Recommended Action
That the Community Development Commission hold a public hearing to receive public
comment and adopt a resolution approving the City of Carlsbad's Fiscal Year 2022
Annual Public Housing Agency Plan for submission to the U.S. Department of Housing
and Urban Development.
Executive Summary
The Housing & Homeless Services Department administers the federally funded Housing
Choice Voucher Program, also known as Section 8, which provides financial assistance to
renters, on behalf of the City of Carlsbad. The department implements HUD projects for
the city as the Carlsbad Housing Agency.
Federal law requires every public housing agency to file a five-year public housing agency
plan with the U.S. Department of Housing and Urban Development. Additionally, the
housing agency is required to prepare, adopt and submit an annual public housing agency
plan to HUD that is consistent with the goals and objectives of its five-year plan.
These plans provide a basic guide to the housing agency's policies and the rules and
requirements concerning the agency's operations, programs and services. The plans also
inform HUD and members of the public about the mission and strategies for serving the
needs of low-income and very low-income families within the housing agency's
jurisdiction for each of the next five years.
Under federal law, the plans must be adopted after a public hearing by the local public
housing agency's board of commissioners, which, for Carlsbad, is the City Council,
serving as the Community Development Commission. The Community Development
Commission approved the five-year plan on April 7, 2020. The Fiscal Year 2022 Annual
Plan {attached to Exhibit 1) is the second annual update of the five-year plan.

Discussion
Plan's goals and objectives
The Carlsbad 5-Year Public Housing Agency Plan identifies quantifiable goals and
objectives that will enable the Community Development Commission to serve the needs
of low-income, very low-income and extremely low-income families.1
The adopted plan has the following goals and objectives:
1. Expand the supply of assisted housing
• PHA will apply for additional Housing Choice Voucher funding, when
funds are made available and the PHA is eligible to apply for such
funds
2. Improve the quality of assisted housing
• Improve Voucher Management by continuing to be recognized as a
High-Performing Housing Agency in accordance with HU D's Section
Eight Management Assistance Program {SEMAP) performance
evaluation
• Improve management functions by streamlining functions and
technical initiatives
• Fully utilize and maintain HAP costs within HUD funded allocations2
3. Increase assisted housing choices
• Maintain voucher payment standards to expand assisted housing
choices
4. Promote self-sufficiency and asset development of families and
individuals
• PHA will continue to voluntarily administer the Family Self-Sufficiency
{FSS) Program3 for participants that are porting {transferring) into the
jurisdiction that are currently on an FSS program
5. Ensure equal opportunity and affirmatively further fair housing
• Undertake affirmative measures to ensure access to assisted housing
regardless of race, color, religion, national origin, sex, sexual
orientation, familial status, and disability
o PHA will provide educational information about equal
opportunity and fair housing at all Section 8 Program Briefings
and Move Briefings {when participants move)
o PHA will provide reasonable accommodations for people with
disa bilities and for frail elderly

non-profit agency that provides advocacy on fair housing and
tenant/landlord mediation issues
Plan changes from last year
Every public housing agency is required every year to identify any elements of the plan
that have been revised since its last annual plan was submitted. There is one area that
has been revised for this reporting period, and it is addressed in the Fiscal Year 2022
Annual Public Housing Agency Plan:
Financial resources -The amount of funding received for housing assistance
payments and program administration in calendar year 2021 decreased slightly
since the last reporting period because of one-time additional funds received
in 2020 due to the COVID-19 pandemic:

Plan progress report
Each public housing agency also needs to indicate its progress in meeting the goals and
objectives identified in its last approved and adopted five-year plan. The city's goals and
status are below:
1. Goal -Expand the supply of assisted housing
• The PHA served an additional 28 households because of an allocation of
special purpose Mainstream vouchers specifically for non-elderly persons
with disabilities
• The PHA served an additional 9 households because of an additional
allocation of special purpose Mainstream vouchers specifically for non-
elderly populations impacted by the Coronavirus.
• In 2021, the PHA began administering 100% of (its) portability vouchers,
which resulted in an increase of 36 assisted participants within the city of
Carlsbad 2021
2. Goal -Improve voucher management
• The PHA received the designation of High Performer for the last 5 fiscal years
in accordance with HUD's Section Eight Management Assistance Program
(SEMAP) report
• The PHA converted to a new software program to meet the changing
requirements of HUD regulations and/or directives.
• The PHA improved customer service and communications to participants and
landlords by utilizing documents by email.

