Recommended Action
Adopt a resolution accepting bids and awarding a contract to Burtech Pipeline Incorporated, a
California corporation, for construction of the Downtown and Terramar Water Main
Replacement, Capital Improvement Program Project No. 3904-C, in an amount not to exceed
$2,475,000.
Executive Summary
This project will replace aging asbestos concrete pipe with PVC pipe in six noncontiguous
locations in the city.
The Carlsbad Municipal Water District (CMWD) Board of Directors approved the plans and
specifications for the project and authorized staff to advertise the project for construction bids
with the adoption of Resolution No. 1677 on June 21, 2022. Staff offered the project up for bids
and, on July 21, 2022, received five bids. The lowest responsive and responsible bidder was
Burtech Pipeline Incorporated, a California corporation, with a bid of $2,475,000.
Staff recommend the CMWD Board of Directors award the construction contract to Burtech in
an amount not to exceed $2,475,000.
Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(I)(6) require CMWD board approval
for all formally bid contracts when the value exceeds $200,000.
Discussion
The project will construct approximately 4,400 linear feet of 8-inch diameter PVC water pipeline
to replace aging asbestos concrete pipelines serving five residential areas and one business area
within the City of Carlsbad.

The pipe diameter will be increased to 8 inches to meet current firefighting water flow
requirements and CMWD’s engineering standards. In four of the six locations, the new pipelines
will be installed generally parallel to the existing pipelines. This will reduce the number and
duration of pipeline shutdowns in these residential areas during construction.
After the new lines are operational and water service to the effected properties is reinstated,
the existing pipelines will be abandoned in place, in keeping with CMWD’s engineering
standards.
The two locations where pipelines will not be constructed in parallel alignments are:
• State Street alley, between Grand Avenue and Carlsbad Village Drive, where the new
pipe needs to be replaced in the current alignment due to existing utility constraints.
A temporary aboveground pipeline will be installed before construction begins to serve
State Street alley water customers while the work is underway. While this temporary
pipeline will provide the businesses with water during construction operations, short
duration service interruptions will occur when the businesses are connected to the
temporary system and then again when they are connected the new water main.
• Tierra del Oro, where the existing water main is looped along the edge of the street and
private improvements have encroached over the water main. The new pipeline
alignment will be located in the street, conform to CMWD engineering standards and
facilitate future maintenance or repair. The existing water line will remain in service
during construction to minimize residential service disruptions. After services are
connected and the new line is operational, the existing looped pipe will then be
abandoned in place, in keeping with CMWD’s engineering standards.

Phased construction is planned to minimize disruption of water service to the residents and
businesses served. CMWD staff are working with the Communication & Engagement
Department to reach out in advance of the project to meet with, notify and coordinate with the
businesses and residents that will be temporarily impacted during these facility improvements.
Parking and delivery access for the State Street alley businesses will be addressed during pre-
construction meetings with the contractors, based on input received during outreach meetings.
Appropriate city and CMWD staff with previous experience working in these areas coordinated
during the project’s design. Affected customers will be provided with updates on the schedule
of work. Residents will also receive multiple notifications before, during and after construction.
Residential street parking will be temporarily impacted during these improvements to the
residents’ water lines. The contract documents specify that the contractor must restore access
to street parking after completing work each day.
Additionally, the work will be scheduled to respect and incorporate the schedules of various
city community events planned in these areas, such as the annual Carlsbad Marathon and the
weekly Farmer’s Market. Staff have incorporated such known major city events into the
contract specifications, indicating restrictions on work schedules prior to and during these
events.
CMWD coordinated with the Transportation Department on its planned repaving of Tierra Del
Oro and Shore Drive. Paving projects on these streets will now occur after the new water lines
are installed. Paving for all other segments will be completed in accordance with city
engineering standards for trench repaving.
Options
Staff provide the following options for the CMWD board’s consideration:
1. Accept bids and award a contract to Burtech for construction of the Downtown and
Terramar Water Main Replacement, Capital Improvement Program Project No. 3904-C,
in an amount not to exceed $2,475,000

Staff recommend Option 1 for the CMWD board’s approval.
Fiscal Analysis
Sufficient funding has been budgeted in the Capital Improvement Program budget for this
water main replacement project.
A summary of available funds is shown in the table below:
Carlsbad Municipal Code sections 3.28.040(C)(5) and 3.28.090(B) authorize the water district’s
Executive Manager to approve change orders up to an amount equal to the contingency set at
the time of contract award. That amount for this project is $371,250.
The amount of the construction management and inspection services increased from the
$360,000 amount that was presented to the CMWD Board on June 21, 2022, to $512,000, as
shown in the table above, because of the extended schedule for phasing the construction for
the multiple sites, accommodating special events and monitoring for possible cultural and
archaeological resources during construction.

