Provide support for the Carlsbad City Library on Dove Lane courtyard naming opportunity via a
memo to City Council.
Executive Summary/Discussion
The family of former Councilmember Ann Kulchin reached out to the library seeking an
honorary naming of a part of the Carlsbad City Library on Dove Library in recognition of her
more than three decades of service to the City of Carlsbad. Council Policy No. 48 (Exhibit 1)
addresses the specific guidelines and procedures for naming rights of parks and municipal
facilities. The procedure requires a written proposal for the honorific naming complete with a
justification and at least three, but no more than five, letters of support. Attached is the
required letter from the Kulchin family and an addendum highlighting her experiences serving
Carlsbad (Exhibit 2), and five letters of support (Exhibit 3) for the honorific naming, as required
by Council Policy No. 48.
Following the application submission, the next step in the process is for the department
director and the city manager to determine whether all applicable criteria has been
satisfactorily demonstrated and achieved. Exhibit 4 is a memo confirming both the department
director’s and the city manager’s support, including the area designated for naming as the
courtyard and entrance at the Carlsbad City Library on Dove Lane. With their approval, and
following Council Policy No. 48, the Library Board of Trustees can consider whether to support
the proposed naming, per Carlsbad Municipal Code 2.16.060, which states the Library Board of
Trustees may make recommendations to the City Council on matters pertaining to library
facilities. This also provides an opportunity for input from the community. The Library Board of
Trustees’ recommendation will be forwarded to the City Council for their final determination.

Next Steps
If the Library Board supports the naming of the Carlsbad City Library courtyard for former
Councilmember Ann Kulchin, staff will assist the Library Board in finalizing a memo to City
Council confirming their support (Exhibit 5).

The purpose of this policy is to:

Create and establish criteria and procedures for the naming or renaming of parks, designated
municipal facilities, and amenities within those facilities.
Encourage philanthropic giving while acknowledging public investments and safeguarding
against the unwanted commercialization of the public realm.
Provide guidance on how to apply for approval to name or rename parks, designated municipal
facilities, and amenities within those facilities.
Present a clear and consistent evaluation framework and approval process for City Council in
considering naming or renaming requests.
BACKGROUND:
The intent of this policy is to:

Confirm the practice of naming or renaming parks, designated municipal facilities, and amenities
within those facilities, after significant geographical, neighborhood, cultural and historical
elements.
Recognize substantial personal and financial contributions that individuals, groups, or
community organizations have made to the public life and the well-being of the residents of the
city.
Promote the practice of naming or renaming parks to include designated municipal facilities and
amenities within a park or municipal facility.
Create, maintain, and make available a list by department of parks, designated municipal
facilities, and amenities within those facilities eligible for City Council's consideration of naming.
Institute a process under which a city-sponsored or city-recognized fund raising support group
may work with staff and the City Council to formally establish conditions (via the agenda bill
process} under which the group may identify and market naming opportunities, and enter into
an agreement with the city under these terms.
No vested rights shall be conferred or received by any individual, entity, group, or community
organization as a result of this policy.

GRANTING OF RIGHTS
• Naming rights of parks, designated municipal facilities, and amenities within those facilities
usually granted in exchange for a significant financial contribution by an individual, group,
community organization, entity, company, corporation or foundation to the city.
• Memorial or honorific naming of parks, designated municipal facilities, and amenities within
those facilities in memory or honor of outstanding achievement, meritorious service, or
exceptional community involvement on the behalf of an individual, generally without a financial
contribution to the city.
POLICY:
Names of individuals, groups, community organizations, entities, companies, corporations, or
foundations will be considered when they have made a significant contribution to the city by:
• Enhancing the quality of life and well-being of the city and a majority of its residents.
• Contributing to the historical or cultural preservation of the city.
• Contributing toward the acquisition, development, or conveyance of land or building to the city.
• A direct relationship or association that exists between a former place of residence of the
person and the parks, designated facilities, and amenities within those designated facilities to be
named.
General criteria for naming rights (including memorial or honorific naming):
• Must be consistent with personal or financial contribution level.
• Provides a sense of place, continuity and belonging reflecting the geographic location,
community, neighborhood or street where the park, municipal facility or amenity within the
facility is located.
• Recognizes the natural, historical and/or cultural significance of the area.
• Reflects the unique characteristics of the site.
• Consistent with the mission, vision and values of the city.
Additional criteria for memorial or honorific naming:
Memorial naming is designed to specifically acknowledge deceased individuals, while honorific naming is
intended to recognize living individuals.
Parks, designated municipal facilities and amenities within those facilities may be named in memory or
honor of an individual that has:
• Made a significant, positive contribution to the community without which the park, designated
municipal facility, or amenity within those facilities may not have otherwise existed, or;
• Made an important contribution that enhanced a park, designated municipal facility, or an
amenity within those facilities in an extraordinary way, and;
• Demonstrated continuous and longstanding track record of exemplary public service, or
community volunteerism over a period of 15 or more years.
• Achieved such unique distinction as to warrant recognition;

