A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO
EXECUTE ALL DOCUMENTS REQUIRED TO PURCHASE, REGISTER AND
TRANSFER TITLE FOR TWO MODULAR RESIDENTIAL BUILDINGS TO THE CITY
OF CARLSBAD, AND APPROVING THE PLANS, SPECIFICATIONS AND
CONTRACT DOCUMENTS, AND AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR CONSTRUCTION OF A TEMPORARY GARAGE FOR
THE TEMPORARY FIRE STATION 7 PROJECT
WHEREAS, the contract with Barnhart-Reese Construction, Inc., or BRC, for the Fire Station 2
Capital Improvement Project, or CIP, Project No. 4060, requires BRC to transfer title of the residential
modular home currently serving as Temporary Fire Station 2 to the City of Carlsbad upon completion
of CIP Project No. 4060; and
WHEREAS, on April 5, 2022, the City Council adopted Resolution No. 2022-082, authorizing
purchase of a second modular residential building for the Temporary Fire Station 7 project, CIP Project
No.4091;and
WHEREAS, a city representative must sign various forms to transfer title and register both
residential modular buildings with the State Department of Housing and Community Development on
the Multi-Purpose Transfer Form; and
WHEREAS, plans for construction of the Temporary Fire Station 7 modular residential buildings
and Sprung Structure have been developed and are currently being reviewed for code compliance by
the city's Building Division of the Community Development Department; and
WHEREAS, the City Council has determined that the plans, specifications and contract
documents for construction of the Sprung Structure for the Temporary Fire Station 7 project have been
completed to the satisfaction of city staff; and
WHEREAS, the City Council has determined it necessary, desirable and in the public interest to
construct CIP Project No. 4091; and
WHEREAS, the plans, specifications and contract documents for CIP Project No. 4091 have been
prepared, are on file at the City Clerk's office and are incorporated by reference; and
WHEREAS, City Council approval of these plans, specifications, and contract documents is
required under Carlsbad Municipal Code Section 3.28.080(E) because the expected value to construct
the Project exceeds $200,000, making the Project subject to this requirement; and

WHEREAS, the City Planner has determined that the project belongs to a class of projects that
the State Secretary for Natural Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the preparation of
environmental documents, according to the following sections of the California Environmental
Quality Act, or CEQA, Guidelines: Section 15301-Existing facilities, (b); 15303 -New construction or
conversion of small structures, (c), 15304 -Minor alterations to land, (f).
In making this determination, the City Planner has found that the exceptions listed in Section
15300.2 of guidelines do not apply to this project. Specifically:
•The project is consistent with 15301 (b) because it is located on a developed site with
existing parking and utilities, such as gas, sewer, water and electrical amenities.
•The project is consistent with Section 15303 (c) because the two temporary buildings
that would house a maximum of seven staff members and would contain two offices are each less
than 2,000 square feet and combined are less than 6,000 square feet.
•The project is consistent with Section 15304 (f) because there will be minor trenching
conducted to connect to existing underground utilities and the surface would be restored. Purchasing
modular buildings for implementation is consistent with that determination.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the City Council hereby authorizes the City Manager, or designee, to execute the
following agreements and related documents, with the City Attorney's prior review and
approval, to purchase, transfer title and register the modular residential buildings that
will serve as Temporary Fire Station 7 to the City of Carlsbad:
a.Pacific Manufactured Homes Consent for Sharing and Use of Information Form;
b.State of California, Department of Housing and Community Development Multi
Purpose Transfer Form;
c.Pacific Manufactured Homes Manufactured Home Purchase Order and Federal
Disclosure Statement;

•
d.State of California Department of Housing and Community Development Certificate
of Title;
e.San Diego County Treasurer-Tax Collector's Manufactured Home Tax Clearance
Request Form; and
f.Any other related documents or agreements, including escrow and title
documentation, needed to purchase, transfer title and register the modular
residential buildings that will serve as Temporary Fire Station 7 in the name of the
City of Carlsbad.
3.That the plans, specifications and contract documents for construction of the Sprung
Structure for the Temporary Fire Station 7 project, CIP Project No. 4091, are hereby
approved.
4.That the City Clerk is hereby authorized and directed to publish, in accordance with state
law, and Carlsbad Municipal Code Section 3.28.080((), a notice to contractors inviting
bids for construction of CIP Project No. 4091 in accordance with plans, specifications
and contract documents referred to herein.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