3. Goal -Increase assisted housing choices
• The PHA has maintained payment standards between 90% and 110% of the
HUD published Fair Market Rents to ensure voucher holders are able to
utilize their assistance and find adequate housing in Carlsbad.
• The City's Housing Navigator assisted with providing services to participants
and the community in locating housing.
4. Goal -Promote self-sufficiency and asset development of families and
individual
• The PHA voluntarily administers the Family Self-Sufficiency Program for
participants who have ported into our jurisdiction. Since FY 2015, we have
administered 7 Family Self Sufficiency {FSS) participants, two of which
graduated successfully with escrow accounts. 4
5. Goal -Ensure equal opportunity and affirmatively further fair housing
• The PHA had contracted with the Center for Social Advocacy (CSA) and Legal
Aid Society of San Diego to provide Fair Housing counseling, educational Fair
Housing seminars for staff, tenants, and landlords. In collaboration with
other North County cities, the San Diego Regional Analysis of Impediments to
Fair Housing has given guidance to the cities and the region to affirmatively
further the goals of fair housing.
• Educational materials are available in the lobby in English and Spanish. The
materials are also included in new HCV program participants' briefing
packets.
Housing Commission
The Housing Commission passed a resolution Feb. 10, 20 , recommending approval of
the annual plan for FY 2022 (Exhibit 2).
Options
Federal regulations require public housing agencies to prepare, adopt and submit an
annual public housing agency plan to HUD as a condition of receiving Housing Choice
Voucher program funding. If the Carlsbad Community Development Commission does not
adopt and submit the Fiscal Year 2022 Annual Public Housing Agency Plan, then the city's
rental assistance program would not receive funding.
Fiscal Analysis
The public housing agency plan governs the federal funds allocated for administration of
the city's rental assistance program. For calendar year 2021, the City of Carlsbad's
funding allocation was $8,145,383 for rental assistance payments and $860,662 for
program operating expenses. The funding level for calendar year 2022 is unknown at
this time and it is not expected that HUD will publish and release the funding allocations
until April. However, assuming next year's funding will be similar to the current year

allocation, staff estimates the housing agency will be able to continue providing rental
subsidies for approximately 550 families.
Next Steps
All required documents will be executed and submitted to the Department of Housing and
Urban Development along with any public comments.
Environmental Evaluation
This action does not require environmental review because it does not constitute a
"project" within the meaning of the California Environmental Quality Act under
California Public Resources Code Section 21065 in that it has no potential to cause either
a direct physical change or a reasonably foreseeable indirect physical change in the
environment.
Public Notification and Outreach
The draft FY 2022 Public Housing Agency Annual Plan was available for public review
and comment for 45 days before its consideration by the Community Development
Commission. Public comments from the public review period and the public hearing will
be included in the final public housing agency plan to be submitted to HUD.
This item was noticed in keeping with the state's Ralph M. Brown Act and it was
available for public viewing and review at least 72 hours before the scheduled meeting
date.

WHEREAS, Housing & Homeless Services Department staff, on behalf of the Carlsbad Housing
Agency, administers the Section 8 Rental Assistance Program for the City of Carlsbad; and
WHEREAS, the U.S. Department of Housing and Urban Development has issued regulations
requiring public housing agencies such as the Carlsbad Community Development Commission to submit
a five-year plan and an annual plan consistent with the City of Carlsbad's Consolidated Plan and local
objectives; and
WHEREAS, the Community Development Commission approved the five-year plan on April 7,
2020;and
WHEREAS, HUD requires that the Community Development Commission hold a public hearing to
receive public comment on the annual public housing agency plan and approve the Carlsbad Annual Public
Housing Agency Plan for Fiscal Year 2022, authorizing execution of the public housing agency certifications
of compliance with the Public Housing Agency Plans and Related Regulations to accompany the Carlsbad

NOW, THEREFORE, BE IT RESOLVED by the Community Development Commission of the City of
Carlsbad, California, as follows that:
1. The above recitations are true and correct.
2. That the streamlined Carlsbad Annual Public Housing Agency Plan for Fiscal Year 2022
(Attached hereto as Attachment A) is hereby approved by the Community Development
Commission.
3. That the Chair of the Community Development Commission is hereby authorized to execute
the public housing agency certifications (Attached hereto as Attachment B), and to submit
the plan and related documents to the U.S. Department of Housing and Urban
Development.

