Executive Summary In recent years Carlsbad residents have seen an influx of electric bicycles and other similar electric or motorized mobility devices on city streets. Unsafe operation, traffic violations and traffic collisions involving these devices and traditional bicycles are a growing concern. Police Department data collected between 2019 and 2021 demonstrate an increasing trend of traffic collisions involving e-bicycles and bicycles. Most of these collisions resulted in injuries to one of the involved parties. The operator of the bicycle and/ore-bicycle was determined as the party at fault in the majority of collisions between Jan. 2020 and July 2021. The proposed ordinance is intended to address these issues by amending Chapter 10.56 of the Carlsbad Municipal Code. This ordinance upgrades Chapter 10.56 by regulating not only bicycles but also electric bicycles, electric personal assistive mobility devices, electrically motorized boards, low-speed vehicles, motorized scooters, shared mobility devices as well as other similar vehicles. The ordinance establishes definitions fore-bicycles and the other regulated mobility devices and prohibitions on where they can be used. It also requires riders to use due care, reduce speed when necessary for safety, follow all rules of the road and dismount their regulated mobility device on trails less than 5 feet in width when within 50 feet of a pedestrian or equine (horseback rider). The ordinance provides peace officers with another enforcement tool outside of the standard California Vehicle Code citations and associated fines for traffic and vehicle safety violations. March 22, 2022 Item #2 Page 1 of 44 The city's local ordinance will also give qualifying violators the opportunity to enroll in a regulated mobility device safety course in lieu of the city referring t heir case to court subject to the imposition of fines. Staff recommend that the City Council introduce the ordinance amending Chapter 10.56 of t he Carlsbad M unicipal Code, thereby expanding local regulations and enforcement tools for regulated mobility devices in the city. Discussion Background The Police Department reported 186 traffic collisions involving bicycles an d/or e-bicycles from Jan. 1, 2019 through Dec. 29, 2021 (Exhibit 3). Of t hese 186 collisions, 163 reportedly resulted in injuries to one of the involved parties. Police Department data revealed that during an 18- month period, from Jan. 2020 through July 2021, there were 99 collisions in t he city involving bicycles and/ore-bicycles. In 72 of t hose 99 collisions, t he operator of the bicycle and/ore- bicycle was determined as the party at fault for that collision. · In response to bicycle and e-bicycle safety concerns, the Police Department increased enforcement and education efforts this past year. These efforts include a new page on the city website that provides information on what qualifies as an e-bicycle, e-bicycle r_ider requirements, where e-bicycles can be ridden, e-bicycle types and the rules of the road (Exhibit 4). The webpage also includes a link to an e-bicycle safety webinar the city presented in July 2021. Panelists on the webinar included members of the Police Department's Traffic Division and a school resource officer. Legal authority • California Vehicle Code Subsection 21113(g) allows public agencies to adopt rules or regulations to restrict or specify the conditions for the use of bicycles, motorized bicycles, e-bicycles, skateboards, electrically motorized boards and roller skates on public property under the jurisdiction of that agency. • Vehicle Code Section 21282 allows cities to enact ordinances regulating the time, place, and manner of the operation of electric personal assistive mobility devices as defined in Vehicle Code Section 313. • Vehicle Code Section 21225 allows cities to enact ordinances to regulate the registration of motorized scooters and t he parking and operation of motorized scooters on pedestrian or bicycle facilities and city st reets and highways, if that regulation is not in conflict with the Vehicle Code. The proposed ordinance This ordinance would amend Chapter 10.56 of the Carlsbad Municipal Code, currently titled "Bicycles," and would retitle the chapter as "Operation of Regulated Mobility Devices." Existing Section 10.56.010 would be amended to a definitions section and Section 10.56.040 on impoundment would be stricken. New Sections 10.56.020, 10.56.030 and 10.56.050 would be added to regulate a host of "regulated mobility devices," defined in the ordinance as bicycles, electric bicycles, electric personal assistive mobility devices, elect rically motorized boards, low- speed vehicles, motorized scooters, shared mobility devices and other similar vehicles. 