Executive Summary/Discussion Commissioner Michael Corrigan was appointed to the Beach Preservation Commission in March 2022 to fill the unexpired term of Commissioner John Prietto with a term ending in June 2022. This leaves a scheduled vacancy on the Beach Preservation Commission, with a term ending in June 2026. Commissioner Corrigan is eligible for and is seeking reappointment. Commissioner Fred Briggs was initially appointed to the Beach Preservation Commission in May 2014 to fill the expired term of Commissioner Jayme Timberlake with a term ending in June 2018. Commissioner Briggs was reappointed in July 2018 with a term ending in June 2022, leaving a scheduled vacancy on the Beach Preservation Commission with a term ending in June 2026. Commissioner Briggs in not eligible for reappointment. The City Clerk’s Office received 12 applications from residents wishing to serve on the Beach Preservation Commission. In keeping with City Council Policy Statement No. 88, the Mayor has recommended the following four residents wishing to serve on the Beach Preservation Commission to advance in the process and interview with the full City Council: •Michael Corrigan (seeking reappointment) – District 1 •Kervin Krause – District 1 •Kevin Shotas – District 2 •Jeffrey Weston – District 2 Exhibit 3 includes applications for all four residents. The Beach Preservation Commission is to consist of seven members. City Council Resolution No. 2020-009 states that the mission of the Beach Preservation Commission is to advise the City Council and the City Manager on matters related to erosion prevention and protection and/or June 21, 2022 Item #15 Page 1 of 13 enhancement of the Carlsbad shoreline (e.g., sedimentation, sea level rise, etc.) and to study the best means to maintain beaches for the safety and optimum enjoyment of the public. Current members of the Beach Preservation Commission are: Commission Member District Brian Colby Robert Ingersoll Lisa Stark Kathleen Steindlberger Chris Woolsey 3 3 3 1 2 Members of the Beach Preservation Commission are subject to the provisions of the California Political Reform Act and must file statements of economic interest each year and complete two hours of ethics training every two years. The Maddy Act (California Government Code Sections 54970-54974) requires that on or before Dec. 31 of each year the legislative body must prepare a local appointments list that contains the appointive terms of board and commission members that will expire in the next calendar year, the name of the incumbent appointee, the date of appointment and the term expiration date. Based on the list, the City Clerk’s Office accepts applications (available on the city’s website and in the City Clerk’s Office) for any upcoming vacancies. Fiscal Analysis This action has no financial impact. Next Steps Following the appointment of two members to the Beach Preservation Commission, the City Clerk’s Office will update the commission roster and coordinate the oath of office and the filing of the appointees’ statements of economic interest and ethics training certificates. Environmental Evaluation This action does not constitute a project within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Public Notification This item was noticed in keeping with the Ralph M. Brown Act and it was available for public viewing and review at least 72 hours before the scheduled meeting date. CORRIGAN ATTORNEY AT LAW Wateridqe Pavilion Sa11 Diego, California 92121-2746 Mr. Corrigan's practice emphasizes general and SEC representation of emerging high technology and other operating companies. He has been counsel to private and public companies in a broad range of industries, including computer hardware and software, telecommunications, multimedia, action sports, restaurant, entertainment and sporting goods manufacturing. He has assisted these companies with their corporate and partnership organization, private and public financing of debt and equity, mergers and ac- quisitions, joint ventures, technology licensing, real estate syndication and related commercial arrange- ments. He has advised owners of these companies on retirement planning and estate planning matters. In addition, Mr. Corrigan has represented several regional investment banking, advisory and management firms in securities and underwriting transactions, as well as compliance matters. Mr. Corrigan escaped to California from Colorado in 1980. The 97-98 El Nino altered our coastline and beaches in only one winter season of weeks-long big swells and heavy rains. Tamarack, Ponto, and other beaches had no sand until the sand was replaced before summer. Cardiff Row was shut down for weeks. We must protect our beaches and coastline!