Purpose. The 5-Year and Annual PHA Plans provide a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning the
PHA's operations, programs, and services, including changes to these policies, and informs HUD, families served by the PHA, and members of the public of
the PHA 's mission, goals and objectives for serving the needs of low-income, very low-income, and extremely low-income families

D. Affirmatively Furthering Fair Housing (AFFH).
0.1 Affirmatively Furthering Fair Housing.
Provide a statement of the PHA's strategies and actions to achieve fair housing goals outlined in an accepted Assessment of Fair Housing
(AFH) consistent with 24 CFR § 5.154(d)(S). Use the chart provided below. (PHAs should add as many goals as necessary to overcome fair
housing issues and contributing factors.) Until such time as the PHA is required to submit an AFH, the Pl-IA is not obligated to complete

Fair Housing Goals:
Goal. All Carlsbad housing opportunities (ownership and rental, market rate and assisted) offered m
conformance with open housing policies and free of discriminatory practices.
Strategies and Actions. With assistance from the city's fair housing provider, the City will continue to offer
fair housing services to its residents and property owners. Services include:
• Distributing educational materials to property owners, apartment managers, and tenants;
• Making public announcements via different media (e.g. social media, newspaper ads and public
service announcements at local radio and television channels);
• Conducting workshops and training opportunities with different community groups;
• Monitoring and responding to complaints of discrimination (i.e. intaking, investigation of
complaints, and resolution);
• Referring services to appropriate agencies;
• Conducting fair testing at random sites to measure compliance and remove any such impediments
through fair housing law enforcement; and
• Continue working collaboratively with San Diego Regional Alliance for Fair Housing to identify
(SDRAFFH) to promote fair housing, education, and advocacy. The SDRAFFH also oversees the
regional preparation of the Analysis of Impediments.
The city worked collaboratively as a partner with the San Diego Regional Alliance for Fair Housing to
complete the Analysis oflmpediments to Fair Housing, which covers fiscal years 2020-2025 that identifies
barriers to fair housing practices around the city with a focus on areas of racial and economic disparity.
Practices that were identified to reduce barriers include, but are not limited to, additional outreach in Spanish,
enforcement of housing safety codes, targeted outreach related to home financing opportunities, promoting
equal access to information, and holding diversity awareness events and programs at a variety of locations
throughout the city.

D. I Affirmatively Furtbering Fair Housing.
The PHA will use the answer blocks in item 0.1 to provide a statement of its strategies and actions to implement each filir housing goal outlined in its accepted
Assessment of Fair Housing (AFH) consistent with 24 CFR § 5.l 54(d)(5) that states, in relevant part: "To implement goals and priorities in an AFH, strategies and
actions shall be included in program participants' ... PHA Plans (including any plans incorporated therein) .... Strategies and actions must affirmatively further fair
housing .... " Use the chart provided to specify each fair housing goal from the PHA 's AFH for which the PHA is the responsible program participant -whether the
AFH was prepared solely by the PHA, jointly with one or more other PHAs, or in collaboration with a state or local jurisdiction -and specify the filir housing
strategies and actions to be implemented by the PHA during the period covered by this PHA Plan. Ifthere are more than three fair housing goals. add answer blocks
as necessary.
Until such time as the PHA is required to submit an AFH, the PHA will not have to complete section D., nevertheless, the PHA will address its obligation to