• Had a longstanding and beneficial affiliation with the city, and;
• Maintained a continuous residence in the city.
• Where the name(s) of an individual(s) is recommended, written consent shall be obtained from
the individual(s) (for honorific naming), their heir(s), or their estate (for memorial naming) prior
to the City Council's public consideration.
In the case of a memorial naming opportunity, the person must be deceased for a minimum of one year
before the proposal will be considered.
If the name proposed is that of an elected official or public employee, they must be retired from public
service to be eligible for consideration.
Where the naming rights opportunity is the result of a financial contribution, the following factors
must be considered:
• The duration of the naming opportunity.
• The cost paid to the city for naming shall be negotiated and established according to a market
value assessment. The naming cost shall be commensurate with the cost of specific
construction, operating, maintenance, and replacement costs of the parks, designated municipal
facilities, and amenities within those facilities to be named.
• Market value assessment (a current assessment of the potential property value within the
marketplace of the Naming Rights for a specific park, designated municipal facility and
amenities within those facilities) to be coordinated by the responsible department on an
individual basis.
Renaming:
A proposal to rename or add an additional name to a park, designated municipal facility, and amenities
with those facilities shall adhere to all applicable criteria outlined above. In addition, the following
guidelines shall be followed:
• The review process shall include due consideration and a comprehensive review of all pertinent
documents by city staff. This includes a legal review by the city attorney of information relating
to the original naming and proposed renaming.
• When a park, designated municipal facility, and amenities within those facilities has already
been named, and will be replaced, substantially renovated, or developed for another use, the
replaced or renovated park, designated municipal facility, and amenities within those facilities
may be renamed.
• When a preexisting name is deemed by the Board, Commission, or city manager to be no longer
befitting.
• When in default or the terms of the Naming Agreement have been violated or not fulfilled.
• When a park, designated municipal facility, and amenities with those facilities is proposed for
renaming, a reasonable effort will be made to notify in advance the current individual named (or
immediate family members), group, or community organization of the renaming.

Existing names may not be changed without consideration of:
• Community input.
• The historical significance of the existing name.
• The impact on the individual or organization previously named.
• The cost and overall effect of changing existing signs, rebuilding community recognition and
updating records (e .g. letterhead, databases, and promotional materials).
• The Terms and Conditions of the Naming Agreement.
Names will not be chosen that:
• Cause confusion due to duplication or names sounding similar to existing locations within the
city.
• Are the names of companies whose business is substantially derived from the sale of alcohol,
tobacco, firearms, pornography, and sexually explicit goods or services.
• Are discriminatory or derogatory considering race, gender, creed, religious or political affiliation,
or other similar factors.
• Recognize the birth, marriage or anniversary of specific individuals.
Naming Rights and Memorial or Honorific Naming Agreement:
The terms of naming rights and memorial or honorific naming of parks, designated municipal facilities,
and amenities within those facilities shall be individually negotiated and agreed upon by all parties. The
agreement is a legal contract between the applicant and the city, and shall contain:
• A description of the contractual relationship, specifying the exact nature of the agreement.
• The term of the agreement (specified commencement and termination period). Naming rights
and memorial or honorific naming of parks, designated municipal facilities, and amenities within
those facilities shall never be granted in perpetuity.
• Renewal options, if any.
• For Naming Rights proposals, market value assessment, including cash, in-kind goods and
services (and method of evaluating in-kind contributions).
• Payment schedule.
• Description of rights and benefits.
• Release, indemnification, non-compliance and early termination clauses.
• Insurance clauses.
Each naming or renaming rights and memorial or honorific naming or renaming proposal will be
considered on a case-by-case basis, and final approval is at the sole discretion of the City Council.
No vested rights shall be conferred or received by any individual or entity as a result of this policy or any
action taken under this policy.
The City of Carlsbad reserves the right to reject or revoke naming rights and memorial or honorific
naming proposals submitted by individuals, groups, community organizations, companies, corporations
and foundations whose views or public statements do not promote and support the mission, vision and
values, or best interests of the city.

