Recommended Action
Adopt a resolution accepting a compliance report on the status of all state-mandated fire
inspections in the City of Carlsbad under California Senate Bill 1205 and California Health and
Safety Code Section 13146.4.
Executive Summary
Local fire departments are required to perform annual fire inspections of all public and private
schools, hotels, motels, lodging houses and apartment and/or condominium buildings under
California Health and Safety Code Sections 13146.2 and 13146.3. In addition, a compliance
report must be provided to its administrating authority each year in accordance with Section
13146.4. This report confirms that all initial annual fire inspections for fiscal year 2021-22 are
complete.
Discussion
Annual fire inspections help mitigate known hazards, reduce community risk and ensure
reasonable compliance with the California Fire Code. Inspections confirm proper maintenance
of fire protection systems, effective egress systems, damage to fire protective construction and
sufficient site access for Fire Department personnel.
State health and safety codes mandate that all hotels, motels and lodging houses are inspected
annually by the local fire department. The Carlsbad Fire Department inspected 43 hotels and/or
motels totaling 163 buildings.
All apartment buildings are also inspected annually by the local fire department. An apartment
building consists of three or more attached units and excludes all duplex buildings. The
California Building Code also specifies that condominiums should be considered apartments.
The Carlsbad Fire Department inspected 2,270 apartment buildings with three units or greater.
The department also inspected 37 public and private schools, totaling 251 buildings.
In total, the Fire Department conducted 2,684 mandated inspections during fiscal year 2021-22
and completed initial inspections of all known buildings and structures within the state
mandate. The acceptance of this compliance report and resolution fulfills the statutory

requirements contained in California Health and Safety Code Sections 13146.2, 13146.3 and
13146.4.
Fiscal Analysis
There is no fiscal impact with filing and accepting this report.

Environmental Evaluation
This action does not constitute a “project” within the meaning of the California Environmental
Quality Act under Public Resources Code section 21065. It has no potential to cause either a
direct physical change in the environment or a reasonably foreseeable indirect physical change
in the environment and therefore does not require environmental review.

Public notice of this item was posted in keeping with the state's Ralph M. Brown Act and it was
available for public viewing and review at least 72 hours before the scheduled meeting date.

EXHIBIT 1 RESOLUTION NO. 2022-143
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING A REPORT ON THE STATUS OF ALL STATE
MANDATED ANNUAL FIRE INSPECTIONS IN THE CITY OF CARLSBAD IN
CONJUNCTION WITH THE CALIFORNIA SENATE BILL 1205 AND THE
CALIFORNIA HEALTH AND SAFETY CODE SECTION 13146.4
WHEREAS, California Health & Safety Code Section 13146.4 was added in 2018, and became
effective on September 27, 2018; and
WHEREAS, California Health & Safety Code Sections 13146.2 and 13146.3 requires all fire
departments that provide fire protection services to perform annual inspections in every building used
as a public or private school, hotel, motel, lodging house, apartment house, and certain residential care
facilities for compliance with building standards, as provided; and
WHEREAS, California Health & Safety Code Section 13146.4 requires all fire departments that
provide fire protection services to report annually to its administering authority on compliance with
Sections 13146.2 and 13146.3; and
WHEREAS, the City Council of the City of Carlsbad intends this Resolution to fulfill the
requirements of the California Health & Safety Code regarding acknowledgment of the Carlsbad Fire
Department's compliance with California Health and & Safety Code Sections 13146.2 and 13146.3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, that
said City Council expressly acknowledges the measure of compliance of the Carlsbad Fire Department
with California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the
City of Carlsbad, as follows:
A.EDUCATIONAL GROUP E OCCUPANCIES:
Educational Group E occupancies are generally those public and private schools, used by more
than six persons at any one time for educational purposes through the 12th grade. Within the City of
Carlsbad, there are 37 Group E occupancy campuses.

During fiscal year 2021-22, the Carlsbad Fire Department completed the annual inspection of
37 Group E occupancies, with a total building count of 251 structures and/or facilities. This is a
compliance rate of 100 percent for this reporting period.
B.RESIDENTIAL GROUP R OCCUPANCIES:
Residential Group R occupancies, for the purposes of this resolution, are generally those
occupancies containing sleeping units, and include hotels, motels, apartments (three units or more),
etc. as well as other residential occupancies. Within the City of Carlsbad, there are 2,433 Group R (and
their associated sub-categories) occupancies of this nature.
During fiscal year 2021-22, the Carlsbad Fire Department completed the annual inspection of
2,433 Group R occupancies, buildings, structures and/or facilities. This is a compliance rate of 100
percent for this reporting period.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That this Resolution, and all action taken subsequent hereto in connection herewith, is
taken pursuant to the provisions of California Health and Safety Code sections 13146,
et seq. (Article 2, State Board of Fire Services).
3.Words used in this Resolution and its subsequent action in connection herewith shall
be defined as outlined in said code sections.
4.That the City Council of the City of Carlsbad hereby declares that the City of Carlsbad is
compliant with the state-mandated fire inspection requirements contained within
California Health and Safety Code Sections 13146.2 and 13146.3.
5.That the City Council of the City of Carlsbad hereby declares that the Fire Department
has met its mandatory reporting requirements to the administering agency, as
required in California Health and Safety Code section 13146.4.