Acting on behalf of the Board of Commissioners of the Public Housing Agency (PHA) listed below, as its Chairperson or other
authorized PHA official if there is no Board of Commissioners, I approve the submission of the_ 5-Year andlor_x__ Annual PHA
Plan, hereinafter referred to as" the Plan", of which this document is a part, and make the following certification and agreements
with the Department of Housing and Urban Development (HUD) for the PHAfiscalyear beginning 07/01/2022 , in connection
with the submission of the Plan and implementation thereof
I. The Plan is consistent with the applicable comprehensive housing affordability strategy (or any plan incorporating such
strategy) for the jurisdiction in which the PHA is located (24 CFR § 91.2).
2. The Plan contains a certification by the appropriate State or local officials that the Plan is consistent with the applicable
Consolidated Plan, which includes a certification that requires the preparation of an Analysis of Impedim ents (AI) to Fair
Housing Choice, or Assessment of Fair Housing (AFH) when applicable, for the PHA's jurisdiction and a description of the
manner in which the PHA Plan is consistent with the applicable Consolidated Plan (24 CFR §§ 91.2, 91.225, 91.325, and
91.425).
3. The PHA has established a Resident Advisory Board or Boards, the membership of which represents the residents assisted by
the PHA, consulted with this Resident Advisory Board or Boards in developing the Plan, including any changes or revisions to
the policies and programs identified in the Plan before they were implemented, and considered the recommendations of the
RAB (24 CFR 903.13). The PHA has included in the Plan submission a copy of the recommendations made by the Resident
Advisory Board or Boards and a description of the manner in which the Plan addresses these recommendations.
4. The PHA provides assurance as part of this certification that:
(i) The Resident Advisory Board had an opportunity to review and comment on the changes to the policies and programs
before implementation by the PHA;
(ii) The changes were duly approved by the PHA Board of Directors (or similar governing body); and
(iii) The revised policies and programs are available for review and inspection, at the principal office of the PHA during
normal business hours.
5. The PHA made the proposed Plan and all information relevant to the public hearing available for public inspection at least 45
days before the hearing, published a notice that a hearing would be held and conducted a hearing to discuss the Plan and invited
public comment.
6. The PHA certifies that it will carry out the public housing program of the agency in conformity with title VI of the Civil Rights
Act of 1964 (42 U.S.C. 2000d-2000d-4), the Fair Housing Act (42 U.S.C. 3601-19), Section 504 of the Rehabilitation Act of
1.973 (29 U.S.C. 794), title ll of the Americans with Disabilities Act (42 U.S.C. 1210 I et seq.), and other applicable civil rights
requirements and that it will affirmatively further fair housing in the administration of the program. In addition, if it administers
a Housing Choice Voucher Program, the PHA certifies that it will administer the program in conformity with the Fair Housing
Act, title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, title II of the Americans with
Disabilities Act, and other applicable civil rights requirements, and that it will affirmatively further fair housing in the
administration of the program.
7. The PHA will affirmatively further fair housing, which means that it will take meaningful actions to further the goals identified
in the Assessment of Fair Housing (AFH) conducted in accordance with the requirements of 24 CFR § 5.150 through 5.180,
that it will take no action that is materially inconsistent with its obligation to affirmatively further fair housing, and that it will
address fair housing issues and contributing factors in its programs, in accordance with 24 CFR § 903.7(0)(3). The PHA will
fulfill the requirements at 24 CFR § 903.7(0) and 24 CFR § 903.15(d). Until such time as the PHA is required to submit an
AFH, the PHA will fulfill the requirements at 24 CFR § 903.7(0) promulgated prior to August 17, 2015, which means that it
examines its programs or proposed programs; identifies any impediments to fair housing choice within those programs;
addresses those impediments in a reasonable fashion in view of the resources available; works with local jurisdictions to
implement any of the jurisdiction's initiatives to affirmatively further fair housing that require the PHA 's involvement; and
maintains records reflecting these analyses and actions.
8. For PHA Plans that include a policy for site-based waiting lists:
• The PHA regularly submits required data to HUD's 50058 PIC/lMS Module in an accurate, complete and timely manner
(as specified in PIH Notice 2011-65);

