In response to an inquiry from Planning Commissioner Meenes, The Sohagi Law Group Partner Sohagi
explained that the SB 330 sunset provision was pushed out to 2030 and could be extended futher in
the future.
In response to an inquiry from Planning Commissioner Sabellico, The Sohagi Law Group Partner
Sohagi explained that there is a limit on the number of waivers and concessions, depending on the
amont of affordable units provided.
In response to an inquiry from Planning Commissioner Sabellico, The Sohagi Law Group Managing
Partner Sohagi explained that the five meeting rule needs to involve a formal city review process
meeting, developers holding their own meetings is not applicable.
In response to an inquiry from Housing Commissioner Manzano, The Sohagi Law Group Managing
Partner Sohagi explained that home owner association rules are enforced through recorded
covenants which in some scenarios can be considered illegal, and state legislation supersedes any
home owner assosciation rules.
In response to an inquiry from Housing Commissioner Manzano, The Sohagi Law Group Managing
Partner Sohagi explained that the city is responsible for ensuring proper utility services and this
legislation only allows the sale of Accessory Dwelling Units {ADUs) to qualified nonprofit
organizations.
In response to an inquiry from Housing Commissioner Nguyen-Cleary, The Sohagi Law Group Partner
Sohagi explained that there is a new pre-application process that includes most development fees to
be set at the time of the pre-application, though there are some limited waivers for fees that have
annual increases that are tied to the Consumer Price Index.
In response to an inquiry from Housing Commissioner Nguyen-Cleary, The Sohagi Law Group
Managing Partner Sohagi explained that basic impact fee study law defines reasonable fees so cities
are not able to charge onerous fees. She added that inclusionary housing fees cannot be applied to
a density bonus project.
In response to an inquiry from Housing Commissioner Nguyen-Cleary, Community Development
Director Murphy explained that the city has identified three sites that could potentially be considered
state excess land.
In response to an inquiry from Mayor Pro Tern Blackburn, The Sohagi Law Group Managing Partner
Sohagi explained that she is aware of four cities who are legally pushing back against state legislation.
Council Member Acosta added that there is language being drafted by Redondo Beach Mayor Bill
Brand for a potenional ballot measure that would repeal this legislation.
In response to an inquiry from Council Member Acosta, The Sohagi Law Group Managing Partner
Sohagi explained that though the city has a Housing Element, the city is not excused from any of the
new legislation in SB 9 or SB 10. She added that if the city were to meet all Regional Housing Needs
Allocation category requirements, the city would not be subject to SB 35.

In response to an inquiry from Council Member Acosta, Community Development Director Murphy
explained that different regions have different deadlines for their Housing Elements and does not
currently have information on how many other cities have had their Housing Elements certified.
In response to an inquiry from Council Member Acosta, City Attorney Celia Brewer explained that
having a certified Housing Element would make the city qualified when state funding becomes
available.
In response to an inquiry from Council Member Bhat-Patel, The Sohagi Law Group Managing Partner
Sohagi explained that when state funding becomes available there will likely be an application
process for the city to complete.
In response to an inquiry from Council Member Bhat-Patel, The Sohagi Law Group Partner Sohagi
explained that the only mention of home owner associations within SB 9 and SB 10 is that state law
preempts home owner association guidelines.
In response to an inquiry from Council Member Bhat-Patel, Community Development Director
Murphy explained that there are two previous actions relating to objective design standards for
multi-family developments, one regarding the Village and Barrio Master Plan area which had its own
subcommittee created to help develop guidelines, and the second one was to focus on city-wide
objective design standards and staff are in the early stages on finalizing these guidelines.
In response to an inquiry from Mayor Hall, The Sohagi Law Group Partner Sohagi explained that the
legislation discussed has not impacted the city's growth management plan aside from the sunset
provision of SB 330 being pushed out from 2026 to 2030. Community Development Director Murphy
added that it did impact the Housing Element because without having housing caps, the city had to
plan for Regional Housing Needs Allocation and also create a buffer that exceeded the growth
management number. He further explained that although there was the sunset provision extension
of SB 330 the city still has to abide by SB 166 and show capacity throughout the entire Housing
Element cycle that the city can take on the Regional Housing Needs Allocation units that the city is
obligated to build.
In response to an inquiry from Mayor Hall, Principal Planner Eric Lardy explained that there will be
opportunities for the public to provide input on the design guidelines and that the Planning
Commission will be reviewing the design guidelines before being presented to the City Council.
In response to an inquiry from Mayor Hall, The Sohagi Law Group Partner Sohagi explained that there
are exceptions for moratoriums under SB 330 in emegerncy situations or situations with an
immediate need.
In response to an inquiry from Mayor Hall, City Attorney Brewer explained that the city's open space
is subject to various types of conservation easements and other protected devices.
The City Council, Planning Commission and Hou sing Commission received the report.
