ANNOUNCEMENT OF CONCURRENT MEETINGS: Mayor Hall announced that he City Council
would be serving as the Carlsbad Municipal Water District Board of Directors on Ordinance for
Adoption Item No. 7 and Departmental and City Manager Reports Item No. 12. He also
announced that the City Council would be serving as both the Carlsbad Municipal Water District
Board of Directors and City Council for Departmental and City Manager Report Item No. 13.
PLEDGE OF ALLEGIANCE: Mayor Pro Tem Blackburn led the Pledge of Allegiance.
INVOCATION: None.
PUBLIC REPORT OF ACTION TAKEN IN CLOSED SESSION: Assistant City Attorney Cindie McMahon
announced that there was no reportable action.

Proclamation in Recognition of Historic Preservation Month and Third Grade Art Contest Award

Commission Chair Chad Majer who shared a few words. Deputy Library & Cultural Arts Director
Sheila Crosby presented certificates to the 3rd Grade Art contest winners.

7. CMWD ORDINANCE NO. 48 – ORDINANCE TO MIRROR THE SAN DIEGO COUNTY WATER
AUTHORITY’S 2020 MODEL DROUGHT ORDINANCE BY ESTABLISHING SIX WATER SHORTAGE
LEVELS – Adoption of Carlsbad Municipal Water District Board of Directors Ordinance No. 48
mirroring the San Diego County Water Authority’s 2020 Model Drought Ordinance and
establishing six water shortage levels. (Staff contact: Faviola Medina, City Clerk’s

City Manager’s Recommendation: Adopt CMWD Ordinance No. 48.
Assistant City Attorney McMahon titled CMWD Ordinance No. 48.

PUBLIC HEARINGS:
8. TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2022-
23 THROUGH 2026-27 – Adoption of Resolution No. 2022-128 approving the Carlsbad
TransNet Local Street Improvement Program of Projects for fiscal years 2022-23 through
2026-27 for inclusion in the 2023 San Diego Association of Governments Regional
Transportation Improvement Program. (Staff contact: Hossein Ajideh, Public Works)
City Manager’s Recommendation: Take public input, close the public hearing, and adopt the
resolution.
Assistant City Attorney McMahon announced that Mayor Hall will recuse himself during the
discussion and decisions of projects in the Village and Barrio area, CB52 and CB62, due to a
conflict of interest.
Engineering Manager Hossein Ajideh presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).
Mayor Hall opened the duly noticed Public Hearing at 5:37 p.m.
Mayor Hall recused himself at 5:38 p.m.

In response to an inquiry from Council Member Acosta, Engineering Manager Ajideh
explained that the May 2021 amendment included the addition of two new projects to the
program and added additional funding to existing projects that were short on funding.
Seeing no one wishing to speak, Mayor Pro Tem closed the duly noticed Public Hearing at 5:39
p.m.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel to approve
CB52 and CB62 as projects in Resolution No. 2022-128. Motion carried 4/1 (Hall – Absent).
Mayor Hall returned to the dais at 5:40 p.m.
Mayor Pro Tem Blackburn recused himself due to a conflict of interest with the Poinsettia Lane
Reach E project, CB13 at 5:40 p.m.
Motion by Council Member Bhat-Patel, seconded by Council Member Acosta to approve CB13
as a project in Resolution No. 2022-128. Motion carried 4/1 (Blackburn – Absent).
Mayor Pro Tem Blackburn returned to the dais at 5:41 p.m.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel to approve
the remaining items contained in Resolution No. 2022-128. Motion carried unanimously, 5/0.
DEPARTMENTAL AND CITY MANAGER REPORTS:
9. CONSIDERATION OF ESTABLISHMENT OF A CARLSBAD COMMUNITY-POLICE ENGAGEMENT
COMMISSION – Receive a report prepared by Michael Gennaco and Julie Ruhlin of OIR Group
regarding more formalized community engagement with the Carlsbad Police Department and
providing direction to staff about establishing a Carlsbad Community-Police Engagement
Commission. (Staff contact: Sheila Cobian, City Manager’s Department, Mickey Williams,
Police Department and Allegra Frost, City Attorney’s Department)
City Manager’s Recommendation: Receive the report.
Legislative & Constituent Services Director Sheila Cobian and OIR Group Founding Principal
Michael Gennaco presented the report and reviewed a PowerPoint presentation (on file in
the Office of the City Clerk).
Yusef Miller expressed his support for establishing a Community-Police Engagement
Commission.
Vicky Sayage expressed her support and recommendations for establishing a Community-
Police Engagement Commission.

