The Planning Division has completed its review of your application for the first extension of Tentative
Tract Map CT 15-07, Planned Development Permit PUD 15-15, Coastal Development Permit CDP 15-53,
Hillside Development Permit HOP 15-03, and Habitat Management Plan Permit HMP 15-05 -OCEAN
VIEW POINT, submitted on June 30, 2022. The 21.9-acre project site, generally located south of the
terminus of Twain Avenue within the Mello II Segment of the Local Coastal Program, was approved by
the City Council on August 20, 2019 (Resolution No. 2019-144) as recommended per Planning
Commission Resolution No. 7339 (dated June 19, 2019}, and later approved by the California Coastal
Commission (CCC} on August 13, 2020 (LCP-6-Cll-19-0145-1}. Condition No. 11 of Planning Commission
Resolution No. 7339 required that the project approval shall become null and void if the final map is
not approved within 24 months from the date on which the CCC voted to approve the project (August
13, 2020). As such, the project is due to expire on August 13, 2022.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the first extension of Tentative Tract Map CT 15-07, Planned Development Permit PUD 15-15, Coastal
Development Permit CDP 15-53, Hillside Development Permit HOP 15-03, and Habitat Management
Plan Permit HMP 15-05 -OCEAN VIEW POINT was submitted in a timely manner prior to the expiration
date, and (2) that the findings required for granting an extension of said permits can be made; therefore,
the City Planner APPROVES the first extension of Tentative Tract Map CT 15-07, Planned Development
Permit PUD 15-15, Coastal Development Permit CDP 15-53, Hillside Development Permit HDP 15-03,
and Habitat Management Plan Permit HMP 15-05 -OCEAN VIEW POINT for a period of two (2) years
from August 13, 2022 to August 13, 2024, based on the following findings and conditions.
Findings:
1. All the findings contained in Planning Commission Resolution No. 7339 dated June 19, 2019, are
incorporated herein by reference, and remain in effect.
2. That the first two-year extension of Tentative Tract Map CT 15-07, Planned Development Permit
PUD 15-15, Coastal Development Permit CDP 15-53, Hillside Development Permit HOP 15-03, and
Habitat Management Plan Permit HMP 15-05 remains consistent with the General Plan, all titles of
the Carlsbad Municipal Code and growth management program policies and standards in place at the
time the extension was filed.

3. The City Planner has determined that:
a. the project is a project for which a Mitigated Negative Declaration, Mitigation Monitoring
and Reporting Program and Addendum were previously adopted [15162] (City Council
Resolution No. 2019-144, dated August 20, 2019);
b. this project is consistent with the project cited above;
c. the Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program and
Addendum were adopted in connection with the prior project;
d. the project has no new significant environmental effect not analyzed as significant in the prior
Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program and
Addendum;
e. none of the circumstances requmng further environmental compliance under CEQA
Guidelines Sections 15162 or 15163 exist; and
f. the City Planner finds that all feasible mitigation measures identified in the Mitigated
Negative Declaration, Mitigation Monitoring and Reporting Program and Addendum, which
are appropriate to this Subsequent Project, have been incorporated into this Subsequent
Project.
Conditions:
1. This first extension of Tentative Tract Map CT 15-07, Planned Development Permit PUD 15-15,
Coastal Development Permit CDP 15-53, Hillside Development Permit HDP 15-03, and Habitat
Management Plan Permit HMP 15-05 is granted for a period of two (2) years from August 13, 2022,
to August 13, 2024. If the final map for this project is not approved within this time period, the
Tentative Tract Map and related permits will expire on August 13, 2024, unless extended per
Sections 21.58.040 and 21.201.210 of the Carlsbad Municipal Code.
2. All of the conditions contained in Planning Commission Resolution No. 7339 dated June 19, 2019, for
Tentative Tract Map CT 15-07, Planned Development Permit PUD 15-15, Coastal Development
Permit CDP 15-53, Hillside Development Permit HDP 15-03, and Habitat Management Plan Permit
HMP 15-05 apply to this extension and are incorporated herein by reference and remain in effect
except for Condition No. 11, which is superseded by Condition No. 1 of this approval letter.
