SUBJECT: CDP 15-17 – 6125 PASEO DEL NORTE – Request for approval of a Coastal Development
Permit to add a third floor consisting of 2,000 square feet of professional office space to
an existing two-story building within the Residential Professional zone and the Mello II
Segment of the City’s Coastal Program located at 6125 Paseo Del Norte within Local
Facilities Management Zone 3. The project site is not within the appealable area of the
California Coastal Commission. The City Planner has determined that the project belongs
to a class of projects that the State Secretary for Resources has found do not have a
significant impact on the environment, and it is therefore categorically exempt from the
requirement for the preparation of environmental documents pursuant to Section 15301,
Existing Facilities, of the state CEQA Guidelines.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 7129 APPROVING Coastal
Development Permit CDP 15-17 based upon the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The 1.45 acre project site is located on the west side of Paseo Del Norte, south of
Palomar Airport Road and north of Encinas Creek as shown on the attached location map. The site was
previously known as the Orco and White Cap building that was used as a construction supply business.
Table “A” below includes the General Plan land use designations, zoning and current land uses of the
project site and surrounding properties.

Proposed Construction: The project consists of tenant improvements to an existing two-story building
that consists of modifications to the first and second floor, and the addition of a third floor on the rear
half of the building consisting of 2,000 square feet of office space, a roof deck, and improvements to the
building elevations. A lot line adjustment is proposed to move the property line to the south,
encompassing a flat, developable area from the property to the south (APN 211-040-26), which is owned
by the same owner of the parcel (APN 211-040-25) containing the existing building with proposed

modifications. The building currently exhibits a zero foot setback along the existing south property line,
which is considered legal non-conforming. The proposed lot line adjustment would bring the building into
conformance with the Residential Professional zone. The lot line adjustment would create a split General
Plan designation on the property. However, as part of the General Plan Update process currently in
process, the General Plan land use designation is proposed to be changed from Travel Recreation
(TR)/Office (O) to Office (O). Additionally, the zoning designation is proposed to be changed from
Residential Professional (RP) to Office (O). The amendments have been approved by the city and require
approval by the Coastal Commission before they can become effective. The General Plan land use
designation will be consistent with the proposed south property line eliminating the split General Plan
land use designation over the lot.
As part of the building improvements, approximately two-thirds of the building will be modified to create
a setback of 34 feet from the proposed south property line. Additional changes to the building footprint
include recesses on the north and west elevations where building entries are located. Improvements to
the rest of the site include re-striping and paving of the parking lot, and new landscaping throughout the
site. The exterior of the building will be modernized by removing the arched windows and replacing them
with larger aluminum storefront glazing. The building will also incorporate stucco, painted concrete and
wood accents.
III. ANALYSIS
The project is subject to the following regulations and requirements:
A. Travel Recreation Commercial/Office General Plan Land Use Designation;
B. Residential Professional Zone;
C. Coastal Development Regulations for the Mello II Segment of the LCP;
D. Growth Management (CMC Chapter 21.90).
The recommendation for approval of this project was developed by analyzing the project’s consistency
with the applicable city regulations and policies. The project’s compliance with each of the above
regulations is discussed in detail in the sections below.
A. General Plan Land Use Designation
The subject property has a General Plan Land Use designation of Travel Recreation Commercial (T-R) and
Office (O). The Office General Plan Designation takes precedence over the Travel Recreation Commercial
designation as the zoning designation can only implement the Office General Plan Land Use Designation,
and not the T-R designation. The addition of a third floor for warehouse and storage purposes does not
change the area or use of the project site which is consistent with the General Plan.

B. Residential Professional Zone (R-P)
The project is required to comply with all applicable regulations and development standards of the
Carlsbad Municipal Code (CMC) including the Residential Professional (R- P) zone. The proposed project

C. Conformance with the Coastal Development Regulations for the Mello II Segment of the Local
Coastal Program (CMC Chapter 21.201).
The project site is located within the Mello II Segment of the Local Coastal Program and is not in the appeal
jurisdiction. The project’s compliance with each of these programs and ordinances is discussed below:

1. Mello II Segment of the Certified Local Coastal Program and all applicable policies.
The project site is located within the Mello II Local Coastal Program Segment. As discussed below, the
project complies with all applicable LCP provisions.
The LCP Land Use Plan designates the subject site for commercial (Travel Services Commercial (T-
S)/Professional & Related (O)) development. The project’s consistency with the O Land Use designation
is analyzed in Section A above. The proposed building will not obstruct views of the coastline as seen from
public lands or the public right of way or otherwise damage the visual beauty of the coastal zone. The
project is consistent with the surrounding development of medical office and commercial buildings.
No agricultural uses currently exist on the site, and the property is not within the Coastal Agricultural
Overlay Zone that would require mitigation for conversion to urban uses. There are no sensitive coastal
resources within the property and it is not located in an area of known geologic instability or flood hazard.
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
No public opportunities for coastal shoreline access are available from the subject site and no public
access requirements are conditioned for the project since it is not located between the first public road
and the ocean. The commercially designated site is not suited for water-oriented recreation activities.
3. Coastal Resource Protection Overlay Zone
The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (CMC
Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City’s Master Drainage Plan,
Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and
Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants
and soil erosion. In addition, the site is not located in an area prone to landslides, or susceptible to
accelerated erosion, floods or liquefaction.
D. Growth Management
The proposed project is located within Local Facilities Management Zone 3 in the southwest quadrant of
the city. The impacts on public facilities created by the project and its compliance with the adopted
performance standards are summarized in Table D below.

IV. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
Section 15301 (Existing Facilities) of CEQA, Article 19 (Categorical Exemptions) exempts additions to
existing structures that will not result in an increase of more than 50 percent of the floor area of the
structure before the addition, or 2,500 square feet, whichever is less. A Notice of Exemption will be filed
by the City Planner upon project approval.