2 March 22, 2022 Item #2 Page 2 of 44 The revised ordinance is intended to promote the safety of people using these vehicles or devices, as well as others on city sidewalks, bike paths, pathways, trails, bike lanes, streets, roads, and highways. The ordinance would also establish reasonable measures and enforcement mechanisms that can be implemented to promote the safe and efficient use of city rights of way including trails. The ordinance's key provision, Section 10.56.020(C)(l)), would require the operator of a "regulated mobility devices" to use "all due care ... reduce the speed of the device, obey all traffic control devices, and take all other action relating to operation of the device as necessary to safeguard the operator, passengers, and any persons or other vehicles or devices in the immediate area." Another key provision, Section 10.56.020(C)(2}}, would require persons operating or riding a regulated mobility device on a city trail to dismount the device where the trail width is less than 5 feet wide and a pedestrian or equine is within a distance of 50 feet from the device. San Diego, San Marcos, San Clemente, Santa Monica, Newport Beach, Folsom and many other California cities have already enacted similar ordinances regulating the operation of e-bicycles and other "regulated mobility devices." Staff believe that the proposed local ordinance would be an important enforcement tool that would help increase safety throughout the city. The proposed ordinance would also offer a locally controlled, education-based enforcement mechanism rather than only monetary court- issued fines. The Police Department believes this approach would be particularly effective with younger violators, who often are not financially responsible for paying violation fines but would benefit from the education component. Enforcement This ordinance would authorize a peace officer or employee charged with enforcing the city's traffic laws and regulations to enforce the ordinance·. In lieu of filing charges in court for a violation of the ordinance, which would likely result in the imposition of a fine in an amount not exceeding $100 (pursuant to Carlsbad Municipal Code Section 1.08.010(E)(2)(a) and Government Code Section 36900(b)), the Police Chief or designee may allow a violator to complete a Police Department-provided safety course for regulated mobility devices. The ultimate goal is to enforce the law while educating e-bicycle and other regulated mobility device operators on safety and the rules of the road. Traffic and Mobility Commission approval This ordinance was presented to the Traffic and Mobility Commission on Mar. 7, 2022, for its review and comment. In a unanimous 6-0 vote, the commission supported staff's recommendation to City Council to amend Carlsbad Municipal Code Chapter 10.56. Commissioners made many comments on the proposed ordinance and asked staff questions about the ordinance and its safety course component. These comments and questions are attached in the meeting minutes as Exhibit 5. Overall, the commission praised the ordinance's education-first approach. Many of the comments centered on increasing bicycle safety outreach and education as well as recommendations for safety courses. None of the comments necessitated a modification to the language of the proposed ordinance; however, city staff 3 March 22, 2022 Item #2 Page 3 of 44 intend to make minor edits to Exhibit 4, the rules of t he road handout, to address commissioners' comments. Options Staff provide the following options for the City Council's consideration: 1. Adopt the proposed ordinance Pros • Expands t he city's available tools to regulate vehicle safety • Regulates vehicle safety without broadly limiting where persons may ride regulated mobility devices • Increases the city's abi lity to educate regulated mobility device violat ors on vehicle and road safety to avoid future violations • Modifies tradit ional enforcement mechanisms by encouraging vehicle and road safety education instead of monetary penalties • Provides officers with a single ordinance to use for enforcement rather than multiple California Vehicle Code provisions • May enhance public safety over time on both city rights of way and city trails Cons • Police Department staff would need to individually assess and contact ordinance violators to determine their eligibility and willingness to participate in the safety course for regulated mobility devices in lieu of filing the case in court • A violator cannot be forced to take the safety course and ca n still elect to have their case filed in court subject to a fine 2. Do not adopt the ordinance Pros • Road and vehicle safety of regulated mobility devices would still be subject to the California Vehicle Code • The general public would be able to anticipate that their road and vehicle safety violations would be subject to a monetary fine as opposed to a potential education- based disposition Cons • Police officers could only use California Vehicle Code provisions to enforce road and vehicle safety, which means that citations would automatically be sent to the Traffic/Minor Offense Division for adjudication with imposition of a fine • The city would not be able to effectively encourage violators to take a regulated mobility device safety course . • Without modification to enforcement of regulated mobility devices, public safety may be negatively impacted in the long-term Staff recommend Option 1, adopting the proposed ordinance. Fiscal Analysis While it is anticipated that funding beyond exist ing budget may be required to enforce the ordinance and fully implement the pre-approved safety course for violators, no additional 4 March 22, 2022 Item #2 Page 4 of 44 funding is being requested at this time. The Police Department will continue to use its existing budget to fund operations of the proposed safety course. Following additional fiscal analysis, staff may return to the City Council with a proposed budget and funding request for further