Recommended Action
Receive information on the results of amending Carlsbad Municipal Code Section 10.40.046 to
prohibit parking between the hours of 11 p.m. and 5 a.m. on Avenida Encinas between Palomar
Airport Road and Poinsettia Lane, and on Macadamia Drive and Raintree Drive.
Executive Summary
The City of Carlsbad received several complaints in 2021 regarding vehicles and motorhomes
parking in the 6900 block of Avenida Encinas, near the Waters End neighborhood and just north
of Poinsettia Lane. Residents and businesses in the area reported that motorhomes and other
vehicles were being parked for several days at a time, and that their owners were leaving trash
and dumping waste water along the streets.
In response, the City Council adopted an ordinance on July 27, 2021, amending Carlsbad
Municipal Code Section 10.40.046 to prohibit parking between the hours of 11 p.m. and 5 a.m.
on Avenida Encinas between Palomar Ai rport Road and Poinsettia Lane and on two adjacent
streets, Macadamia Drive and Raintree Drive. The City Council directed staff to return in six
months with an update on the effect of this parking restriction.
The ban enacted on overnight parking on Avenida Encinas between Palomar Airport Road and
Poinsettia Lane and on two adjacent st reets has had the desired result: Law enforcement
contacts in the area have decreased dramatically, and residents and businesses in the area say
the parking restrictions and police enforcement has made a noticeable improvement in the
issue of long-term parking of oversized. vehicles and related concerns.
Discussion
For the first 30 days after t he ordinance was adopted, the Police Department contacted the
occupants of vehicles found in the area to inform them of the pending ban on overnight
parking. People found to be in violation of other Carlsbad Municipal Code or California Vehicle
Code sections were cited for those violations, as appropriate.

The city had previously marked the parking spaces along these streets and the Police
Department had been actively enforcing Carlsbad Municipal Code section 10.40.145, which
prohibits parking vehicles beyond the marked 21-foot-long spaces.
The overnight parking restrictions became enforceable Aug. 27, 2021. law enforcement
contacts in the area have decreased significantly since then. The table below shows police
contacts on the affected streets in the six months before the ordinance went into effect and the
six months following the change:

During one of the calls for service, a community member commented to a police dispatcher
that they also perceived t hat crime seemed to have decreased in the neighborhood since the
Police Department has been addressing the issues stemming from overnight parking of
vehicles.
The department contacted businesses along this section of Avenida Encinas -Porsche Carlsbad,
Volvo Cars Carlsbad, La Quinta Inn, Best Western Carlsbad by the Sea, Motel 6 Carlsbad and
Holiday Inn Express & Suites Carlsbad Beach -as well as a representative from the Water's End
neighborhood to determine if they had seen a reduction in the number of vehicles parked
overnight in the area and whether the municipal code amendment was helping to reduce the
number of oversized vehicles remaining parked on Avenida Encinas, Macadamia Drive and
Raintree Drive.
In general, they said the addition of marked spaces and the municipal code amendment had a
positive effect on addressing long-term parking of oversized vehicles, a·nd that they had seen a
noticeable improvement in the total number of vehicles parked on Avenida Encinas. Some
respondents did mention that a few vehicles that were not oversized remained in the area
overnight until they were observed and their occupants contacted by the Police Department.
The businesses were told to contact the Police Department if they observed vehicles parked
overnight, in violation of the new restrictions.
One representative from the Water's End community responded to an email request from the
Police Department and said, "I'm very pleased to report t hat we've seen a significant reduction
in petty crimes, car break-ins, and vandalism." He also stated, "Certainly the no parking rules
and striping on Avenida Encinas has been a big help." (Exhibit 1).
The restriction on overnight parking and the marked spaces will allow the Police Department to
continue its sustained enforcement to address community concerns along this segment of
Avenida Encinas and adjacent streets.

Fiscal Analysis
The cost of the enforcement actions described in this report fall within the Police Department's
normal operations and will be covered by the department's budget, so there is no fiscal impact
from this item.
Environmental Evaluation
Pursuant to Public Resources Code Section 21065, receipt of this report does not qualify as a
"project" within the meaning of the California Environmental Qua lity Act (CEQA) in that it has
no potential to cause either a direct physical change in the environment, or a reasonably
foreseeable indirect physical change in the environment, and therefore does not require
environmental review.
Next Steps
The Police Department will continue to conduct parking enforcement in the affected areas.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
review at least 72 hours prior to the scheduled meeting date.

Hi Jason,
Thank you very much for the follow up.
First off, Carlsbad PD has been awesome since day 1 of us reaching out to express concern about the
security in our community. We truly appreciate all the work you and your colleagues have put in to help
us. We couldn't have asked for more.
I'm very pleased to report that we've seen a significant reduction in petty crimes, car break-ins, and
vandalism. We were getting about 1-2 incidents per month and now it's more like 1 every 6-8
months. It's not perfect but it's progress!
Certainly the no parking rules and striping on Avenida Encinas has been a big help.
Per the recommendations of CPD, we've also implemented Cameras with LPRs (Flock Safety) at all
entrances and exits. We've added a night walking guard in the community. We've also done a better
job of building community awareness with many residents adding ring cameras, additional lighting and
doing a better job of locking cars and doors.
Things are significantly better now than they were.
We do still get the occasional vagrant that wanders in from the Motel 6 (less frequently than we used
to) so we need to continue the efforts. Having a consistent police presence around the Motel 6 area is
very helpful because it deters people from wandering in when you're there and we get a very fast
response when there is an incident.