· Procedure:
• Applicant(s) shall submit a written proposal for naming rights or memorial or honorific naming
to the corresponding department complete with justification to aid in considering the proposal.
It is incumbent upon the applicant to clearly document and illustrate how the proposed name
satisfies the criteria as defined in this policy.
• For memorial or honorific naming, the proposal shall include supporting background
information and/or biographical information (newspaper articles, photos, proclamations,
awards, and certificates) demonstrating that the proposed name is of significance to the
community, and be accompanied by at least three, and no more than five, letters of support.
• Staff shall thoroughly review the proposal, and then forward it to the department director and
City Manager for a recommendation.
• Only if the department director and City Manager determines that all applicable criteria as
required by this policy has been satisfactorily demonstrated and achieved, shall the proposed
name be placed on the Board and/or Commission agenda (if required) for further consideration.
Incomplete or ineligible proposals will be returned to the applicant.
• Sufficient time shall be allowed for review by the Board and/or Commission and subcommittee
if required, and to publicize and receive input from the community at the Board and/or
Commission meeting. The Board and/or Commission's recommendation will be forwarded to
the City Council for their final determination of the official name.
City sponsored or city-recognized support group fundraising guidelines:
In the case of city sponsored or city-recognized support groups fundraising on behalf of the City (i.e.
Rotary Club, Friends of the Library and/or Friends of Carrillo Ranch), it is necessary to establish naming
opportunities and gift levels prior to soliciting gifts and offering naming rights to prospective donors.
No final commitment to name a park, designated municipal facility or amenity within those facilities
shall be made to a potential donor without the appropriate prior approvals as outlined within this policy.
The support groups will first establish recommended naming opportunities and gift levels. The
recommended naming opportunities and gift levels will then be submitted to the corresponding
department director for review, and then submitted to the corresponding Board and/or Commission.
The Board and/or Commission's recommendation on the naming opportunities and gift levels will then
be forwarded to the City Council for final approval via the agenda bill process prior to the support group
soliciting donations.
Appeals Process:
• Within 30 calendar days of the denial of a Naming Rights Application by a department
director/City Manager, an applicant(s) may only submit a written request for reconsideration if
the applicant can demonstrate that criteria and documentation were not properly assessed at
the time of the initial department director's review.
• The decision of the department director/City Manager may be appealed to the City Council. The
decision of the City Council is final. It is the city's policy to not consider requests for
reconsideration based solely on questions pertaining to the evaluation.

I am writing to respectfully request consideration for proper naming recognition at
the Dove Library for my fellow councilmember and dear colleague, Ann Kulchin.
This request is made in accordance with Policy 48, Naming Rights of Parks and
Municipal Facilities, and based upon her significant contribution to the City of ·
Carlsbad. I strongly believe Ann's contribution to the quality of life and wellbeing in
Carlsbad spanning more than three decades clearly meets the criteria for significant
contribution. •
My working relationship with Ann on behalf of the City began with my election to
the Council in 1990. During the three consecutive terms I served, I saw firsthand
how she helped to steer the development of the long range Carlsbad vision. She was
an integral part of why Carlsbad is such a well-planned, well-managed and well-
financed city.
Ann's deep devotion to the development of the Dove Library is well known. Her
number one passion was always for a strong library presence in the community. The
creation of the Dove Library was her joy. Ann sat on every committee for the new
library: the location committee, architect committee, and arts committee. She was
instrumental in conceiving the facility to be a cultural center not just for South
Carlsbad, but all of Carlsbad. Having been so involved in the Dove's creation, Ann
called it "my library" because she felt so invested in it.
Our community would not be the wonderful place it is without Ann's careful
direction. She is so deserving of this hon._,g.r -what a wonderful way to show
appreciation and recognition for her devotion and love for her city.