consideration and action, if appropriate. The Parks & Recreation Department anticipates that signage along trails regarding the new dismounting requirement can be accommodated within its existing departmental budget. Next Steps If the City Council approves and adopts this ordinance, city staff will engage in community outreach and education regarding general e-bicycle and bicycle safety, as well as education of the new regulated mobility device ordinance. Staff would also post signage on and near trails informing users of the new dismount provision (see proposed Carlsbad Municipal Code Section 10.56.020( C)(2)). Environmental Evaluation This action does not constitute a "project" within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Prohibition of regulated mobility devices where posted. It is prohibited to operate or ride on a regulated mobility device in public areas where such prohibition is posted by signs or as otherwise set forth in this ordinance. A list of public locations where regulated mobility devices are prohibited shall be on file in the city clerk's office. The list may be amended from time to time by resolution ofthe city council. B. No operating or riding on sidewalks and public facilities. No person shall operate or ride a regulated mobility device upon any sidewalk, in any public drainage facility, culvert, ditch, channel, or any other public athletic/sports court, or gymnasium in the city. C. Duty to operate with due care, reduce speed. 1. The operator of a regulated mobility device shall exercise all due care and shall reduce the speed of the device, obey all traffic control devices, and take all other action relating to operation of the device as necessary to safeguard the operator, passengers, and any persons or other vehicles or devices in the immediate area. It shall also be unlawful to transport any other person upon the bar, handle bars, floorboard or other area of regulated mobility device not designed for passenger riding or designed for a single person, or cling to or attach oneself or one's regulated mobility device with an operator or rider on board to any moving vehicle or motorized or non-motorized wheeled device. 2. Persons operating or riding a regulated mobility device on a city trail must dismount the regulated mobility device where the trail width is less than 5 feet and a pedestrian or equine is within a distance of 50 feet from the regulated mobility device. 10.56.030 Enforcement. In lieu of a fine or administrative citation as authorized by this code, and in lieu of filing charges in any court having jurisdiction over a violation, the police chief or designee may allow a violator of this chapter to complete a police department provided safety course for regulated mobility devices. 10.56.040 Exemptions. A. Public agency personnel. Notwithstanding any other provision of this chapter, or any other section of this code, city and public agency personnel may operate regulated mobility devices or other vehicles at any place in the city in the performance of their official duties. B. Disability. This chapter is not intended to apply to or otherwise restrict regulated mobility devices used in a safe manner by physically disabled persons as defined under the Americans with Disabilities Act (42 U.S.C. Section 12101 et seq.). 10.56.050 Severability. If any portion of this chapter, or its application to particular persons or circumstances, is held to be invalid or unconstitutional by a final decision of a court of competent jurisdiction, the decision will not affect the validity of the remaining portions of this chapter or the application of the chapter to persons or circumstances not similarly situated. LOCAL ROADWAY SAFETY PLAN PROGRESS UPDATE-(Staff Contact: John Kim and Miriam Jim, Public Works) Staff's Recommendation: Receive a presentation March 22, 2022 Item #2 Page 41 of 44 Exhibit 5 Senior Engineer Jim and Consultant Transportation Planner Prescott presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk) Commissioner Penseyres recommended that additional data be provided for bicycle collisions to determine the root cause of these collisions. In addition, the collision data analysis should distinguish between bikes involving moving motor vehicles and solo crashes. Commissioner Penseyres further recommended that post-COVID data should be included in the collision data set and analyzed due to increase in the number bicyclists on city streets and the changing demographic of cyclists that have occurred due to the pandemic and prevalence of e-bikes in our community. Commissioner Linke recommended t hat the Local Roadway Safety Plan, or LRSP, program become an ongoing safety monitoring program that is updated periodically. Commissioner Linke asked if the collision reports could indicate if collisions were caused by distracted driving such as cell phone use. Commission Linke recommended that the lRSP take a closer look at t he State Street roundabout to determine cause of collisions and potential improvements which could enhance safety at the roundabout. Commissioner Perez asked if school location~ could be added on the figures included in the Staff Report to emphasize collisions in and around school sites. Commissioner Penseyres had a motion.on the floor but decided to withdraw his motion because the Minutes Clerk said that all comments would be incorporated in the