INTRODUCTION An original program of the City of Carlsbad Cultural Arts Office, TGIF Concerts in the Parks have provided summer concerts in beautiful Carlsbad parks since 1986. These events have featured hundreds of musical artists for 35 years and brought together a community who values free, fun, and engaging cultural events. That same community has helped TGIF grow to have reputation as one of the leading music events in north San Diego County. As a public program, TGIF Concerts in the Parks reflects the high standards and commitment of the City of Carlsbad to arts and culture in the community. Through the Cultural Arts Office, staff continually strive to provide and make connections throughout the community through arts education, visual arts and performing arts programs. With an emphasis on presenting accessible, diverse and dynamic arts experiences for all ages, the City of Carlsbad’s Cultural Arts Office works to bring people together to create a community in celebration of arts and culture. 2. TGIF MISSION Presenting engaging and dynamic arts and culture events (in Carlsbad parks) by providing diverse high-quality musical performances complemented by creative and educational experiences (throughout the summer.) 3. TGIF VISION Bringing people together in a shared musical experience that celebrates diversity and samples an array of styles and genres. 4. TGIF VALUES OR GOALS • Aligning with the mission, vision, and values of the City of Carlsbad’s Cultural Arts Office, including initiatives in the Arts & Culture Master Plan (2018) • Expands music offerings in Carlsbad while enhancing the quality of cultural life • Present talented artists of high caliber and from a diverse array of genres through careful curation with variety and balance • A commitment to events that are accessible for a wide variety of audiences, including providing all events and programming for free • Commitment to safety for all events, audiences, artists, and staff • Creating a sense of community in Carlsbad through providing an enjoyable atmosphere at each event • Providing opportunity for audiences to enjoy and participate in new artistic, creative and educational experiences for the whole family • Ensure all events provide exceptional quality and outstanding artistic productions • Dedicated to presenting a variety of diverse artistic expression and styles • To cultivate collaboration and cooperation with partners, artists, and community • To inspire and encourage the unique and creative nature of everyone • Opportunities for emerging artists to perform for new audiences 5. TGIF VALUES OR GOALS • Efficient and strategic use of public funds to present safe and quality events • Scheduling of artists, locations, and event partners • Suitability of each event for all ages • Responsiveness to community interests • Awareness of other programs being presented in the region DocuSign Envelope ID: 0C9F8722-4409-4D66-B2B2-8ECDF0757A19 DocuSign Envelope ID: 0C9F8722-4409-4D66-B2B2-8ECDF0757A19 CCityof Carlsbad Memorandum April 14, 2022 To: From: Via: Re: Roxanne Muhlmeister, Assistant Finance Director Richard Schultz, Cultural Arts Manager Suzanne Smithson, Library & Cultural Arts Department Director cyi/-(" Request Sole Source Authorization for Concert Producer for the 35th Annual TGIF Concerts in the Parks Professional Services Agreement Per administrative order No. 12, any professional services and equipment procurements over $40,000 require a formal bidding process. The purpose of this letter is to request authorization for an exemption to the bidding process per Purchasing Code 3.28.110 (N) and allow staff to negotiate with an existing vendor for a one-year agreement, not to exceed $75,000. This code provides a bidding exemption for situations where solicitations of bids or proposals for goods, services, and/or professional services would be, in the discretion of the awarding authority, impractical, unavailing, impossible, or not in the best interests of the city. (Ord. CS-002 § 2, 2008) Background: TGIF Concerts in the Parks are a popular music tradition in Carlsbad. The concerts, managed by the Cultural Arts Office, are presented outdoors at four city community parks each summer between late June and mid-August, with an average season attendance of 30,000. These concerts represent the combined efforts of multiple city departments, including Library & Cultural Arts, Parks & Recreation, Traffic, Facilities, and Police and Fire departments. In 2017, the city went out with a request for a proposal for a concert producer, of which three competitive bids were received and where Nicholas Sitar dba Anthology Live was selected. From 2017 until the TGIF Concerts in the Parks 2020 season, producer Sitar contracted with the nine mainstage bands each summer and provided onsite sound and lighting support. Due to his extensive music industry contacts, he is well-versed in securing various bands from numerous genres on budget and time. Mr. Sitar is a consummate professional and exhibited great flexibility when city staff added new event elements to the nine concerts, including an opening act at each concert and an earlier start time for the sound crew. In May 2020, the 2020 concert series was canceled just a month