Recommended Action
Adopt a resolution authorizing the City Manager, or designee, to execute all documents
required to purchase, register and transfer title for two modular residential buildings to the City
of Carlsbad and approving plans, specifications and contract documents and authorizing the
City Clerk to advertise for bids for construction of a temporary garage for the Temporary Fire
Station 7 Construction Project, Capital Improvement Program Project No. 4091.
Executive Summary
The city is building a temporary fire station near Carlsbad Boulevard while a permanent site is
obtained and developed. Temporary Fire Station 7 will consist of two modular residential
buildings and a movable high-tensioned fabric structure that will serve as the station’s garage.
Staff request that the City Council authorize the City Manager or designee to execute all
required documents to purchase, register and transfer title for the two modular residential
buildings to the City of Carlsbad. Staff also request that the City Council approve plans,
specifications and contract documents for Capital Improvement Program Project No. 4091 and
authorize the City Clerk to advertise for bids for construction of the movable fabric structure. (A
proposed resolution is attached as Exhibit 1.)
City Council approval of these plans and specifications is required under Carlsbad Municipal
Code Section 3.28.080(E) because the expected value for this work is greater than $200,000.
Discussion
Timeline
The City Council has taken the following actions in approving this project:
March 11, 2021 - Identified as one of its four priority goals for FY 2021-22 to “bring the
Fire Department into conformance with the standards of cover evaluation.” This refers
to the Standards of Coverage, a document that determines the level of protection that
best fits a fire department’s needs.

May 11, 2021- Approved a work plan to implement its priority goals that identified and
detailed the need for a temporary Fire Station 7 west of the railroad tracks, near
Carlsbad Boulevard.
April 5, 2022 - Authorized the purchase of the required second modular residential
building and the materials necessary to expand the fabric structure to 3,200 square feet.
(Resolution No. 2022-082)
June 21, 2022 - Authorized the city entering into a license agreement with Cabrillo
Power I LLC, a subsidiary of NRG West Coast LLC, to locate Temporary Fire Station 7 on
property owned by NRG at 4600 Carlsbad Blvd. (A location map is provided as Exhibit 7)
The project
Temporary Fire Station 7, to be built on the former power plant site along Carlsbad Boulevard
near Cannon Road (Exhibit 7), will consist of two modular residential buildings and the high-
tensioned fabric structure that will be used as the garage to store Fire Department vehicles and
equipment.
One temporary modular building and a 1600-square foot high-tension fabric structure are now
serving as a temporary fire station adjacent to the City Library on Dove Lane during the
reconstruction of Fire Station 2.
The company awarded the contract for that project, Barnhart-Reese Construction Inc., is
required under the contract to transfer ownership of the two structures to the city and deliver
them to the temporary Fire Station 7 site once the reconstruction of Fire Station 2 is complete,
which is expected to be in fall 2022.
Staff are requesting that the City Council delegate authority to the City Manager, or designee,
to execute all required documents needed to transfer title of the modular residential building
to the City of Carlsbad.
The second temporary modular residential building and the materials needed to expand the
temporary garage materials have been ordered, and staff are also requesting that the City
Council delegate authority to the City Manager, or designee, to execute all documents required
for the City of Carlsbad to take ownership of and register that second modular residential
building.

Additional forms related to the purchase of the manufactured home will include escrow and
title documentation
The Coastal Commission has approved the coastal development permit for the project. The
plans and specifications for Temporary Fire Station 7 were submitted to the Building Division of
the Community Development Department for permit review on May 31, 2022.
Staff are requesting that the City Council approve the plans, specifications and contract
documents and authorize the City Clerk to advertise for bids for construction of the Sprung
Structure for the Temporary Fire Station 7 Construction Project, CIP Project No. 4091.

Staff provide the following options for the City Council’s consideration:
1. Adopt a resolution authorizing the City Manager, or designee, to execute all documents
required to purchase, register and transfer title for two modular residential buildings to
the City of Carlsbad, and approving plans, specifications and contract documents, and
authorizing the City Clerk to advertise for bids for construction of the Sprung Structure
for CIP Project No. 4091.

