Thank you for submitting an Early Assessment to replace approximately 4,423 linear feet iron pipe with
PVC pipe that provides potable water to businesses and residents. The project is proposed at six locations
within the downtown area, the beach area, and the Terra mar area. The sites are existing developed areas
and vary in length. The table below provides additional detail for each of the six locations.

In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of an Early Assessment is to provide you with direction and comments on the overall concept
of your project. This Early Assessment does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the project are as follows:
a. General Plan: Project improvements are in the street right of way and do not have a General
Plan land use designation
Zoning: VProject improvements are in the street right of way and do not have a zoning
designation.
b. Project improvements are primarily in the Coastal Zone as the table below identifies. As
improvements are in the right of way, there are no Coastal land use designations and zoning
that apply.

2. The project requires the following permits:
a. It is possible a Coastal Development Permit (CDP) could be necessary if there are any increases
in capacity, construction taking place outside of the public right of way, or if there are any
negative impacts to public access to the beach. The memo provided stated that there would
be no such negative impacts.
Although, please note that the Garfjeld segment is described as "upsizing". If this
repair/replacement results in an increase in capacity, then it is likely to trigger a Coastal
Development Permit. Additional evaluation of capacity and replacement may be needed to
investigate with the Coastal Commission staff if there are any additional options.
3. Environmental Evaluation (CEQA)
The existing Water and Sewer Master Plans, adopted in November 2012, were evaluated in a program
environmental impact report (PEIR 12-01) prep~red and certified by the city. At that time, the PEIR
considered and analyzed CIP projects proposed as part of an update to the city's Water Master Plan
and Sewer Master Plan (2003) and Water Reclamation Master Plan (1992).
On September 17, 2019 the City Council approved "2019 Potable Water, Recycled Water, and Sewer
Master Plan Updates." During that time the city planner reviewed the project changes, and the revised
Master Plans' PEIR addendum prepared by HDR and found them to be appropriate.
The proposed project segment for "Garfield" is within the scope of the adopted PEIR and addendum,
and none of the requirements in CEQA Guidelines Sections 15162 and 15163 for a subsequent or
supplemental EIR have been triggered.
But the other proposed segments do not appear to have been included in the analysis of the previous
EIR or Addendum. These segments would be able to perform an addendum ifthe findings within CEQA
Guidelines Section 15164 could be made and none of the conditions described in Section 15162 have
occurred. Further analysis would need to be conducted and information provided for staff to make a
CEQA determination.
Land Development Engineering:
1. Even though the project is not considered a "development project", per form E-32 the project is
a Tier Ill SWPP. Prior to construction, the project shall prepare a SWPP that identifies construction
BMP's.

access the General Plan Land Use Element and the Zoning Ordinance online at the website address shown;

submitting.