Joseph Ramos expressed his support for establishing a Community-Police Engagement
Commission and urged the City Council to consider delegating a seat on the commission to a
member of the Carlsbad Equality Coalition.
Hannah Summerhill expressed her support for establishing a Community-Police Engagement
Commission and urged the City Council to consider delegating a seat on the commission to a
member of the Carlsbad Equality Coalition.
Aly Vredenburgh representing a group of Joe, Alison Vredenburgh and Sabrina Goodman,
expressed her support for establishing a Community-Police Engagement Commission and
urged the City Council to consider delegating a seat on the commission to a member of the
Carlsbad Equality Coalition.
Brandon Tiongison expressed his support for establishing a Community-Police Engagement
Commission urged the City Council to consider delegating a seat on the commission to a

In response to an inquiry from Council Member Bhat-Patel, Legislative & Constituent Services
Director Cobian explained that if the Council desired, they could choose to approve both a
commission and an annual report from the Police Chief.
In response to an inquiry from Council Member Bhat-Patel, OIR Group Founding Principal
Gennaco provided an overview of the structure of how work groups typically function in these
types of commissions.
In response to an inquiry from Council Member Bhat-Patel, Legislative & Constituent Services
Director Cobian explained that staff anticipate absorbing the workload of a new commission
with existing staff. She added that there would be additional costs associated with
broadcasting and running the meetings.
In response to an inquiry from Council Member Acosta, OIR Group Founding Principal
Gennaco recommended that the commission be made up of 5 to 7 members.

In response to an inquiry from Council Member Acosta, OIR Group Founding Principal
Gennaco offered to provide examples of list of duties from other jurisdictions if the Council
proceeds in establishing a commission.
In response to an inquiry from Council Member Norby, Police Chief Mickey Williams explained
that community outreach is a high priority for the Police Department. He further explained
that this commission would serve as a new opportunity for the Police Department to engage
with the community and does not see it causing a financial burden for the department.
In response to an inquiry from Council Member Norby, OIR Group Founding Principal
Gennaco explained that he is not familiar with commissions being ran by nonprofit
organizations within the community in the other jurisdictions he has worked with. He further
added that with the city’s involvement, it creates a more formal framework
In response to an inquiry from Mayor Pro Tem Blackburn, OIR Group Gennaco explained that
he believes best practice would include having a Police Department presence at the meetings
to hear any concerns and to answer any questions that may arise.
Council received the report.
Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel directing staff
to draft and bring back an ordinance establishing a Community-Police Engagement
Commission and include the following:
• Five-member commission with no special interests
• Primary duty of community engagement, not police oversight
• Quarterly meetings
• Annual workplans presented to the City Council
• Name the commission Carlsbad Community-Police Engagement Commission
• Reports directly to the City Council. Motion carried, 4/1 (Hall – No).

10. HOMELESS QUARTERLY UPDATE FOR JAN. 1 - MARCH 31, 2022 – Receive the third quarterly
update on the city’s goal to reduce its unsheltered homeless population, covering the period
from Jan. 1 - March 31, 2022. (Staff contact: Mandy Mills, Housing & Homeless Services)
City Manager’s Recommendation: Receive the report.
Housing & Homeless Services Director Mandy Mills, Police Lieutenant Darbie Ernst and Senior
Program Manager Chris Shilling presented the report and reviewed a PowerPoint
presentation (on file in the Office of the City Clerk).

In response to an inquiry from Council Member Norby, Senior Program Manager Shilling
reported that there were 146 individuals from the north coastal region that were sheltered
during the point-in-time count.
In response to an inquiry from Council Member Norby, Housing & Homeless Services Director
Mills explained that shelter services have increased in the last five years.
In response to an inquiry from Council Member Norby, Housing & Homeless Services Director
Mills explained that there are multiple public restrooms across the city at parks and beaches,
and in addition the city was funding five portable units, but one of the portable units has been
removed due to resident concerns.
In response to an inquiry from Council Member Acosta, Housing & Homeless Services Director
Mills explained that in term “unduplicated contact,” “contact” could reference a house or an
individual, and “unduplicated” is stated as an assurance that if services are offered to a
contact more than once, they are not duplicating their data and the contact is only
documented once.
In response to an inquiry from Council Member Acosta, Housing & Homeless Services Director
Mills explained that the number of permanent housing placements was very high in the third
quarter and a major success.
In response to an inquiry from Council Member Acosta, Police Lieutenant Ernst explained that
counting the number of shopping carts collected did not start until the second quarter.
In response to an inquiry from Council Member Bhat-Patel, Police Lieutenant Ernst explained
that the Homeless Outreach Team recently began using E-bikes in the downtown area to
encourage engagement and accessibility.
In response to an inquiry from Council Member Bhat-Patel, Housing & Homeless Services
Director Mills explained that city staff are in touch with the county and monitoring federal
funding opportunities.
In response to an inquiry from Mayor Pro Tem Blackburn, Senior Program Manager Shilling
explained that the city uses the Homeless Management Information System which allows for
detailed reporting and history of the homeless community amongst other cities and services.

