expiration date is also included on the list. Based on the prepared list, the City Clerk’s Office
accepts applications (available on the city’s website and in the City Clerk’s Office) for any
upcoming vacancies.
Carlsbad Municipal Code Section 2.15.050(2) states, “Although each member of the City Council
elected by a district shall use his or her best efforts to appoint individuals residing in that
district to these commissions, members of the City Council may appoint individuals not residing
in their districts in their discretion in order to assure that the most interested and qualified
individuals serve on the commissions.”
According to City Council Resolution No. 2018-178, these Planning Commission scheduled
vacancies shall be appointed by the Mayor with the approval of the City Council. The Planning
Commission shall consist of seven members, and of four ex officio members who shall be the
Community Development Director, City Engineer, City Attorney and City Planner.

Members of the Planning Commission are subject to the provisions of the California Political
Reform Act and must file a statements of economic interests annually and complete two hours
of ethics training every two years.
Fiscal Analysis
None.
Next Steps
Following the appointment of two members to the Planning Commission, the City Clerk’s Office
will update the commission roster and coordinate the oaths of office and the filing of the
appointees’ statements of economic interest and ethics training certificates.
Environmental Evaluation
This action does not require environmental review because it does not constitute a “project”
within the meaning of the California Environmental Quality Act under California Public
Resources Code Section 21065 in that it has no potential to cause either a direct physical
change or a reasonably foreseeable indirect physical change in the environment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ESTABLISHING A TRANSITION PLAN FOR THE APPOINTMENT
OF NEW MEMBERS TO THE PLANNING COMMISSION, PARKS AND
RECREATION COMMISSION AND TRAFFIC SAFETY COMMISSION
WHEREAS, on May 23, 2017 the City Council of the City of Carlsbad, California determined that
the Carlsbad Municipal Code requires revisions and amendments and that a comprehensive update to
the Carlsbad Municipal Code is necessary to improve clarity and consistency as well as to reflect current
legal and professional best practices; and
WHEREAS, on May 23, 2017 the City Council of the City of Carlsbad adopted Resolution 2017-
095 authorizing the Carlsbad Municipal Code update; and
WHEREAS, on July 24, 2018 the City Council adopted an ordinance adding Chapter 2.15 to the
Carlsbad Municipal Code which provides a uniform set of rules and procedures that apply to all city
boards and commissions; and
WHEREAS, section 2.15.050 establishes a new procedure for appointing members to the
Planning Commission, Parks and Recreation Commission and Traffic Safety Commission; and
WHEREAS, the City Council needs to establish a system for transitioning to the new
appointment process for members ofthe Planning Commission, Parks and Recreation Commission and
Traffic Safety Commission; and
WHEREAS, the City Council wishes to establish a transition plan which will allow for continuity,
a smooth transition for new members to commissions and help to retain institutional knowledge on
the commissions; and
WHEREAS, the City Council wishes to have all Planning Commission transition terms begin in
the month February so that new Commission members will be able to attend the League of California
Cities Planning Commissioners Academy shortly after being appointed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. As the terms expire for members of the Planning Commission, Parks and Recreation
Commission and Traffic Safety Commission, the most recently elected district
councilperson or mayor will nominate a new member. The term of the newly
nominated member will be set to begin in February and expire at the time the
nominating councilperson's term expires. Each subsequent term for the commission
member will be set to coincide with the nominating councilperson's term.

3. All current Planning Commission members' terms will be shortened by three months so that
the next term begins in the month of February.
4. The terms of two members of the Parks and Recreation Commission will also need to be
lengthened by four months.

Unfortunately I have an important appointment I need to keep this evening that in all likelihood would prevent me from
calling into the Council meeting. Could you please advise Mayor Hall?
However, I would like to thank the Council for their trust in my experience they had placed in me 4 years ago to sit on
the Commission, knowing that shortly thereafter 2 Commissioners were terming out, thereby losing close to 2 decades
of solid experience.
I look forward to the upcoming challenges that the Commission will entertain, with the same thoughtful deliberation