Next Steps
Upon the CMWD board’s acceptance of the bids and award of the construction contract to
Burtech, staff will issue a purchase order, schedule a pre-construction meeting with the
contractor and issue a notice to proceed for construction of the project, which is expected to
begin in November 2022.
Upon successful completion of the project, a notice of completion to release the bonds issued
for the project will be recorded.
Construction is expected to take 16 months, with limited work during the summer months.
Staff anticipate all construction will be complete will be in early spring 2024.
Environmental Evaluation
The project classifies as a replacement or reconstruction of existing utility and/or facilities
involving negligible or no expansion of capacity, and the City Planner has determined it is
exempt from environmental review according to California Environmental Quality Act
Guidelines Section 15302 (c). Staff filed a notice of exemption with the San Diego County Clerk
in compliance with Section 21152 (b) of the California Public Resources Code. No exception to
the exemption as set forth in CEQA Guidelines Section 15300.2 applies.
Public Notification
This item was noticed in accordance with the Ralph M. Brown Act and it was available for public
viewing and review at least 72 hours prior to the scheduled meeting date.
Before construction begins, the public will be notified of the construction activities through
signage, email messages the city website and other city communication channels. The
construction contractor will also be required to notify the public of construction activities via
changeable message signs, door hangers, letters to residents and/or “NO PARKING” signs, as
applicable.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
ACCEPTING BIDS AND AWARDING A CONTRACT TO BURTECH PIPELINE
INCORPORATED, A CALIFORNIA CORPORATION, FOR CONSTRUCTION OF
THE DOWNTOWN AND TERRAMAR WATER MAIN REPLACEMENT PROJECT
WHEREAS, the Carlsbad Municipal Water District, or CMWD, Board of Directors of the City of
Carlsbad, California has determined that it is necessary, desirable and in the public interest to replace
water distribution pipelines for the Downtown and Terramar Water Main Replacement, Capital
Improvement Program, or CIP, Project No. 3904-C, or Project; and
WHEREAS, on June 21, 2022, the CMWD Board adopted Resolution No. 1677, approving plans
and specifications, and authorizing advertisement for bids for construction of the Project; and
WHEREAS, on July 21, 2022, staff received five bids for construction of the Project; and
WHEREAS, Burtech Pipeline Incorporated, a California corporation, submitted the lowest
responsive and responsible bid, in an amount of $2,475,000; and
WHEREAS, sufficient funds exist in the Miscellaneous Pipeline Replacement Program fund, CIP
Project No. 3904, for project costs in the current fiscal year; and
WHEREAS, Carlsbad Municipal Code Sections 3.28.040(C)(S) and 3.28.090(8) authorize the
Executive Manager or designee to approve change orders in an amount equal to the contingency set
at the time of contract award, which is $371,250 for the Project; and
WHEREAS, the City Planner has determined that the Project is categorically exempt from the
California Environmental Quality Act, or CEOA, pursuant to CEOA Guidelines Section 15302(c), as a
replacement or reconstruction of existing utility and/or facilities, and that no exception to the
exemption as set forth in CEOA Guidelines section 15300.2 applies.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of Directors
of the City of Carlsbad, California, as follows:
1.That the above recitations are true and correct.
2.That the low bid of $2,475,000 submitted by Burtech Pipeline Incorporated, a California
corporation, for construction of the Downtown and Terramar Water Main Replacement
Project, CIP Project No. 3904-C, is accepted and the CMWD Board President is hereby
authorized to execute a contract for the Project.
3.That the Executive Manager or designee is hereby authorized to approve construction
change orders up to $371,250.

4.That the award of this contract is contingent upon Burtech Pipeline Incorporated
executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 days of adoption of this Resolution. The
Executive Manager may grant reasonable extensions of time to execute the contract
and assemble the required bonds and insurance policies.