minutes. Chair Perez requested a break at 6:35 p.m. and the meeting resumed at 6:42 p.m. 5. ACTIVE TRANSPORTATION MONITORING RESULTS -DRAFT REPORT-(Staff Contact: Nathan Schmidt, Public Works) Staff's Recommendation: Receive a presentation and provide input Transportation Planning & Mobility Manager Schmidt presented the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk) Commissioner Penseyres inquired as to whether the camera that has been installed can see the entire intersection. Transportation Planning & Mobility Manager Schmidt said the camera has a wide field of view and can capture the entire intersection. Vice-Chair Linke commented that he agrees that we need to figure out what the average occupancy is in Carlsbad as the car ridership here is probably not the same as the county average. He also commented that the cameras located across the city should have a way where there are automated counts. There may be technical problems associated with that. This may be a more inexpensive way to do counts of bicyclists. This may allow us to do more areas then a re on t his list. Chair Perez inquired as to why we didn't survey the College area/Northeast area? He feels that the study would show a lot of information from that area. He is wondering Why the age of the cyclist was mentioned in the report and if this would have been done if the cyclist was thirty-five years old. He 1s inquiring if there is a policy to identify the age of the victim and if the rationale behind providing this data could be provided in next month's report? Commissioner Penseyres replied to Commissioner Fowler that the age of the victims is always included in the SWITRS reports. The age is useful informat ion as there is usually a pretty big difference with t he age of the cyclist in regard to fault, more experienced versus non-experienced cyclists. Commissioner Fowler inquired about the reasoning behind synchronize the traffic signals. He would like more detail on the different types of models, how they work and what they do. Transportation Director Frank replied that he will include those comments in his next semi- annual transportation report update. Commissioner Penseyres inquired about two letters from the residents to the T&MC regarding Cannon Road Westbound to get to the beach. Last year it was discussed and t here was a proposal to add sh arrows from Paseo Del Norte towards the 1-5 in the number two lane. The proposal was also to add sharrows in the left turn lane from Paseo Del Norte onto Cannon Road. Bot h letters were from citizens that wanted to im prove things for cyclists. What is the status of this item? Transportation Director Frank replied that they were intending to include the sharrows in a re- striping project that would include narrowing the vehicle travel lanes and providing .a wider bike lane and delineated merge area for eastbound vehicular traffic approaching Paseo Del Norte. He will check on the stat us and timing of the project and assess if we want to keep the sharrows as part of that project or if they shou ld be a stand-alone project to implement them sooner. Chair Perez commented on parking issues over at Alga Norte Park on Alicante Road. Chair Perez has observed that on some nights of the parking lot is fully occupied and even the overflow is completely full. Cars are parking along Alicante Road. Th is is obstruct ing the bike lanes and starting to narrow the roadway. The devices are for health reasons and often are used by people that are not able to walk & their only means of mobility. It's unfair that these mobility devices would fall under the same category as bikes/e-bikes/e- scooters, etc .. In addition, our city is considered age friendly and we are building an age friendly city. As more of our community members age these types of devices wil.l be in higher demand. I believe the revision will assist efforts to curtail unsafe operation, traffic violations and collisions involving bicycles, electric bicycles and other mobility devices. If the goal is truly to enhance safety for all, then there are significant additional efforts that need to take place. This includes educating and enforcing regulations for pedestrians who unlawfully take the right of way from bicyclists in bike lanes. Per the California Vehicle Code, Rules of the Road, Pedestrians' Rights and Duties, Section 21966; "No pedestrian shall proceed along a bicycle path or lane where there is an adjacent adequate pedestrian facility (sidewalk)". This is summarized in the California Drivers Handbook (2019) as "Do not walk or jog in a bike lane unless there is no sidewalk". Unfortunately I have seen countless occasions where pedestrians have taken the whole bike lane or significant portions of it, forcing bicycle and other mobility users out into fast moving lanes of traffic. The problem is most severe along Carlsbad Boulevard between Carlsbad Village Drive and Cannon Road, where there is a sidewalk 1 provided. It is quite clear that almost all pedestrians feel it is their right to impede the flow of traffic in the bike lane. Many of them are cluelessly not facing oncoming traffic and create a real hazard for themselves and legal bike lane users. Please direct the Police Department to equally educate and enforce the law for both operators of regulated mobility devices and pedestrians who just as often are creating dangerous conditions.
