AGENDA OF: August 20,1997 Application complete date: June 9, 1997 Project Planner: Chris DeCerbo Project Engineer: Clyde Wickham SUBJECT: CDF 96-10 - NORTH BATIOUITOS SEWAGE FORCE MAIN- Request for approval of a Mitigated Negative Declaration and Coastal Development Permit to replace the existing North Batiquitos Sewage Force Main and a water main on property which is located north of Batiquitos Lagoon and east of Interstate 5 in Local Facilities Management Zone 19. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4148, APPROVING the Mitigated Negative Declaration issued by the Planning Director, and ADOPT Planning Commission Resolution No. 4149, APPROVING Coastal Development Permit CDP 96-10, based on the findings and subject to the conditions contained therein. II. INTRODUCTION This proposal A Coastal Development Permit is required because the project qualifies as development in the Coastal Zone. The project conforms with all applicable regulations and staff has no issues with the proposal. III. PROJECT DESCRIPTION AND BACKGROUND The Carlsbad Municipal Water District (CMWD) is requesting approval of a Coastal Development Permit for the replacement of the existing 14 inch diameter North Batiquitos Sewage Force Main and an 8 - 10 inch water main which are located on the north side of Batiquitos Lagoon between the North Batiquitos Sewage Pump Station and Interstate 5. Both of these pipelines have deteriorated and need to be replaced. The existing sewage force main alignment, as shown on Attachment "A", extends northward from the Batiquitos Life Station, which is located within the wetland buffer along the north shore of Batiquitos Lagoon, to Gabbiano Lane and westward through an existing 40 foot wide disturbed public utility easement to an existing upstream gravity sewer. As shown on Exhibits "C"-"D", the proposed new alignment for the 14 inch North Batiquitos Sewage Force Main will extend from the North Batiquitos Sewage Pump Station across the Azure Cove development (CT 89-19) in a westerly - northwesterly direction along the south and west sides of the proposed Batiquitos Lagoon North Shore Trail, and then westerly up a steep slope within an existing Carlsbad Municipal Water District (CMWD) utility easement. Extending from the Sewage Pump Station and along the North Shore Trail, the Sewage Force Main would be located within CDP 96-10 - NORTH BATIQUITOS SEWAGE FORCE MAIN AUGUST 20,1997 PAGE 2 : the Batiquitos Lagoon wetlands buffer, however, would not encroach into the Batiquitos Lagoon wetlands. The vegetation which is located within the steep slope area of the proposed Sewage Force Main easement (the existing CMWD utility easement) is comprised of disturbed goldenbrush scrub. Coastal Sage Scrub (CSS) vegetation exists to the south and adjacent to this easement. This project, including the water main discussed below, will not encroach into this CSS vegetation. The proposed water main will be replaced in its existing alignment. It will be 12 inches in diameter and will extend westward from Piovana Court within the Azure Cove development to the existing CMWD utility easement discussed above. Both pipelines will be located within existing and proposed public utility easements. The pipelines will be constructed subterranean, backfilled to pre-construction natural grade and landscaped consistent with the approved landscape plan for the Azure Cove project. The replacement sewer force main and water line would be located upon property which is designated Open Space and Residential Medium (4-8 du/acre) and zoned Open Space and R-l- 7500 Q (soon to be zoned Planned Community (PC), upon California Coastal Commission approval of LCPA 96-13 to annex Azure Cove into the Aviara Master Plan). This proposal is subject to the following regulations: A. General Plan and B. Local Coastal Program. IV. ANALYSIS The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of these regulations/policies utilizing both text and tables. A. General Plan Pursuant to the Growth Management provisions of the Carlsbad General Plan and Zoning Ordinance (Chapter 21.90), public utilities are an anticipated use which are allowed within all General Plan designations and zones. The proposal to replace the North Batiquitos Sewage Force Main and a water main is consistent with the applicable goals and policies of the General Plan . Particularly relevant to the proposal is the Land Use Element. Table 1 below indicates how the project complies with the Land Use Element of the General Plan. The replacement of the deteriorated sewage force main and water main are necessary to ensure that ongoing sewer and water service to existing and proposed residential and non- residential development is adequate. Yes Sewer trunk line capacity to meet demand as determined by the appropriate sewer district. The CMWD has determined that the North Batiquitos Sewage Force Main must be replaced to meet existing and future demand anticipated by the Carlsbad General Plan. Yes Water line capacity to meet demand as determined by the appropriate water district. The CMWD has determined that the existing 8-10" water main be