Thank you for submitting a preliminary review application for a proposed retention basin within the
existing parking lots of the subject properties. The submitted plans show three potential basin options.
Two of the options will eliminate 11 parking spaces and one will retain parking above a basin.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose ofa preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your
submittal. This review is based upon the plans, policies, and standards in effect as of the date of this
review~ Please be aware that at the time of a formal application submittal, new plans, policies, and
standards may be in effect and additional issues of concern may be raised through a more specific and
detailed review.
Planning:
1. General Plan and zoning designations for the property are as follows:
a. General Plan: Planned Industrial and Open Space (Pl/OS)
b. Zoning: Planned Industrial and Open Space (P-M/OS)
2. Removal of Parking: Records indicate 109 parking spaces are required for the existing hotel and 109
parking spaces have been provided on hotel site, and this is already including a 10-space parking
reduction. Option 3 is the only option that would retain the number of surface parking spaces
previously required for the hotel; and thus, is the most supportable by Planning staff. The other two
options that eliminate parking would be inconsistent with the Conditional Use Permit approved for
the site (Planning Commission Resolution No. 6888, Attached); and therefore, are not supported
unless a waiver or modification of parking standards could be further secured pursuant to Carlsbad
Municipal Code Section 21.44.040.B.
3. The project requires the following Entitlements: ·
a. Conditional Use Permit Amendment (CUP, see comment 4)

4. Previous Approvals: Information on previous approvals on 1929 Palomar Oaks, Hotel Use:
Plei,lse be aware that the Conditional Use Permit (CUP) approved by the Planning
Commission on June 6, 2012 is set to expire on June 5, 2022 (Planning Commission
Resolution No. 6888, Attached) and will require an amendment to extend in perpetuity.
An amendment to the CUP will also entitle the development of the retention basin.
b. Approval of the Hotel Use included the approval of a Habitat Management Plan Permit
(HMP), all construction activities shall be compliant with the HMP (Planning Commission
Resolution No. 6889, Attached).
5. Sensitive Habitat: In addition to the HMP, the following comments are provided in connection to the
project's location adjacent to sensitive native upland habitat:
a. All projects adjacent to native habitat must avoid impacts to breeding birds. The project
must:
i. Avoid the bird breeding season (Feb 15 -August 31) OR, if breeding season can't
be avoided.
ii. Hire a qualified biologist to do a pre-work nest clearance survey to ensure that
there are no nesting birds within about 300 feet of work area; no more than 3
days before start of the work; if nest is found, no-work buffer must be
established (300-500 feet for Threatened or Endangered Species and raptors, or
if other species, width to be determined in coordination with city).
b. There may need to be temporary fencing installed to ensure that the work does not
accidently encroach into the habitat. If work does encroach, mitigation through
revegetation would be required.

General Plan Land Use Element and the Zoning Ordinance online at the website address shown; select
Department Listing; select Planning Home Page. Please review all information carefully before
submitting.
Land Development Engineering:
Land Development Engineering Division staff has completed a preliminary review of the above-
referenced project. Prior to formal application submittal the following items must be adequately
resolved/addressed:
1. Complete a Stormwater Standards Questionnaire. This questionnaire will guide you and the City in
determining what type of reports and storm water mitigation must be completed to satisfy state and
City storm water quality requirements. The questionnaire can be printed from the following website

Preliminary analysis suggests that the project is a Standard Project subject to Trash Capture
Requirements. The project will require submittal and approval of a Trash Capture SWQMP. The link

2. Of the three options provided, Option 1 is the least preferred. Removing eroded soil from the surface
of the earth basin would seem problematic. You would not be able to vegetate the surface and so
there would be concerns about maintaining slope stability. Some reinforcement of the surface would
be needed. This option also has less capacity. Option 2 appears to be the most feasible approach
and the highest capacity for sedimentation. Option 3 {Option 2 with traffic rated grates covering the
basin) would also be acceptable but does add additional maintenance as the grates would require
removal and replacement each time sediment is removed. Removal of sediment from the walls of
the basin would be subject to wear if machinery is used. Additional concrete reinforcement would
also be necessary. The wall loads and grates would need to be rated for a truck {H20 loading). Specify
how the grate parking spaces would be delineated.
3. Plot the invert and top of grate elevations of each inlet. Plot the 21-inch RCP pipe on scaled section
views.
