A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT AMENDMENT TO ALLOW AN
OFFICE ADDITION AND REMODEL ON PROPERTY
GENERALLY LOCATED ON THE NORTH SlDE OF LA COSTA
AVENUE EAST OF EL CAMINO REAL ..
CASE NAME: LEUCADIA COUNTY WATER DlSTRICT
C-.ASE NO: CUP I30(A)
WHEREAS, a verified application has been filed with the Cil!y of Carlsbad
and referred to the Planning Commission; and
WMEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
Commission did, on the 20th day of November, 1991, hold a duly noticed public hearing
to consider said applkation on property described as:
A portion of Lot 9 in Section 35, Township 12 South, Range
4 West, San Bernardino Base and Meridian in the County of
San Diego, State of California.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Commission
considered all factors relating to CUP 130(A).
NOW, THj';B£FOR~, BE IT HEREBY RESOLVED by the Planning Commission
of th~· City of Carlsbad as follows:
A) That the foregoing recitations are tme and correct.
B) That based on the evidence presented at the public hearing, the Commission
APPROVES CUP 130(A), based on the following findings and subject to the
following conditions:
Findings:
1. The requested use is necessary or desirable for the development of the community,
is essentially in harmony with the various elements and objectives of the general
plan, and is not detrimental to existing uses or to uses specifically permitted in the
zone in which the proposed use is to be located.
2. The site for the intended use is adequate in size and shape to accommodate the
use.
3. All of the yards, setbacks, walls, fences, landscaping, and other features necessary
to adjust the requested use to existing or permitted future uses in the
neighborhood will be provide<½ and maintained. , ·
4. The street system serving the proposed use is adequate to properly Min.die all
traffic generated by the proposed use.
5. The Planning Commission has, by inclusion of an appropriate condition to this
project, ensured building permits will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur
within the project unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the Public Facilities Element of
the General Plan have been 'met insofar as they apply to sewer sen:ke for this
project.
6. All necessary public improvements have been provided or will be required as
conditions of approval.
7. TI1e proposed project is compatible with the surrounding future land uses since
surrounding propeftles' are desigllated for commercial development on the General
Plan.
8. This project is consistent with the City's Growth Management Ordinance as it has
been conditioned to comply with any requirement approved as part of the Local
Facilities Mallagement Plall for Zone 6.
9. The findings of the staff report dated January 12, 1977, Planning Commission
Resolution No. 1311, are incorporated herein by reference.

Ccmditions:
1. Approval is granted for Cup 130(A), as shown on Exhibit(s) "A" -"!", dated
October 15, 1991, incorporated by reference alld on file in the Pl~nning
Department. Development shall occur substantially as shown unless otherwise
noted ill these conditions.
2. The developer shall provide the City with a reproducible 24" x 36", m~dar copy of
the Site Plan as approved by the Planning Commission. The Site Phm shall ·reflect
the conditions of approvlll by the City. The Plan copy shall be submitted to the
City Engineer-prior to issuance of building permits or imprqvement plan subtnittal,
whichever occurs first.
3. The conditions imposed for CUP 130 shall be superseded by those imposed for
CUP 130(A).
4. This project is approved upon the express condition that building permits will not
be issued for development of the subject property unless the City Engineer
determines that sewer facilities are available at the time of application for such
sewer permits and will continue to be available until time of occupancy.
5. Water shall be provided to this project pursuant to the Water Service agreement
between the City of Carlsbad and the Carlsbad Municipal Water District, dated May
25, 1983.

This project shall comply with all conditions and mitigation required by the Zone
6 Local Facilities Management Plan approved by the City Council on November 10,
1987, incorporated herein and on file in the Planning Department and any future
amendments to the Plan made prior to the issuance of building permits.
If ally condition for constru<:tion of any public improvements or facilities, or the
payment of any fees in lieu thereof, imposed by this approval or imposed by law
on this project are challenged this approval shall be suspended as provided in
Government Code Section 65913.5. If any such condition is determined to be
invalid this approval shall be invalid unless the City council determines that the
project without the condition complies with all requirements of law.
Approval of this request shall not excuse compliance with all sections of the
Zoning Ordinance and all other applicable City ordinances in effect at time of
building permit issuance.
This approval shall become null and void if building permits are not issued for this
project within one year from the date of project approval.

All roof appurtenances, illcl~1ding air conditioners, shall be a~chitecturally
integrated and concealed from view and the sound buffered from adjacent
properties and streets, in substance ns provided in Building Department Policy No.
80-6, to the satisfaction of the Directors of Pbnning and Buildillg.
No outdoor stornge of material shall occur onsite unless required by the Fire Chief.
In such instance a storage plan will be submitted for approval by the Fire Chief
and the Planning Director.
The applicanr shall prepare a detailed l,mdscape and irrigation plan which shall be
submitted to and approved by the Planning Director prior to the issuance of
grading or building permits, whichever occurs first.
All landscaped areas shall be maintailled in a healthy and thriving condition, free
from weeds, trash, and debris.
All landscape plans shall be prepared to conform with the Landscape Manual and
submitted per the landscape plan check procedures on file in the Planning
Department.
Landscape plans shall be designed to minimize water use. Lawn and other zolle
1 plants (see LandJcape Manual) shall be limited to areas of special visual
importance or high use. Mulches shall be used and irrigation equipment and
desigll shall promote water conservation.
Prior to final occupancy, a lette,· from a California licensed landscape architect
shall be si.1bmitted to the Planning Director certifying that all landscaping has been
installed as shown 011 tl1e approved lm1dscape plans.
All herbicides shall be applied by applicators licensed by the State of California.
The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code. This fee may be waived at the
discretion of the Planning Director.
The first set of landscape alld irrigation plans submitted shall include building
plans, improvemenr plans and grading plans.
The minimum shrub size _shall be 5 gallons.
30% of trees ill industrial and commercial projects shall be 24" box or greater.

23. Arly signs proposed for this development shall ar a minimum be designed in
conformance with rhc City's Sign OrdinGnce and slwll require review and approval
of the Planning Director prior to installation of such signs.
24. As part of the plans submitted for building permit plan check, the applicant shall
include a reduced version of the approving resolution/resolutions on a 24" x 36"
blueline drawing. Suid blueline drawing(s) shall also include a copy of aRy
o1pplicable Coastal Development Permit alld signed approved site plan.
Fire:
25. Prior to the issrnmce of building permits, complete buildillg plans shall be
submitted to and approved by the Fire Department.
26. Applicant shall submit a sire plan to the Fire Department for approval, which
depicts location of required, proposed and existing public water mains and fire
hydrants. The plrm should include oJT-site fire hydrants within 200 feet of the
project.
27. All all weather, unobstructed access road suitable for emergency service vehicles
shall be provided and maintained during construction. When in the opinion of the
Fire Chief, the access road has become unserviceable due to inclement weather or
other reasoll.s, he may, in the interest of public safety, require that construction
operations cease until the condition is corrected.
28. All security gate systems C()ntrolling vehicular access shall be equipped with a
"Knox", key.operated emergency c1pry device. Applicant shall contact the Fire
Prevention Bureau for specifications and approvals prior to installation.