• The system of site-based waiting lists provides for full disclosure to each applicant in the selection of the development in
which to reside, including basic information about available sites; and an estimate of the period oftime the applicant would
likely have to wait to be admitted to units of different sizes and types at each site;
• Adoption of a site-based waiting list would not violate any court order or settlement agreement or be inconsistent with a
pending complaint brought by HUD;
• The PHA shall take reasonable measures to assure that such a waiting list is consistent with affirmatively furthering fair
housing; and
• The PHA provides for review of its site-based waiting list policy to determine if it is consistent with civil rights laws and
certifications, as specified in 24 CFR 903.7(o)(l).
9. The PHA will comply with the prohibitions against discrimination on the basis ofage pursuant to the Age Discrimination Act
of 1975.
I 0. In accordance with 24 CFR § 5.105(a)(2), HU D's Equal Access Rule, the PHA will not make a determination of eligibility for
housing based on sexual orientation, gender identify, or marital status and will make no inquiries concerning the gender
identification or sexual orientation of an applicant for or occupant of HUD-assisted housing.
11 . The PHA will comply with the Architectural Barriers Act of 1968 and 24 CFR Part 41, Policies and Procedures for the
Enforcement of Standards and Requirements for Accessibility by the Physically Handicapped.
12. The PHA will comply with the requirements of Section 3 of the Housing and Urban Development Act of 1968, Employment
Opportunities for Low-or Very-Low Income Persons, and with its implementing regulation at 24 CFR Part 135.
13. The PHA will comply with acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 and implementing regulations at 49 CFR Part 24 as applicable.
14. The PHA will take appropriate affirmative action to award contracts to minority and women's business enterprises under 24
CFR5.105(a).
15. The PHA will provide the responsible entity or HUD any documentation that the responsible entity or HUD needs to carry out
its review under the National Environmental Policy Act and other related authorities in accordance with 24 CFR Part 58 or Part
50, respectively.
16. With respect to public housing the PHA will comply with Davis-Bacon or HUD determined wage rate requirements under
Section 12 of the United States Housing Act of 1937 and the Contract Work Hours and Safety Standards Act.
17. The PHA will keep records in accordance with 2 CFR 200.333 and faci litate an effective audit to determine compliance with
program requirements.
18. The PHA will comply with the Lead-Based Paint Po isoning Prevention Act, the Residential Lead-Based Paint Hazard
Reduction Act of 1992, and 24 CFR Part 35.
19. The PHA will comply with the policies, guidelines, and requirements of 2 CFR Part 200, Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Financial Assistance, including but not limited to
submitting the assurances required under 24 CFR §§ 1.5, 3.11 5, 8.50, and I 07.25 by submitting an SF-424, including the
required assurances in SF-424B or D, as applicable.
20. The PHA will undertake only activities and programs covered by the Plan in a manner consistent with its Plan and will utilize
covered grant funds only for activities that are approvable under the regulations and included in its Plan.
2 1. All attachments to the Plan have been and will continue to be available at all times and all locations that the PHA Plan is
available for public inspection. All required supporting documents have been made available for public inspection a long with
the Plan and additional requirements at the primary business office of the PHA and at all other times and locations identified
by the PHA in its PHA Plan and will continue to be made available at least at the primary business office of the PHA.

CALIFORNIA, RECOMMENDING APPROVAL OF THE CARLSBAD FISCAL YEAR
2022-23 ANNUAL PUBLIC HOUSING AGENCY (PHA) PLAN AND
AUTHORIZATION TO SUBMIT TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT

WHEREAS, the Housing Services Division administers the Section 8 Rental Assistance Program for
the City of Carlsbad's Public Housing Agency (PHA); and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD) has issued regulations
requiring PHAs to submit a 5-Year and Annual Plans consistent with the City of Carlsbad's Consolidated
Plan and local objectives; and
WHEREAS, the 5-Year Plan for 2020-2025 was approved by the Community Development
Commission on April 7, 2020; and
WHEREAS, federal regulations provide that Annual Plans must be adopted by the Carlsbad
Community Development Commission and submitted to the U.S. Department of Housing and Urban
Development.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Housing Commission of the City of Carlsbad,
California, as follows:
1. The above recitations are true and correct.
2. That based on the information provided within the Housing Commission Staff Report, the
Housing Commission adopts this resolution and Attachments A-C, recommending that the
Carlsbad Community Development Commission approve the Carlsbad Fiscal Year 2022-23
