Executive Summary Commissioner Matt Simons was appointed to the Parks & Recreation Commission in February 2011 to fill the unexpired term of Commissioner Comstock for a term ending in August 2013. Commissioner Simons was reappointed in August 2013 and August 2017. Commissioner Simons is not eligible for reappointment. The term of the replacement commissioner will expire in December 2022 to coincide with the Mayor’s term. The City Clerk’s Office received seven applications from residents wishing to serve on the Parks & Recreation Commission. In keeping with City Council Policy No. 88, Mayor Hall has recommended the following two residents wishing to serve on the Parks & Recreation Commission to advance in the process and interview with the full City Council: Mayoral recommendation • Avram Kaplan - District 3 • Robert Winston - District 3 Exhibit 2 contains applications for the two finalists. Discussion The Maddy Act (California Government Code Sections 54970-54974) requires that on or before December 31 of each year the legislative body must prepare a Local Appointments List, which contains the appointive terms of Board and Commission members that will expire in the next calendar year. The name of the incumbent appointee, the date of appointment and the term expiration date is also included on the list. Based on the prepared list, the City Clerk’s Office accepts applications (available on the city’s website and in the City Clerk’s Office) for any upcoming vacancies. Carlsbad Municipal Code Section 2.15.050(A)(2) states, “Although each member of the City Council elected by a district shall use his or her best efforts to appoint individuals residing in Jan. 25, 2022 Item #7 Page 1 of 7 that district to these commissions, members of the City Council may appoint individuals not residing in their districts in their discretion in order to assure that the most interested and qualified individuals serve on the commissions.” According to City Council Resolution No. 2018-178, the Parks & Recreation Commission scheduled vacancy shall be appointed by the Mayor with the approval of the City Council. The Parks & Recreation Commission shall consist of seven members. The current members of the Parks & Recreation Commission are: Member District Amy Allemann 3 Brad Thorp 3 Jengi Martinez 2 Marissa Steketee 1 Michael Luna 2 Michael Sebahar 4 Members of the Parks & Recreation Commission are subject to the provisions of the California Political Reform Act and must file statements of economic interest annually and complete two hours of ethics training every two years. Fiscal Analysis None. Next Steps Following the appointment of two members to the Parks & Recreation Commission, the City Clerk’s Office will update the commission roster and coordinate the oaths of office and the filing of the appointees’ statements of economic interest and ethics training certificates. Environmental Evaluation This action does not require environmental review because it does not constitute a “project” within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change or a reasonably foreseeable indirect physical change in the environment. Public Notification This item was noticed in keeping with the Ralph M. Brown Act and was available for public viewing and review at least 72 hours prior to the scheduled meeting date. Exhibits 1.