replaced with a 12" water main to meet existing and future demand anticipated by the Carlsbad General Plan. Yes B. Local Coastal Program The proposed sewage force main and water main is located within the Mello II and East Batiquitos Lagoon/Hunt Properties segments of the Local Coastal Program, therefore, this project is subject to the Implementing Ordinances and Land Use Plans for those segments. The City's Zoning Ordinance (Title 21) is the implementing ordinance for those portions of the Mello II segment upon which this project is located. Pursuant to the Growth Management provisions of the City's Zoning Ordinance (Chapter 21.90), public utilities are an anticipated and permitted use within all zones (including the Open Space zone). Upon Coastal Commission approval of LCPA 96-13 (which will annex the Azure Cove project into the Aviara Master Plan), the implementing ordinance for those portions of the Mello II segment upon which this project is located is the Aviara Master Plan. This project would be consistent with the Aviara Master Plan, as discussed below. The Aviara Master Plan is the implementing ordinance for those portions of the East Batiquitos Lagoon/Hunt Properties segment (and Mello II segment when LCPA 96-13 is approved by the California Coastal Commission) upon which this project is located. One of the goals of the Aviara Master Plan is to ensure that public facilities and services are available to serve the planned development of the Aviara project prior to or concurrent with demand. The public CDP 96-10 - NORTH BATIQUITOS SEWAGE FORCE MAIN AUGUST 20, 1997 PAGE 4 facility requirements for the Aviara Master Plan are fully addressed within the Zone 19 Local Facilities Management Plan (LFMP). In that the proposed replacement North Batiquitos Sewage Force Main and water main are identified as required public facilities within the Zone 19 LFMP, this project is consistent with the Aviara Master Plan. The policies of the Mello II and East Batiquitos Lagoon/Hunt Properties Land Use Plans (LUP) which apply to this project deal with: 1) permitted development in proximity to Batiquitos Lagoon and within wetland buffer zones; 2) grading and erosion control and the protection of 25% and greater gradient slopes; and, 3) scenic resources. This project complies with the above noted LUP policies as discussed below. 1. This project will not encroach into the Batiquitos Lagoon wetlands. The sewage force main line will however be located within the 100 foot wide wetland buffer adjacent to the Batiquitos Lagoon North Shore Trail. Based upon the fact that incidental public facilities are permitted within the Batiquitos Lagoon wetlands (Batiquitos Lagoon Special Treatment Overlay) and the California Coastal Commission has historically allowed the development of other similar utilities within the Batiquitos Lagoon wetland buffer (including desiltation basins and drainage pipes), it is concluded that this subterranean sewage force main is a permitted use within the wetlands buffer. Upon completion of pipeline construction the pipeline corridors shall be landscaped with native vegetation consistent with the approved Azure Cove project landscape plans. 2. The western extent of the proposed pipelines will be within an existing CMWD easement which is located on a slope which has a gradient of greater than 25%. The vegetation within this easement is comprised of non-sensitive disturbed goldenbrush scrub. The easement area is however surrounded by sensitive Coastal Sage Scrub habitat. In order to mitigate potential impacts to this habitat, the habitat area will be staked and flagged in the field by a qualified biologist prior to project construction. In that the development of the pipelines upon this steep slope is essential, will not result in damage or alteration to major wildlife habitat or native vegetation areas, and will be revegetated upon completion of construction to mitigate soil erosion this project is consistent with this Coastal policy. 3. Because the proposed pipelines will be constructed subterranean and the pipeline construction corridor will be subsequently landscaped, no visual impact to the Batiquitos Lagoon scenic resource will occur. Considering the above, the North Batiquitos Lagoon Force Main and water main project is consistent with the Carlsbad Local Coastal Program. V. ENVIRONMENTAL REVIEW This project entails the replacement of a sewage force main and replacement and increase in capacity of a water line in order to accommodated growth anticipated by the General Plan. The Planning Director has determined that this project could have a significant effect on the environment, however, there will not be a significant effect in this case because the mitigation CDP 96-10 - NORTH BATIQUITOS SEWAGE FORCE MAIN AUGUST 20,1997 PAGES measures described in the attached initial study have been added as conditions of approval to this project. This decision was based on findings of the Environmental Impact Assessment Part II, a Biological Survey and a site survey by staff. A Mitigated Negative Declaration was issued by the Planning Director on November 19, 1996.
