Subject: State Housing Legislation Presentation
District: All
Recommended Action
Receive a public presentation regarding the state’s recent housing legislation and its
implications for the City of Carlsbad.
Executive Summary/Discussion
The California Legislature passed a handful of housing bills that bring many changes to the
housing permitting process, density bonus applications, and accessory dwelling units, among
other housing issues. Margaret and Tyson Sohagi of the Sohagi Law Group PLC will be
presenting information on this legislation and responding to questions.
These recently passed Senate bills focus on increasing the housing stock and streamlining
housing development to implement the state’s housing goals. The presentation will include a
discussion of the following:
•Senate Bill 9, the Housing Opportunity and More Efficiency Act, or HOME Act, requires
ministerial approval (meaning without discretionary review or hearing) of duplexes
and/or urban lot splits on single-family zoned parcels if the proposed project meets
certain requirements.
•SB 10 gives local governments the option to increase the density of the zoning on
certain parcels to allow up to ten housing units.
•SB 8 updates the Housing Crisis Act of 2019, which limits local discretion in approving
housing projects.
•AB 1174 updates the Housing Accountability Act, which streamlines the ministerial
approval process for multifamily housing projects.
•AB 345 requires local governments to allow the sale or conveyance of accessory
dwelling units separately from the primary residence.
•Updates to the state’s Density Bonus Law that encourage greater housing density. The
law enables developers to obtain more favorable development standards and include
more total units in a project than would otherwise be allowed by local zoning in
exchange for providing affordable or senior units.