before the scheduled start of the first summer concert due to the COVlb-19 pandemic. Before the event cancellation, Mr. Sitar had secured all nine bands and met the 2020 contract scope. Thus, the final year of the existing contact was interrupted and could not be fully realized. For the 2021 season, and as the COVID-19 pandemic continued, Mr. Sitar pivoted and worked with city staff to fill the gap with an alternative service to the community. He worked with city staff to develop a virtual concert series, TGIF in Your Backyard, that included four concerts recorded in the Schulman Auditorium. Mr. Sitar contractually secured four regionally prominent bands and a local video company to record and mix the concerts. Uncertainty about whether the pandemic would recede enough to host the concert series this summer delayed the final decision to proceed until late March. A new programs & venues coordinator, Thomas Johnston, was just hired on March 21 and is responsible for the management of the concert series. The resulting timeline to get all the elements of TGIF in place is shorter than in previous seasons. Having the producer return for one more season reduces some of the uncertainty of bringing back these concerts in a "new normal." The summer of 2022 serves as a bridge year between a long and cherished history of summer concerts and the two-year hiatus. The 2022 season will celebrate the 35th anniversary of the concert series by delivering nine quality concert experiences in the style and format most familiar to local audiences. Thus, consistency in approach and personnel would be an asset and in the best interest of the concert series, community and city. Staff would like to enter into a one-year contract with Mr. Sitar to provide consistency and help to assure a triumphant comeback for this memorable summer musical tradition. Next Steps: With the approval of this exemption, staff will return to its standard practice of issuing a request for proposal during Fall 2022 for the 2023 TGIF Concerts in the Parks' concert producer. I appreciate your consideration. Please let me know if I can answer any further questions. Your policy documents Your automobile policy consists of this Policy Declarations and the documents in the following list. Please keep these together. Allstate Automobile Policy AU104-3 California Amendatory Endorsement AU14629-3 Amendment of Policy Provisions AU14626-1 Important payment and coverage information Here is some additional, helpful information related to your coverage and paying your bill: uYour rate is lower because you are insuring multiple cars. uYour bill will be sent to you in a separate mailing and will list any payment option(s) available to you. If you are eligible to pay your premium in installments, your first bill will reflect your available payment options, including the option to pay in full or to pay in monthly installments. Please note that any amounts payable for the first renewal bill will not include an installment fee (unless you have an unpaid balance from a previous policy period, in which case the Minimum Amount Due will include an installment fee, or unless you are participating in the Allstate Easy Pay Plan). The following applies to installment payments made after your first renewal bill. If you decide to pay your premium in installments, there will be a $3.50 installment fee charge for each payment due. If you make 6 installment payments during the policy period, and do not change your payment plan method, then the total amount of installment fees during the policy period will be $21.00. If you are on the Allstatefi Easy Pay Plan, there will be a $1.00 installment fee charge for each payment due. If you make 6 installment payments during the policy period, and remain on the Allstatefi Easy Pay Plan, then the total amount of installment fees during the policy period will be $6.00. If you change payment plan methods or make additional payments, your installment fee charge for each payment due and the total amount of installment fees during the policy period may change or even increase. Please note that the Allstatefi Easy Pay Plan allows you to have your insurance payments automatically deducted from your checking or savings account. Allstate may cancel or nonrenew your policy for one or more of the following reasons: —Nonpayment of premium; —Fraud or material misrepresentation affecting the policy or the insured; or —Substantial increase in the hazard we insure against. In addition, your policy may be nonrenewed or your premium may be increased for any of the following reasons: —Accident involvement by an insured and whether the insured is at fault in the accident; —A change in, or addition of, an insured vehicle; —A change in, or addition of, an insured under the policy; —A change in the location of garaging of an insured vehicle; —A change in the use of an insured vehicle; —Conviction for violating any provision of the Vehicle Code or Penal Code relating to the operation of a motor vehicle; —The payment made by an insurer due to a claim filed by an insured or a third party; —Any other reason that is lawful and not unfairly discriminatory. Accidents and convictions for violating any provision of the Vehicle Code or Penal code