Mike Borrello expressed his concern with election fraud.
Glenn Bernard spoke regarding flag etiquette and the flag policy item on the prior meeting's
agenda.
Mark Packard explained that the City of Carlsbad invests in its own resources and that fiscal
responsibility has made the city what it is today. He also requested that resources be allocated
for the railroad trenching project.

Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to approve
Consent Calendar Item Nos. 1 through 3. Motion carried unanimously, 5/0.
1. SETTLEMENT OF WORKERS' COMPENSATION CLAIM OF THOMAS SUGG FOR $100,000 -
Adoption of Resolution No. 2022-109 authorizing settlement of the Workers' Compensation

2. PERMIT WITH THE CALIFORNIA DEPARTMENT OF PARKS & RECREATION TO MAINTAIN THE
UPPER PICNIC FACILITIES AT TAMARACK STATE BEACH AND COASTAL BLUFF AT
TAMARACK/FRAZEE STATE BEACH -Adoption of Resolution No. 2022-110 authorizing a right
of entry permit with the State of California Department of Parks & Recreation to maintain the
upper picnic facilities at Tamarack State Beach and the coastal bluff at Tamarack/Frazee State

3. EXECUTE HOLD HARMLESS AGREEMENTS FOR THE USE OF PRIVATE PROPERTY BY THE
LIBRARY & CULTURAL ARTS. POLICE AND FIRE DEPARTMENTS -Adoption of Resolution No.
2022-111 delegating authority to the City Manager to execute hold harmless agreements for
the use of private property by the Library & Cultural Arts Department, Police Department and

PROHIBITION -1) Adoption of Ordinance No. CS-423 amending Title 6 of the Carlsbad
Municipal Code to add Chapter 6.22 -Plastic Bottled Beverage Reduction; and
2) Adoption of Ordinance No. CS-424 amending Title 6 of the Ca rlsbad Municipal Code to add
Chapter 6.24 -Plastic Bag Ban; and
3) Adoption of Ordinance No. CS-425 amending Title 6 of the Carlsbad Municipal Code to add

Glenn Bernard expressed his appreciation for the release of balloons being banned and
expressed his concerns with the increase in prices at restaurants and grocery stores that is in
relation to the bans on plastic.
Farzan Dehmoubed spoke in favor of the plastic ban ordinances.
Hudson Langley spoke in favor of the plastic ban ordinances and requested for the bans to be
extended to retail.
Jesse Langley spoke in favor of the plastic ban ordinances.
City Attorney Brewer titled the ordinance.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Ordinance No. CS-423. Motion carried unanimously, 5/0.

DEPARTMENTAL AND CITY MANAGER REPORTS:
5. FISCAL YEAR 2021-22 PLANNING COMMISSION WORK PLAN ANNUAL REPORT AND FISCAL
YEAR 2022-23 PLANNING COMMISSION WORK PLAN -Adoption of Resolution No. 2022-112
accepting the Fiscal Year 2021-22 Planning Commission Annual Work Plan Report and
approving the Fiscal Year 2022-23 Planning Commission Work Plan. (Staff contact: Don Neu,
Community Development)
City Manager's Recommendation: Adopt the resolution.
City Planner Don Neu and Planning Commissioner Alicia Lafferty presented the report and
reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to Mayor Hall's inquiry, City Planner Neu explained that attendance of Planning
Commissioners to the League of California Cities conference is optional. Mayor Hall
expressed his desire for the conference to be mandatory for Planning Commissioners to
continue with training and requested that City Planner Neu discuss this with the Planning
Commission members.
Motion by Mayor Pro Tern Blackburn, seconded by Council Member Bhat-Patel, to adopt
Resolution No. 2022-112. Motion carried unanimously, 5/0.

6. ECONOMIC AND FINANCIAL UPDATE FOR THE THIRD QUARTER OF FISCAL YEAR 2021-22 -
Receive a report on the economic and financial update for the third quarter of fiscal year
2021-22. {Staff contact: Laura Rocha, Administrative Services Department)
City Manager's Recommendation: Receive the report.
Economic Development Manager Matt Sanford and Assistant Finance Director Roxanne
Muhlmeister presented the report and reviewed a PowerPoint presentation (on file in the
Office of the City Clerk).
In response to Council Member Bhat-Patel's inquiry, Economic Development Manager
Sanford explained that the City of Newport Beach has more family and individual travel hotels
than Carlsbad and generally has higher occupancy which is why they have a higher average
daily occupancy.
Council received the report.
This item was continued to a date uncertain.
7. 2022 EMPLOYEE ENGAGEMENT SURVEY RESULTS-Receive a report on the results of the 2022
Employee Engagement Survey. {Staff contact: Nancy Magpusao Burke and Judy von
Kalinowski, Administrative Services Department)
City Manager's Recommendation: Receive the report.
8. CONFIRMATION OF APPOINTMENT OF ONE MEMBER OF THE HISTORIC PRESERVATION
COMMISSION TO THE GROWTH MANAGEMENT PLAN UPDATE ADVISORY COMMITTEE -
Adoption of Resolution No. 2022-113 confirming the appointment of one member from the
Historic Preservation Commission to serve as an alternate on the Growth Management
Update Advisory Committee. (Staff contact: Tammy McMinn, City Clerk's Department)
City Manager's Recommendation: Adopt the resolution.
Motion by Mayor Hall, seconded by Mayor Pro Tern Blackburn, to adopt Resolution No. 2022-
113 confirming the appointment of Jamie Jacobs from the Historic Preservation Commission
to serve as an alternate on the Growth M anagement Plan Advisory Committee. Motion
carried unanimously, 5/0.
PUBLIC COMMENT (CONT.):
Susan Reynolds requested the Poinsettia Community Park Dog Park be named The Shaggy Dog
Park in honor of her neighbor.
COUNCIL REPORTS AND COMMENTS: Mayor Hall and the City Council Members reported on
activities and meetings of some committees and subcommittees of which they are members.
