Adopt a resolution authorizing execution and submittal of a Proof of Designation Form 184
letter to the California Department of Resources Recycling and Recovery to designate Allied
Waste Systems Inc., dba Republic Services of San Diego, as an approved collector of electronic
waste for the City of Carlsbad.
Executive Summary
The City Council is being asked to designate Allied Waste Systems Inc., dba Republic Services of
San Diego, the company that recently took over waste removal services in Carlsbad, as an
approved collector of electronic waste for the City of Carlsbad.
Under state law, this designation must be made before Republic can collect e-waste for the city.
Under City Charter section 402, only the City Council can approve solid waste hauling franchises
that operate on city streets, highways or other rights of way. A City Council resolution (Exhibit
1) is therefore required to authorize the mayor to sign the proof of designation form that will
be submitted to California’s Department of Resources Recycling and Recovery, known as
CalRecycle.
Discussion
State law requires local jurisdictions like the City of Carlsbad to have programs to capture
household hazardous waste to prevent them from being disposed in landfills, including
electronic waste, or e-waste. (California Code of Regulations, Title 14, Division 7, Chapter 9,
Article 6.3) If a private waste hauler provides e-waste services on a city’s behalf, the city must
submit a proof of designation form to CalRecycle that describes and authorizes the waste
hauler’s activities.
Republic began providing waste collection services in Carlsbad as of July 1, 2022, and will be the
new designated e-waste collector. Under the terms of its agreement with the city, approved by

the City Council on April 6, 2021, with Resolution No. 2021-075, Republic must provide on-call
e-waste collection services to all single-family and multi-family customers in the city. Republic
will collect the e-waste and contract with E-Recycling of California for proper disposal or
recycling.
The City of Carlsbad does not have city-operated drop-off or collection facilities for e-waste.
Designating Republic as an e-waste collector within the city will allow city residents continued
e-waste curbside and drop-off services at the Palomar Transfer Station. Residents will only need
to show proof of residency for their material to be collected at the Republic drop-off location at
the Palomar Transfer Station. They will only have to call to schedule a curbside pickup.
The franchise agreement requires Republic to take on these e-waste collection services, which
were previously provided by Waste Management.
CalRecycle allows the option of submitting a new proof of designation form that will be in effect
for the duration of the franchise agreement. Staff recommend submitting the new form to align
with the franchise agreement term, which expires on June 30, 2032.
Fiscal Analysis
This item has no fiscal impact.
Next Steps
Republic will start collection of e-waste within the city 30 days after the city submits the
authorized form to CalRecycle.
Environmental Evaluation
The proposed action does not qualify as a project under the California Environmental Quality
Act under Guidelines Section 15378. It does not result in a direct or any reasonably foreseeable
indirect physical change in the environment.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and was available for public
viewing and review at least 72 hours prior to scheduled meeting date.

WHEREAS, California Code of Regulations, or CCR, Title 14, Division 7, Chapter 9, Article 6.3
requires every local jurisdiction to have programs to capture household hazardous waste to prevent
disposal to the landfills, including electronic waste, or e-waste; and
WHEREAS, the City of Carlsbad does not have city-operated drop-off or collection facilities for
e-waste, and designating Allied Waste Systems, Inc., dba Republic Services of San Diego, or Republic,
as an e-waste collector within the city will allow city residents continued e-waste curbside and drop

WHEREAS, if a private waste hauler provides e-waste services on behalf of a local government,
the local government must submit a Proof of Designation, or POD, Form 184, letter to the California
Department of Resources Recycling and Recovery, or CalRecycle, describing and authorizing the
hauler's activities; and
WHEREAS, under CCR, Title 14, Section 18660.49(b)(S), the POD must be signed by "a
representative of the Local Government that is duly authorized and empowered to execute agreements
or contracts related to waste management on behalf of the Local Governm.ent;" and
WHEREAS, the City Council approves solid waste hauling franchises under the City Charter
section 402; and
WHEREAS, on April 6, 2021, the City Council adopted Resolution No. 2021-075, approving the
current franchise hauling agreement with Republic; and
WHEREAS, the franchise hauling agreement, which became effective on July 1, 2022, requires
Republic to provide e-waste services within the City of Carlsbad; and
WHEREAS, CalRecycle allows the option of submitting a new POD for the term of a franchise
hauling agreement; and
WHEREAS, staff recommend submitting a new POD for Republic for the term of the current
franchise agreement, which expires on June 30, 2032.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That the Mayor is authorized and directed to execute a Proof of Designation letter, Form
184, attached hereto as Attachment A, designating Allied Waste Systems, Inc., dba
Republic Services of San Diego, as an approved collector of electronic waste on behalf
of the City of Carlsbad through June 30, 2032.
3.That the Deputy City Manager of the Public Works Branch, or designee, is authorized
and directed to submit the Proof of Designation letter designating Allied Waste Systems,
Inc., dba Republic Services of San Diego, as a city-approved collector of electronic waste,
to the California Department of Resources Recycling and Recovery.