I have been blessed with the opportunity to work closely with Ann for over thirty~six years and
have witnessed her dedication and devotion firsthand. I cannot imagine anyone else who loved
the City of Carlsbad, its citizens and employees as much as Ann. It was not uncommon for her to
be spotted regularly conversing with someone who nonnally would not receive the attention
from a city councilman. She did not appeal just to those who shared her same views, but to
everyone. She truly cared for each individual and had their best interest at heart. She wanted the
citizens of Carlsbad to be fulfilled and to flourish in their community.
If not for Ann being on the city's council and her tenacity for working towards creating a
brighter future, Carlsbad would not be where it is today. I cannot think of a better way to show
recognition of Ann Kulchin's contributions than with the naming of a section of the Dove
Library in her honor where she shared a deep love and support in its creation.

As you are aware, I was police chief in Carlsbad for five years (2010-2015). During my tenure as
chief Ann was a council person. Our relationship built over the years and I witnessed her
compassion and love she had for the city of Carlsbad.
I feel this honor would be entirely appropriate to signify and represent Ann's countless
contributions in Carlsbad, which spanned over three decades. Ann was relentless in ensuring a
high quality of life for all members of the Carlsbad community. She constantly reached out to me
to make sure the police department had what it needed to guarantee the safety of the Carlsbad's
citizens, and members of the department.
In conclusion, I have heard it said, three key aspects of a successful city are: public safety,
business and commerce, and cultural institutions. Working with Ann for five years, I can truly
say she mastered this philosophy and left an amazing legacy in Carlsbad that should be model for
all who wish to serve in Carlsbad.

Recently I became aware that there has been some discussion in the city to have Ann Kulchin recognized by
naming the Dove Library in her honor. I believe that Ann's contribution to the City of Carlsbad is noteworthy of such an honor. Ann stared her professional career as a schoolteacher and holds literacy as a special place in the
core of who she is. She recognizes that for every student to reach their potential they need to have education as
a key foundational element to their success.
later on, Ann expanded her horizon of influence and ran for city council in 1980. Ann saw the need to have
quality of life as a cornerstone for all who lived in the area. Ann served on the city council for eight terms from
1980 to 2012! During this time, Ann was involved with the creation of parks and their locations, community
centers, police and fire services, and most of all, the location and placement of libraries. You see, because of Ann's educational background, she had the desire for the city to have multiple library locations that would be
easily accessible for all Carlsbad Residents. Ann was most instrumental in wanting a library in the southern end
of the city to serve those residents -especially school-aged children and senior citizens. From the initial concept
of a south library to its completion and dedication, Ann provided strategic leadership as to its location, its design
and look, and expanding its vision to include being a cultural center for the community.
I would be remiss, being from the business community, if I did not stop and recognize Ann's contribution to the business community. From the first time that I talked with Ann, she convincingly urged us to head quarter our
company, Grand Pacific Resorts, in Carlsbad. Her thought is if you are going to have projects developed in our
community then you need to be a permanent part of the community. Looking back over the years, it was some of the best advice that I have received. Ann was a friend to the business community, but she was always fair and
balanced in her approach, desiring to have harmony between the quality of life for the residents and the needs
of business. Ann certainly knew first hand that to have a growing community that provided a quality of life for its residents there must also be a strong, vibrant business environment in that community.
As we look back for the 32 years that Ann served on the Carlsbad City Council, those years were the most
significant period of time when the city grew and became what it is today. We are a remarkable city and a lot of our success was foresight and leadership of which Ann was a key stakeholder. Scott, I would urge the city to consider naming the Dove library in honor of Ann Kulchin.