Next Steps
With the City Council’s approval, staff will execute all documents required to purchase, register
and transfer title for two modular residential buildings to the City of Carlsbad and advertise a
request for bids to construct the project. Staff will evaluate the bids received and identify the
lowest responsive and responsible bidder.
Staff will then return to the City Council with a recommendation to award a construction
contract to the identified bidder, which is expected to be in fall 2022. The construction contract
for the project provides for three months to construct the project improvements. On-site
construction is expected to begin in December 2022 and to be completed in January 2023.
Environmental Evaluation
The City Planner determined on Dec. 20, 2021, that the project belongs to a class of projects
that the State Secretary for Natural Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the preparation
of environmental documents, according to the following sections of California Environmental
Quality Act Guidelines: Section 15301 – Existing Facilities, (b); 15303 – New Construction or
Conversion of Small Structures, (c); and 15304 –Minor Alterations To Land, (f).
In making this determination, the City Planner has found that the exceptions listed in Section
15300.2 of the guidelines do not apply to this project. Specifically:
• The project is consistent with 15301 (b) because it is located on a developed site
with existing parking and utilities, such as gas, sewer, water and electrical amenities.
• The project is consistent with Section 15303 (c) because the two temporary
buildings that would house a maximum of seven staff members and would contain
two offices are each less than 2,000 square feet and combined are less than 6,000
square feet.
• The project is consistent with Section 15304 (f) because there will be minor
trenching conducted to connect to existing underground utilities and the surface
would be restored. Purchasing modular buildings for implementation is consistent
with that determination.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and it was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO
EXECUTE ALL DOCUMENTS REQUIRED TO PURCHASE, REGISTER AND
TRANSFER TITLE FOR TWO MODULAR RESIDENTIAL BUILDINGS TO THE CITY
OF CARLSBAD, AND APPROVING THE PLANS, SPECIFICATIONS AND
CONTRACT DOCUMENTS, AND AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR CONSTRUCTION OF A TEMPORARY GARAGE FOR
THE TEMPORARY FIRE STATION 7 PROJECT
WHEREAS, the contract with Barnhart-Reese Construction, Inc., or BRC, for the Fire Station 2
Capital Improvement Project, or CIP, Project No. 4060, requires BRC to transfer title of the residential
modular home currently serving as Temporary Fire Station 2 to the City of Carlsbad upon completion
of CIP Project No. 4060; and
WHEREAS, on April 5, 2022, the City Council adopted Resolution No. 2022-082, authorizing
purchase of a second modular residential building for the Temporary Fire Station 7 project, CIP Project
No.4091;and
WHEREAS, a city representative must sign various forms to transfer title and register both
residential modular buildings with the State Department of Housing and Community Development on
the Multi-Purpose Transfer Form; and
WHEREAS, plans for construction of the Temporary Fire Station 7 modular residential buildings
and Sprung Structure have been developed and are currently being reviewed for code compliance by
the city's Building Division of the Community Development Department; and
WHEREAS, the City Council has determined that the plans, specifications and contract
documents for construction of the Sprung Structure for the Temporary Fire Station 7 project have been
completed to the satisfaction of city staff; and
WHEREAS, the City Council has determined it necessary, desirable and in the public interest to
construct CIP Project No. 4091; and
WHEREAS, the plans, specifications and contract documents for CIP Project No. 4091 have been
prepared, are on file at the City Clerk's office and are incorporated by reference; and
WHEREAS, City Council approval of these plans, specifications, and contract documents is
required under Carlsbad Municipal Code Section 3.28.080(E) because the expected value to construct
the Project exceeds $200,000, making the Project subject to this requirement; and

following agreements and related documents, with the City Attorney's prior review and
approval, to purchase, transfer title and register the modular residential buildings that
will serve as Temporary Fire Station 7 to the City of Carlsbad:

b.State of California, Department of Housing and Community Development Multi
Purpose Transfer Form;

4.That the City Clerk is hereby authorized and directed to publish, in accordance with state
law, and Carlsbad Municipal Code Section 3.28.080((), a notice to contractors inviting
bids for construction of CIP Project No. 4091 in accordance with plans, specifications
and contract documents referred to herein.