relating to the operation of a motor vehicle that occur within the 36-month period ending on the effective date of the policy may lead to an increase of your premium. You have the right to be informed, upon your request, of any increase in premium, in whole or in part, charged to you because of an accident or conviction. Under certain circumstances, if we fail to send your renewal offer at least 20 days prior to your renewal effective date or if we fail to send your nonrenewal notice at least 30 days prior to the nonrenewal effective date, California law requires us to extend your existing policy term for 30 days from the date the notice is mailed or delivered to you. Other Uninsured Motorist Coverage Options Your policy has been issued with the coverages and options you requested. Please refer to the enclosed Policy Declarations to verify that your policy has been issued according to your requests. However, please be aware that you still have options concerning coverage for damages to your insured auto that you are legally entitled to recover from the owner or operator of an uninsured motor vehicle. The following options are available for each vehicle under your policy. Please see your Policy Declarations to determine your current coverages for each of your vehicles. —If your vehicle is insured for Auto Collision Insurance, we are offering a Waiver of your Collision Coverage Deductible to apply when the vehicle is damaged in an accident caused by an uninsured motor vehicle. —If your vehicle is not insured for Auto Collision Insurance and is insured for Uninsured Motorists Insurance for bodily injury, we are offering you the opportunity to extend your Uninsured Motorists Insurance to cover property damage. —You still have the option of rejecting either the Waiver of Collision Coverage Deductible or Uninsured Motorists Insurance for property damage, or both coverages. If a vehicle insured under your policy is damaged by an uninsured motor vehicle and you are legally entitled to recover damages, we will, depending on the coverage you purchase, either: —Pay the collision deductible on the insured motor vehicle when you have purchased collision coverage, or —Pay for the damage to the insured motor vehicle when you have not purchased collision coverage but have purchased Uninsured Motorists Insurance for property damage. Payment shall not include damage to personal property or loss of use of a motor vehicle and shall not exceed the smaller of: —The amount of the collision deductible, —The actual cash value of the insured motor vehicle, —$3500. The law also permits you to reject these coverages completely. If you would like to purchase one of these coverages or make any other changes concerning these coverage options, please call your Allstate Agent. X5126-4 Voluntary Provider Networks We want to let you know about a program that may be available to you. If you, or anyone covered under your policy, is injured in a loss covered under your auto policy, a Voluntary Provider Network may be available to you. A Voluntary Provider Network includes a variety of participating medical providers that can treat those injuries. Voluntary Provider Networks maintain lists of their participating providers. In the event that you experience a loss, your claims representative can provide you with contact information for any participating Allstate networks that may be available in your state at that time. You are under no obligation to use a medical provider who is a member of one of these networks, and you are free to seek medical services from a provider of your choice. There is no penalty if you choose a provider outside the network. If you are injured and treated by a provider who is a member of one of the participating networks, we may review their bills for covered medical services for re-pricing based on the approved rate for that providers network. You do not need to make a choice about these networks at this time. Please keep in mind that using a provider within a network should not be considered a confirmation that you have coverage. This notice is for informational purposes only. X73469 Important information about the Good Driver Discount The Good Driver Discount gives a driver the opportunity to receive a discount for having a good driving history. Depending on your driving experience and information in your driving record, (such as the number of traffic violation convictions or accidents), you could be eligible for a 20% discount on your auto insurance premiums. Please Note:If a driver is no longer eligible for a Good Driver Discount policy because of the driving safety record or years of driving experience of any other person, the good driver is eligible to purchase a Good Driver Discount policy which excludes such other persons from coverage. If you want to exclude such other persons from your auto policy so that Allstate can offer you the Good Driver Discount policy, please contact your Allstate agent or representative. This change may affect your premium and any discounts currently on your policy. Questions? If you think you may qualify, have any questions regarding the Good Driver Discount or your coverage in general, please feel free to contact your Allstate agent or representative.
