Thank you for submitting a preliminary review to amend the reciprocal parking, access, and maintenance
agreement between 1695 Faraday Avenue and 5801 and 5807 Van Allen Way. The intent of the
amendment to the agreement is to remove 1695 Faraday Avenue from the shared parking arrangement
with 5801 and 5807 Van Allen Way, while still maintaining reciprocal access and maintenance between
the three (3) properties. No new development, additions, alterations, or intensification of use are
proposed with this review. The properties are located in the Heavy Commercial (C-M) Zone, the Carlsbad
Research Center Specific Plan, SP 180 (I), and Local Facilities Management Zone 5.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect ~s of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: Pl, Planned Industrial
b. Zoning: C-M, Heavy Commercial; and
c. Specific Plan: The property is located within Area 1 of the Carlsbad Research Center Specific
Plan, SP 180(1). Biomedical R&D is considered a permitted use.

a. Amendment to Non-Residential Planned Development Permit PUD 2017-0008. The reciprocal
parking, access and maintenance agreement is a condition of approval for PUD 2017-0008. To
amend the shared parking arrangement, an amendment to the Non-Residential PUD is
required.
3. Based on the meeting between the applicant and planning staff and the information provided within
the preiiminary review application, it is understood that the property owner of 1695 Faraday Avenue
(SMAC), is interested in amending the recorded reciprocal parking, maintenance and access
agreement between 1695 Faraday Avenue and 5801 and 5807 Van Allen Way to facilitate the sale of
the property. Planning staff is preliminarily supportive of the request. However, the information
below is necessary to further evaluate and support the request.
4. Parking Analysis. Please provide updated parking analysis information, as applicable, with the formal
application submittal. The tables below summarize staff's understanding of the existing and required
parking for the properties. 1695 Faraday Avenue appears to meet the parking requirements of
Carlsbad Municipal Code (CMC) 21.44 with no modification required. However, 5801 and 5807 Van
Allen would require 102 additional parking spaces to meet the parking requirements of CMC 21.44.

Please verify whether the analysis above is correct and provide updated parking analysis information
with the formal application submittal.
5. Modification of Parking Standards. Pursuant to the Carlsbad Municipal Code (CMC) Section
21.44.040.B, an alternative to the shared parking agreement between 5801 and 5807 Van Allen is
through a modification of parking standards. The city planner may modify the required parking
standards where it can be demonstrated that adequate parking will be provided, and the modification
will not adversely affect the neighborhood or the site design and circulation. The modification shall
be based on the results of a parking study prepared by a registered traffic engineer or other qualified
parking consultant, or other evidence satisfactory to the city planner. Therefore, please submit a
parking study for staff evaluation with the formal application.
6. Joint Parking Agreement and Revised Reciprocal Access and Maintenance Agreement. If the
modification to the parking standards is approved, a new Joint Parking Agreement will be required for

the properties at 5801 and 5807 Van Allen Way, and a revised reciprocal access and maintenance
agreement will be required for all three properties.

counter located in the Faraday Building at 1635 Faraday Avenue or online at
https://www.carlsbadca.gov/departments/community-development/planning. You may also access the
General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Please
review all information carefully before submitting.
Land Development Engineering:
1. Provide a preliminary title report within 6 months of the application date. Label and annotate all
existing easements and encumbrances affecting the property on the site plan.
2. Show all existing utilities and callout on the plans.
3. Provide a Storm Water Standards Questionnaire, Form E-34, available on the City of Carlsbad website.
