HomeMy WebLinkAbout2022-07-20; Planning Commission; Minutes City Council Chamber 1200 Carlsbad Village Drive Carlsbad, CA 92008 July 20, 2022 Amended Minutes CALL TO ORDER: 5:00 p.m. ROLL CALL: Commissioners Kamenjarin, Luna, Meenes, Merz, Stine, and Sabellico Commissioner Lafferty absent PLEDGE OF ALLEGIANCE: Commissioner Meenes led the Pledge of Allegiance APPROVAL OF MINUTES: Motion by Commissioner Kamenjarin, seconded by Commissioner Meenes, to approve as amended the June 15, 2022, meeting minutes. Motion carried 6/0/1 (Commissioner Lafferty absent). PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA: None. PLANNING COMMISSION PUBLIC HEARING: Chair Stine directed everyone’s attention to the slide on the screen to review the procedures the Commission would be following for that evening’s public hearing. Chair Stine opened the public hearing for Item 1. 1. CDP 2021-0023 (DEV2021-0092) – MINICILLI RESIDENCE – Request for approval of a Coastal Development Permit to allow for the addition and remodel of an existing single-family residence within the Mello II Segment of the city’s Local Coastal Program located at 3926 Highland Drive within Local Facilities Management Zone 1. The project site is not within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from further environmental review pursuant to CEQA Guidelines Section 15301(e) (Existing Facilities). Assistant Community Development Director Mike Strong introduced Agenda Item 1 and stated Senior Planner Goff would make the staff presentation (on file in the Planning Division). DISCLOSURES: Commissioner Luna had no disclosures to report. Commissioners Kamenjarin, Meenes, Merz, and Stine disclosed they visited the site. Commissioner Sabellico disclosed he looked at the site on Goggle maps. Senior Planner Goff gave the staff presentation on behalf of Associate Planner Danna who was absent. PLANNING COMMISSION Minutes Planning Commission Minutes July 20, 2022 Page 2 PUBLIC COMMENTS: Chair Stine asked if there were any members of the public who wished to speak on the project, seeing none, he opened and closed public testimony. COMMISSION DISCUSSION: Commissioner Merz and Chair Stine stated they support the project. ACTION: Motion by Commissioner Meenes, Seconded by Commissioner Merz, to adopt Resolution No. 7455. Motion carried, 6/0/1 (Commissioner Lafferty absent). 2. CT 2021-0005/PUD 2021-0010/CDP 2021-0067 (DEV2021-0183) – CHINQUAPIN COAST HOMES Request for approval of a Tentative Tract Map, Planned Development Permit and Coastal Development Permit to allow the demolition of a single-family home and the development of a nine-unit, residential air-space condominium project on a 0.44-acre site located at 330 Chinquapin Avenue, within the Mello II Segment of the Local Coastal Program and within Local Facilities Management Zone 1. The project site is located within the appealable area of the California Coastal Commission. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from further environmental review pursuant to CEQA Guidelines Section 15332 (In-fill Development Projects). Assistant Community Development Director Mike Strong introduced Agenda Item 2 and stated Associate Planner Dan would make the staff presentation (on file in the Planning Division). Chair Stine recused himself from the dais due to a conflict of interest regarding the item. ACTION: Motion by Commissioner Meenes, Seconded by Commissioner Sabellico, to nominate Commissioner Merz chair in the absence of Chair Stine. Motion carried, 5/0/2 (Commissioner Lafferty absent and Chair Stine recused). Assistant City Attorney Kemp asked the applicant if he would like to proceed with five of the seven commissioners. Applicant stated he would like to proceed. DISCLOSURES: Commissioner Luna disclosed he drove by the site. Commissioners Kamenjarin, Merz, and Meenes disclosed they visited the site. Commissioner Sabellico disclosed he looked at the site on Goggle maps. Planning Commission Minutes July 20, 2022 Page 3 PUBLIC COMMENTS: Reg Whatley, resident asked staff for an environmental impact study to be done that includes three endangered species that he has seen on this property. He also stated his neighbors have phone called and emailed staff and did not receive a response. Associate Dan responded that staff did not identify any sort of particular species that are of concern or are sensitive to the state or national wildlife agencies and determined that it falls within an exemption of an in-fill development project. Mr. Dan stated the CEQA determination exemption was filed on June 14, 2022 and was publicly noticed, on the city’s website and staff never received any comments. COMMISSIONER DISCUSSION: None. ACTION: Motion by Commissioner Sabillico, Seconded by Commissioner Meenes, to adopt Resolution No. 7456. Motion carried, 5/0/1 (Commissioner Lafferty and Chair Stine absent). 3. CUP2020-0003/CDP 2020-0021/(PUB 2019-0006) – Recycled Water Phase III – D-4 Reservoir - Request for approval of findings that the proposed project is consistent with the previous Mitigated Negative Declaration and Addendum to the Mitigated Negative Declaration; and approval of Conditional Use Permit and Coastal Development Permit amendments to construct a recycled water tank at an existing city water facility at 6580 Black Rail Road. The project is within the Mello II segments of the Local Coastal Program and within Local Facilities Management Zone 20. This project is not located within the appealable area of the California Coastal Commission. Chair Stine resumed his duties as chair. COMMISSIONER DISCUSSION: Chair Stine asked staff to explain the enhancement of the project. It is his understanding the approval of the water pump stations for recycled water was back in 2003. Planning Commission Minutes July 20, 2022 Page4 City Planner Lardy responded this site has had a lot of activity over the last 20 years to expand the system and the 2003 action was part of the larger effort, as well as 2012 and 2018 actions to expand the system which included those linear facilities. Utilities Engineering Manager Padilla responded this is the third and final phase of improvements and if there are any future improvements to be constructed it would require to be studied under new environmental documents. Chair Stine asked if any public outreach had been done to the residents in the surrounding area. Mr. Padilla stated yes staff posted hearing notice and issued a public report outreach report. Also notices were sent to all surrounding property owners prior to this hearing. Staff received a couple of inquiries on -the construction, timing and staging, but no opposition to this project. ACTION: Motion by Commissioner Meenes, Seconded by Commissioner Kamenjarin, to adopt Resolution No. 7457. Motion carried, 6/0/1 (Commissioner Lafferty absent). DEPARTMENT REPORT: None. PLANNING COMMISSION REPORTS/COMMENTS: Commissioner Kamenjarin attended the Objective Design Review Board workshop on June 29, 2022 and received a copy of the handout of the presentation and would like it forwarded on to all commissioners. It is currently on the city website as well. Chair Stine reported Commissioner Sabellico and himself are representatives of the Growth Management Citizens Committee. Chair Stine stated he attended the meeting held on June 23, 2022. The committee is in an informational phase giving us background on various public services and how they are funded. The meeting on June 23 topics were on school performance issues, drainage issues, and wastewater sewer collection issues. The meeting in September will be about the options and recommendations moving forward. CITY PLANNER REPORTS: · The next Planning Commission meeting will be held on August 17, 2022. CITY ATTORNEY REPORTS: None. ADJOURNMENT: Chair Stine adjourned the duly noticed meeting at 5:56 p.m.
