D is cus s ion Pursuant to California Elections Code Section 21627.1, before adopting a final map in the redistricting process, the commission must hold at least four public hearings at which the public is invited to provide input regarding the composition of one or more districts. At least one public hearing must be held before the commission draws a draft map or maps of the proposed City Council district boundaries. The first public hearing held on Sept. 23, 2021, satisfied this requirement. Additionally, at least one public hearing or public workshop must be held on a Saturday, on a Sunday, or after 6 p.m. on a weekday Monday through Friday. Tonight’s public hearing satisfies this requirement. The second public hearing held on Nov. 13, 2021 and the third public hearing held on Jan. 13, 2022 also satisfied this requirement.1 Based on public input and other legally required criteria, the City’s redistricting consultant/demographer has prepared proposed draft district maps for public review and comment. These maps, along with maps drawn by members of the public are publicly available on the City’s website: https://www.carlsbadca.gov/city-hall/city-council/redistricting/maps. 1 A public hearing may potentially satisfy more than one requirement. The commission’s public hearing schedule has been designed to meet or exceed the statutory public hearing requirements. Feb. 17, 2022 Item #1 Page 1 of 56 The intention of this public hearing is to receive final public comment regarding draft maps of the city’s proposed voting districts. While all public input concerning the composition of the city's districts should be considered, all maps must meet the following federal requirements: 1. Population equality across districts. 2. Race cannot be the predominant factor or criteria when drawing districts. 3. Compliance with the federal Voting Rights Act of 1965, which, among other things, prohibits districts that dilute minority voting rights and encourages a majority-minority district if the minority group is sufficiently large and such a district can be drawn without race being the predominant factor. Additionally, the maps must also meet the following state requirements: 1. Maps must be drawn using the following criteria in prioritized order: • District boundaries must be geographically contiguous to the extent practicable • Districts boundaries must minimize the division of neighborhoods and communities of interest to the extent practicable • Districts boundaries must be easily identifiable and understandable by residents and, to the extent practicable, be bounded by natural and artificial barriers, streets, or city boundaries • To the extent practicable and where not in conflict with the preceding criteria, district boundaries must be geographically compact 2. Maps must not favor or discriminate against a political party 3. Maps must be accompanied by information on the total population, citizen voting age population, and racial and ethnic characteristics of the citizen voting age population. 4. Maps prepared by the city or city contractors may not be released earlier than three weeks after the state redistricting database is publicly available. At the Commission’s regular meeting held on Jan. 27, 2022, the Commission voted to narrow down the number of maps to be focused on at the fourth public hearing. At that meeting the Commission narrowed the focus to the following maps: • NDC 101c • d96973 with adjustments noted below • d96786 with adjustments noted below The Commission requested the following changes to map d96973, with the changes being prioritized in the following order: 1. Move La Costa Glen community to District 4 2. Keep a gated community together by moving homes west of Xana Way to District 4 3. Keep the La Costa Greens and La Costa Ridge neighborhoods together by moving part of La Costa Greens to District 2 The outcome of the changes being requested to map d96973 resulted in the creation of two new maps because all three items could not be achieved in one map due to population balance issues. New map d96973b accomplishes priority one moving La Costa Glen to District 4. New map d96973c accomplishes priorities two and three keeping a gated community together by moving homes west of Xana Way to District 4 and keeping La Costa Greens and La Costa Ridge Feb. 17, 2022 Item #1 Page 2 of 56 neighborhoods together by moving part of La Costa Green to District 2. Maps accomplishing priorities one and two and priorities one and three are not provided as they would not be population balanced. The commission requested the following changes to map d96786: 1. Move Bressi Ranch neighborhood into District 2 2. Move an area near McClellan-Palomar Airport into District 3 The outcome of the requested changes resulted in the creation of a new map. New map d96786c attempts to swap Bressi Ranch with the community identified south of Palomar Airport Road and west of Aviara Parkway. In addition to the above requested changes, the Commission requested that the coastline district boundaries be cleaned up. These changes have been made to maps NDC 101c and d96786c. The commission also received 11 new maps from the community (Exhibit 2). The commission may select the final map from any legal draft map that was posted on the internet for at least seven days before the public hearing. Fiscal Analysis This action has no fiscal impact. Next Steps The resolution selecting the final map is effective upon adoption. The final map will be codified in the Carlsbad Municipal Code, transmitted to the San Diego County Registrar of Voters, and publicized to the community. The final will apply to Districts 1 and 3 beginning with the November 2022 election. The final map will apply to Districts 2 and 4 beginning with the 2024 election. The record of the redistricting proceedings will be maintained on an internet web page dedicated to redistricting for at least 10 years. Environmental Evaluation In keeping with California Public Resources Code Section 21065, this action does not constitute a “project” within the meaning of the California Environmental Quality Act in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Public Notification and Outreach This agenda item was noticed in keeping with the Ralph M. Brown Act and California Elections Code Section 21628(c) and it was available for public viewing and review at least 5 days before the scheduled public hearing date. Furthermore, all maps for the Commission’s consideration were posted on the internet and made available at least seven days prior to the public hearing in accordance with California Elections Code Section 21628(d)(1). Prior to this public hearing, the city conducted outreach in both English and Spanish to encourage public participation in both the redistricting process in general, and this public hearing in particular. A notice of this public hearing was published in English and in Spanish in the Feb. 11, 2022, edition of the San Diego Union-Tribune. Feb. 17, 2022 Item #1 Page 3 of 56 Exhibits 1. This may involve dividing a census block, but since it was divided in 2017, I hope it can be divided again this time. 2. Population Unit 20 is assigned to District 1 in Map 96786b, but it is in District 2 in Map 96786c. I will propose that it be placed in District 1. 3. Population Units 41 and 44 lie south of Agua Hedionda. They were assigned to District 2 in the existing (2017) map. I believe they have nearly 0 people, and I will propose that they stay in District 2, as well as that part of Pop Unit 61 that extends north of Cannon.. 4. In some of our maps, including 96786b, Population Unit 1 is divided between Districts 1 and 2. I will propose that we similarly divide it here, putting Quarry Creek into D2 and the apartments on Marron just east of El Camino Real into D1. I expect that items 3 and 4 will have little impact on the population balance. Depending on whether 96786d turns out to be non-compliant with all four changes, we may need to decide between incorporating item 1 vs item 2. If incorporating all of my suggestions turn out to be too much, please be prepared to show two versions with only 3 of my suggestions, leaving off either item 1 or item 2, respectively. Q2: Please explain why the Population Unit numbers can be used to calculate the changes in the 96973c statistics, whereas some other numbers must be used to calculate the changes in 96973b statistics. I believe the final arrangements made by map NDC101c ensures the best representation of all communities in Carlsbad. The expanding area of District 1 is necessary and relevant, as many families who live near Carlsbad High School associate themselves with the Village, rather than communities in District 2. NDC101c also binds communities instead of separating them. By moving slightly Southward (inheriting the Bressi Ranch Area, previously represented by District 3) District 2 preserves existing political communities that would be more aligned with the people of the aforementioned district. District 3 does this as well by bringing the Alicante Rd neighborhood together instead of separating them as the district lines do now. District 4 also does the same by combining my community on Estrella De Mar Ct alongside the rest of Estrella De Mar Rd. For these reasons, I believe that map NDC101c is the most fair and equal representation of the people of Carlsbad.
