FORM

OWNER-BUILDER ACKNOWLEDGMENT FORM
Pursuant to State of California Health and Safety Code Section 19825-19829
To: Property Owner
An application for construction permit(s) has been submitted in your name listing you as the owner-builder of the
property located at:
Site Address _.<::eJ.-:...:\,._,_/'-'r /.:_, __,\CL.j l'--=S::_1'-'-A-'---'-[2.A_,_-l-b:...11-"1 ~.._< :....:AL-------------
The City of Carlsbad ("City") is providing you with this Owner-Builder Acknowledgment and Verificati9n form
to inform you of the responsibilities and the possible risks associated with typical construction activities issued
in your name as the Owner-Builder.
The City will not issue a construction permit until you have read and initialed your understanding of each
provision in the Property Owner Acknowledgment section below and sign the form. An agent of the owner
cannot execute this notice unless you, the property owner, complete the Owner's Authorized Agent form and
it is accepted by the City of Carlsbad.
INSTRUCTIONS: Please read and initial each statement below to acknowledge your understanding and
verification of this information by signature at the bottom of the form. These are very important construction
related acknowledgments designed to inform the property owner of his/her obligations related to the requested
permit activities.
r,
I. _\_1 understand a frequent practice of unlicensed contractors is to have the property owner obtain an "Owner
Builder" building permit that erroneously implies that the property owner is providing his or her own labor and
material personally. I, as an Owner-Builder, may be held liable and subject to serious financial risk for any injuries
sustained by an unlicensed contractor and his or her employees while working on my property. My homeowner's
insurance may not provide coverage for those injuries. I am willfully acting as an Owner-Builder and am aware of
the limits of my insurance coverage for injuries to workers on my property.
' II. _1_1 understand building permits are not required to be signed by property owners unless they are responsible
for the construction and are not hiring a licensed contractor to assume this responsibility.
' Ill. _'_I understand as an "Owner Builder" I am the responsible party of record on the permit. I understand that I
may protect myself from potential financial risk by hiring a licensed contractor and having the permit filed in his
or her name instead of my own.
IV. _· ·_1 understand contractors are required by law to be licensed and bonded in California and to list their license
numbers on permits and contracts.
V. __ I understand if I employ or otherwise engage any persons, other than California licensed contractors, and
the total value of my construction is at least five hundred dollars ($500), including labor and materials, I may be
considered an "employer" under state and federal law.
1 REV. 08/20
Owne'r-Builder Acknowledgement Continued
VI. _·;_· _I understand if I am considered an "employer" under state and federal law, I must register with the state
and federal government, withhold payroll taxes, provide workers' compensation disability insurance, and
contribute to unemployment compensation for each "employee." I also understand my failure to abide by these
laws may subject me to serious financial risk.
VII. /, '-'-'--I understand under California Contractors' State license Law, an Owner Builder who builds single-family
residential structures cannot legally build them with the intent to offer them for sale, unless all work is performed
by licensed subcontractors and the number of structures does not exceed four within any calendar year, or all of
the work is performed under contract with a licensed general building contractor.
VIII. ---'----I understand as an Owner Builder if I sell the property for which this permit is issued, I may be held liable
for any financial or personal injuries sustained by any subsequent owner(s) which result from any latent
construction defects in the workmanship or materials.
IX. ~ I understand I may obtain more information regarding my obligations as an "employer" from the Internal
Revenue Service, the United States Small Business Administration, the California Department of Benefit
Payments, and the California Division of Industrial Accidents. I also understand I may contact the California
Contractors' State license Board (CSLB) at 1-800-321 CSLB (2752) or www.cslb.ca.gov for more information
about licensed contractors.
/ -X. _·_1 am aware of and consent to an Owner Builder building permit applied for in my name, and understand
that I am the party legally and financially responsible for proposed construction activity at the following address:
2J~{, \/1~-rA--IA ~l1:,4 1 CAtit-::.r✓A,u,CA ,,..tzao(
XI.
( ,-,
..::'...l_l agree that, as the party legally and financially responsible for this proposed construction activity, I will abide
by all applicable laws and requirements that govern Owner-Builders as well as employers.
XII. l1 agree to notify the issuer of this form immediately of any additions, deletions, or changes to any of the
information I have provided on this form.