Honorary Naming of Dove Library Space for Ann Kulchin (District 3)

This memorandum provides background information about a request from the family of Ann
Kulchin to establish an honorific naming of part of the Carlsbad City Library on Dove Lane (Dove
Library) in recognition of her years of service to the City of Carlsbad. In accordance with Council
Policy No. 48 (Attachment A), Library & Cultural Arts staff are requesting City Manager support
of the naming, as indicated by his signature at the end of this memorandum.
Background
Former Council Member Ann Kulchin's family reached out to Dove Library seeking an honorary
naming of a part of Dove Library in recognition of her more than three decades of service to the
City of Carlsbad. Council Policy No. 48 addresses the specific guidelines and procedures for
naming rights of parks and municipal facilities. The procedure requires a written proposal for
the honorific naming complete with a justification and at least three, but no more than five,
letters of support. Attached is the required letter from the Kulchin family and an addendum
highlighting her experiences serving Carlsbad (Attachment B), and five letters of support
(Attachment C) for the honorific naming, as required by Council Policy No. 48.
Following the application submission, the next step in the process is for the department
Director and the City Manager to determine whether all applicable criteria has been
satisfactorily demonstrated and achieved. With their approval, and following Council Policy
No. 48, the proposed naming will be placed on a Library Board of Trustees agenda, for their
consideration, per Carlsbad Municipal Code 2.16.060, which states the Library Board of
Trustees may make recommendations to the City Council on matters pertaining to library
facilities. This also provides an opportunity for input from the community. The Library Board of
Trustees' recommendation will be forwarded to the City Council for their final determination.
I, Suzanne Smithson, Library & Cultural Arts Director, support an honorific naming of a portion
of the Dove Library in Ann Kulchin's honor. Ann's dedication to building the Dove Library, to
staffing the Dove Library, to providing library access to southern Carlsbad, to supporting the
library's requests through her many years on City Council, support the Kulchin family request.
Ann's consistent and long-standing use of the Dove Library, advocacy for and promotion of
library services to the community, and passion for the public venue, have created an area in
southern Carlsbad for gathering, education, and entertainment.

At one point in the process, the Kulchin family suggested the whole Dove Library be renamed
for Ann. However, the library industry is trending toward naming libraries for the communities
they serve, rather than after individuals. Ann's son, Steve Kulchin, walked the Dove Library with
me last week, and we discussed three areas as options for naming:
1. The courtyard and entrance
2. The Great Hall
3. The Children's Library
These three areas are also the top three locations listed on the approved Naming Opportunities
Recommended for the Improved Spaces at the Carlsbad City Library (Resolution No. 2016-032)
for those who wish to establish naming rights through financial donations. The family supports
the nomination of the courtyard and entrance for the naming, possibly as the Kulchin
Courtyard, writing "The Courtyard is beautiful and welcoming to all Library patrons. We love
that the area is also used for special events."
I, Suzanne Smithson, Library & Cultural Arts Director, support the naming of the courtyard and
entrance and confirm that all criteria required by City Council Police No. 48 has been
demonstrated and achieved.
Next Steps
If the City Manager agrees to the proposed naming opportunity, next steps include:
• Staff will place the honorific naming proposal on a Library Board of Trustees agenda,
seeking their recommendation.
• With department Director, City Manager and Library Board of Trustees support, staff
will place the item on a future City Council agenda, for their final determination.
• Staff will work with the City Attorney to draft an agreement between the Kulchin family
and the city, with the specific terms of the naming, to be agreed upon by all parties and
legally binding ..

SUPPORT OF HONORARY NAMING OF CARLSBAD CITY LIBRARY COURTYARD
On May 25, 2022, the Library Board of Trustees received a presentation about a request from
the family of former Councilmember Ann Kulchin to establish an honorific naming of part of the
Carlsbad City Library on Dove Lane (aka Dove Library) in recognition of her years of service to
the City of Carlsbad.
In accordance with Council Policy No. 48, Naming of Parks, Facilities & Amenities in Parks, and pursuant to Carlsbad Municipal Code Section 2.16.060, the Library Board of Trustees “…may
make recommendations to the city council and advise the city council in matters pertaining
to…the advisability and desirability of facilities of the city library.” At this meeting, by proper
motion and vote, the Library Board of Trustees determined that it supports the naming of the
Carlsbad City Library courtyard for former Councilmember Ann Kulchin.