11. STATUS OF TEMPORARY OUTDOOR ACTIVATION PERMITS ISSUED DUE TO COVID-19
PANDEMIC – Receive a report on the status of the temporary outdoor activation permits that
were issued in response to the COVID-19 pandemic and provide staff direction, as
appropriate. (Staff contact: Eric Lardy, Community Development)
City Manager’s Recommendation: Receive the report and provide direction to staff.

Mayor Hall recused himself at 7:58 p.m. due to a potential conflict of interest with properties in
the Village and Barrio Master Plan area.
Principal Planner Eric Lardy and Community Development Director Jeff Murphy presented
the report and reviewed a PowerPoint presentation (on file in the Office of the City Clerk).
In response to an inquiry from Mayor Pro Tem Blackburn, Community Development Director
Murphy explained that the city has not experienced frequent reports of incidents with
vehicles and the outdoor activations.
In response to an inquiry from Council Member Norby, Community Development Director
Murphy explained that staff is currently looking at options to require a fee for permanent
outdoor activations.
Council received the report.

12. IMPLEMENTATION OF DEMAND REDUCTION ACTIONS FOR WATER SHORTAGE LEVEL 2 TO
COMPLY WITH NEW STATE WATER RESOURCES CONTROL BOARD EMERGENCY REGULATION
Adoption of Carlsbad Municipal Water District Board of Directors Resolution No. 1672
directing the Executive Manager to implement the demand reduction actions for water
shortage Level 2 to comply with the emergency regulation adopted by the State Water
Resources Control Board on May 24, 2022. (Staff contact: Mario Remillard and Vicki Quiram,
Public Works)
City Manager’s Recommendation: Adopt the resolution.
Utilities Director Vicki Quiram presented the report and reviewed a PowerPoint presentation
(on file in the Office of the City Clerk).
In response to an inquiry from Council Member Bhat-Patel, Utilities Director Quiram
explained that the community has reduced the number of gallons of water, per capita, per
day by 58% from 1990-2020.
In response to an inquiry from Council Member Bhat-Patel, Utilities Director Quiram
explained that there will be numerous community outreach education efforts regarding this
reduction.
In response to an inquiry from Council Member Bhat-Patel, Utilities Director Quiram
explained that the state is recommending soft enforcement and the city only plans to use
enforcement if needed once the program is implemented.

Motion by Mayor Pro Tem Blackburn, seconded by Council Member Bhat-Patel, to adopt
CMWD Resolution No. 1672. Motion carried unanimously, 5/0.
13. FISCAL YEAR 2022-23 PRELIMINARY CAPITAL IMPROVEMENT AND STRATEGIC DIGITAL
TRANSFORMATION INVESTMENT PROGRAMS – Accept a report detailing the proposed fiscal
year 2022-23 preliminary Capital Improvement and Strategic Digital Transformation
Investment Programs and provide direction to staff on any changes desired. (Staff contact:
Laura Rocha, Administrative Services Department and Paz Gomez, Public Works)
City Manager’s Recommendation: Accept the report.
Deputy City Manager Public Works Paz Gomez and Information Technology Director Maria
Callander presented the report and reviewed a PowerPoint presentation (on file in the Office
of the City Clerk).

in the Village and Barrio Master Plan area.
In response to an inquiry from Council Member Bhat-Patel, Deputy City Manager Public
Works Gomez explained that the projects to be decelerated were determined by staff’s
consideration of department capacity, timing, and funding.
In response to an inquiry from Council Member Bhat-Patel, Deputy City Manager Public
Works Gomez explained that each project has an individual timeline and staff would need to
look at the projects separately to determine the delay timeframe for each of them.
In response to an inquiry from Council Member Acosta, Deputy City Manager Public Works
Gomez explained that there are projects within the Sustainable Mobility Plan that staff are
planning to roll out sooner than others, and the ones specifically mentioned in the report are
the ones being proposed to be delayed by one year.
In response to an inquiry from Council Member Acosta, Deputy City Manager Public Works
Gomez explained that the Sustainable Mobility Plan will come back to the City Council for
reprioritization for the next fiscal year.
In response to an inquiry from Council Member Norby, Deputy City Manager Public Works
Gomez explained that some projects have factors that impact each other, causing some to be
delayed over others. She added that another factor causing possible delays is working with
other utilities.
Motion by Council Member Norby, seconded by Council Member Bhat-Patel to approve
staff’s recommendation, remove the Sustainable Mobility Plan from the deceleration list of
projects and return with options to reprioritize the Sustainable Mobility Plan. Motion carried,