Licensed contractors are regulated by laws designed to protect the public. If you contract with someone who
does not have a license, the Contractor's State license Board may be unable to assist you with any financial loss
you may sustain as a result of a complaint. Your only remedy against unlicensed Contractors may be in civil court.
It is also important for you to understand that if an unlicensed Contractor or employee of that individual or firm
is injured while working on your property, you may be held liable for damages. If you obtain a permit as Owner-
Builder and wish to hire contractors, you will be responsible for verifying whether or not those contractors are
properly licensed and the status of their workers' compensation coverage.
Before a building permit can be issued, this form must be completed, signed by the property owner and returned
to the City of Carlsbad Building Division.
I declare under penalty of perjury that I have read and understand all of the information provided on this form and that my responses, including my
authority to sign this form, is true and correct. I am aware that I have the option to consult with legal counsel prior to signing this form, and/ hove
either (1) consulted with legal counsel prior to signing this form or (2) have waived this right in signing this form without the advice of legal counsel,

Section 1612.3, all new construction of buildings, structures and
portions of buildings and structures, including substantial
improvement and restoration of substantial damage to buildings
and structures, shall be designed and constructed to resist the
effects of flood hazards and flood loads. For buildings that are
located in more than one flood hazard area, the provisions asso-
ciated with the most restrictive flood hazard area shall apply.
1612.2 Design and construction. The design and construc-
tion of buildings and structures located in flood hazard areas,
including coastal high hazard areas and coastal A zones, shall
be in accordance with Chapter 5 of ASCE 7 and ASCE 24.
1612.3 Establishment of flood hazard areas. To establish
flood hazard areas, the applicable governing authority shall
adopt a flood hazard map and supporting data. The flood haz-
ard map shall include, at a minimum, areas of special flood
hazard as identified by the Federal Emergency Management
2019 CALIFORNIA BUILDING CODE
Agency in an engineering report entitled "The Flood Insu~-
ance Study for [INSERT NAME OF JURISDICTION]," dated
[INSERT DATE OF ISSUANCE], as amended or revised with the
accompanying Flood Insurance Rate Map (FIRM) and Flood
Boundary and Floodway Map (FBFM) and related supporting
data along with any revisions thereto. The adopted flood haz-
ard map and supporting data arc hereby adopted by reference
and declared to be part of this section.
Exception: {OSHPD IR, 2 & SJ The flood hawrd map J J
shall include, at a minimum, areas of special flood hazard
as identified by the Federal Emergency Management
Agency's Flood Insurance Study (FIS) adopted by the local
authority having jurisdiction where the project is located.
1612.3.1 Design flood elevations. Where design flood
elevations are not included in the flood hazard areas estab-
lished in Section 1612.3, or where floodways are not des-
ignated, the building official is authorized to require the
applicant to do one of the following:
I. Obtain and reasonably utilize any design flood ele-
vation and floodway data availahle from a federal,
state or other source.
2. Determine the design flood elevation or floodway in
accordance with accepted hydrologic and hydraulic
engineering practices used to define special flood
hazard areas. Determinations shall be undertaken by
a registered design professional who shaU document
that the technical methods used reflect currently
accepted engineering practice.
27
1805.3.3 Joints and penetrations. Joints in walls and
floors, joints between the wall and floor and penetrations
of the wall and floor shall be made water tight utilizing
approved methods and materials.
1805.4 Subsoil drainage system. Where a hydrostatic pres-
sure condition does not exist, dampproofing shall be provided
and a base shall be installed under the floor and a drain
installed around the foundation perimeter. A subsoil drainage
system designed and constructed in accordance with Section
1805.1.3 shall be deemed adequate for lowering the ground-
water table.
1805.4.1 Floor base course. Floors of basements, except
as provided for in Section 1805.1.1, shall be placed over a
floor base course not less than 4 inches (l 02 mm) in thick-
ness that consists of gravel or crushed stone containing not
more than 10 percent of material that passes through a No.
4 (4.75 mm) sieve.
Exceptioru:
J. Where a site is located in well-drained gravel or
sand/gravel mixture soils, a floor base course is
not required.
2. [HCD l] When a capillary break is installed in
accordance with the California Green Building
Standards Code (CALGreen), Chapter 4, Divi-
sion 4.5.
1805.4.2 Foundation drain. A drain shall be placed around
the perimeter of a foundation that consists of gravel or
crushed stone containing not more than IO-percent material
that passes through a No. 4 ( 4.75 mm) sieve. The drain shall
extend not less than 12 inches (305 mm) beyond the outside
edge of the footing. The thickness shall be such that the bot-
tom of the drain is not higher than the bottom of the base
under the floor, and that the top of the drain is not less than
6 inches (152 mm) above the top of the footing. The top of
the drain shall be covered with an approved filter membrane
material. Where a drain tile or perforated pipe is used, the
invert of the pipe or tile shall not be higher than the floor
elevation. The top of joints or the top of perforations shall
be protected with an approved filter membrane material.
The pipe or tile shall be placed on not less than 2 inches (51
SOILS AND FOUNDATIONS
mm) of gravel or crushed stone complying with Section
1805.4.1, and shall be covered with not less than 6 inches
(152 mm) of the same material.
1805.4.3 Drainage discharge. The floor base and founda-
tion perimeter drain shall discharge by gravity or mechan-
ical means into an approved drainage system that complies
with the California Plumbing Code.
Exception: Where a site is located in well-drained
gravel or sand/gravel mixture soils, a dedicated drain-
age system is not required.
SECTION 1806
PRESUMPTIVE LOAD-BEARING
VALUES OF SOILS
1806.1 Load combinations. The presumptive load-bearing
values provided in Table 1806.2 shall be used with the allow-
able stress design load combinations specified in Section
1605.3. The values of vertical foundation pressure and lateral
bearing pressure given in Table 1806.2 shall be permitted to
be increased by one-third where used with the alternative
basic load combinations of Section 1605.3.2 that include
wind or earthquake loads.
1806.2 Presumptive load-bearing values. The load-bearing
values used in design for supporting soils near the surface
shall not exceed the values specified in Table 1806.2 unless
data to substantiate the use of higher values arc submitted and
approved. Where the building official has reason to doubt the
classification, strength or compressibility of the soil, the
requirements of Section 1803.5.2 shall be satisfied.
Presumptive load-bearing values shall apply to materials
with similar physical characteristics and dispositions. Mud,
organic silt, organic clays, peat or unprepared fill shall not be
assumed to have a presumptive load-bearing capacity unless
data to substantiate the use of such a value are submitted.
Exception: A presumptive load-bearing capacity shall be
permitted to be used where the building official deems the
load-bearing capacity of mud, organic silt or unprepared
fill is adequate for the support of lightweight or temporary
structures.

ARCHITECT INSTALLATION GUIDELINES
FOR RESIDENTIAL INSTALLATIONS ONE PIECE UNITS
General Layout
□ Call SwimEx at 800-877-7946 to receive AutoCAo• Drawings of the Swim Ex model that you
will be installing. These drawings can be placed directly int o your pool room layout and site
drawings.
□ Swim Ex pools are available in different versions to accommodate new or existing
construction situations.
□ One piece Models: Model 40005 and 500OS come standard in one piece. (No seams or
additional assembly of pool sections are required)
❖ Provide a flat level surface for pool to sit on with a load-bearing capacity of 425
lbs./sq.ft.(2077 kg/sq.m) **Footprint of pool must be level, remainder of pit or area can be
sloped to drain water. (One Piece Unit Standard holds 2,600 Gallons)
~Below ground installation requires a minimum pit of 12'(3657mm)wide by 20'(6096mm)
long and 58"{1473mm) deep for 40005 and 50005 models. The pit side walls provide no
structure for the pool; they are only retaining walls. Please note special pit drawings if
ordering a Model 50005 with a deep well.
□ Above ground installation requires a minimum ceiling height of 10'(3048mm) with no
obstructions above the pool (Lights, vents, ducts, beams) **Check local building codes for
minimum ceiling height and required decking area.
□ Every Swim Ex comes standard with an entrance ladder. Based on the orientation of the pool
within the room, the ladder needs to be placed in the optimum location. Please familiarize
yourself with the Swim Ex orientation, and make sure that the order specifies whether the
ladder should be on the right or left side. The ladder can be placed on either side of the unit
for no charge, so long as the order indicates the location. {The entrance ladder is formed in
the molding process, thus we must know the desired location at the time the order is
placed.)
