SUBJECT: GPP 97-02 - SAMBI SEASIDE HEIGHTS - Request for a Coastal
Development Permit to allow for: (1) the construction of 93 single family homes
on previously subdivided lots in the R-D-M-Q zone and (2) minor grading
associated with the expansion of lot pad areas on property located within the Zone
20 Specific Plan and Local Facilities Management Plan along the west side of
Aviara Parkway between Camino De Las Ondas and Palomar Airport Road.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4082
APPROVING CDP 97-02 based on the findings and subject to the conditions contained therein.
II. INTRODUCTION
This project is requesting approval of a Coastal Development Permit for architecture and
building placement of 93 single family homes on previously approved standard single family lots
in the R-D-M-Q zone by the Sambi Subdivision Map (CT 92-02(A)), and minor grading
associated with the expansion of some of the pad areas of these lots. All required permit
findings can be made to support this request.
III. PROJECT DESCRIPTION AND BACKGROUND
Kaufman and Broad is requesting approval of a Coastal Development Permit to allow the
construction of 93 single family homes on standard single family lots which were previously
subdivided as part of the Sambi Seaside Heights Subdivision Map (CT 92-02(A)) and minor
grading associated with the expansion of pad areas for some of the residential lots. The project
site is located along the west side of Aviara Parkway between Camino De Las Ondas and
Palomar Airport Road.
The original Sambi Seaside Heights project approvals also included a Site Development Plan
(SDP 92-06(A)) which approved project layout and grading, a Hillside Development Permit
(HDP 92-03 (A)) for hillside grading and a Coastal Development Permit for development within
the Mello II segment of Carlsbad's Local Coastal Program. The project site is currently graded
consistent with these previous project approvals. Architecture and building placement for this
single family project were however not proposed or approved through the original project
applications. Accordingly, the project was conditioned to require Planning Director approval of
the architecture and placement of the single family homes on the approved lots consistent with

the standards of the R-l Zone, the Zone 20 Specific Plan and the architectural
standards/guidelines of the Hillside Ordinance.
As shown on attachments "A" - "N", the project includes three different product types (each with
3 different front elevations) which range from 2,433 square feet to 3,908 square feet in area and
include three car garages. All of the units are two-stories (between 28 feet and 28.5 feet tall).
Architectural features include recessed, arched and paned windows, hip and gabled roofs,
earthtone colored stucco walls with wood and stone trim and flat and barrel tile roofs.
Concurrent with this Coastal Development Permit application request, a Site Development Plan
Amendment (SDP 92-06(B)) application has been processed for approval of project architecture
and building placement by the Planning Director. A Hillside Development Permit Amendment
(HDP 92-03 (B)) application has also been processed for approval through the Planning Director
for minor project encroachment (construction of retaining walls ranging from 3-5.5 feet in
height) into existing manufactured slopes located in the rear and side yards of around 50% of the
project residential lots for the purpose of increasing the rear and side yard pad areas.
This Coastal Development Permit application (CDP 97-02) is required for the placement and
architecture of the proposed units on the single family lots and for the minor lot grading
associated with the expansion of the lot pad areas for the residential units.
The proposed project is subject to the Mello II Local Coastal Program.
IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project's
consistency with the Mello II Local Coastal Program. The following analysis discusses project
compliance with the Mello II Local Coastal Program.
Mello II Segment of Carlsbad Local Coastal Program
A Coastal Development Permit for the Sambi Seaside Heights project, which included the
subdivision of single family lots, infrastructure location and grading has been issued by the
California Coastal Commission based on findings of project consistency with the Mello II
Coastal Resource Protection Overlay Zone and Coastal Agricultural Overlay Zone policies. The
project has been graded in compliance with the approved Coastal Development Permit. The
approved project was conditioned to mitigate impacts to sensitive coastal resources including
riparian and coastal sage scrub habitat. The required project resource mitigation, including
receipt of various Federal and State permits and the purchase of mitigation credits from the
Carlsbad Highlands Mitigation Bank have already been implemented. The Sambi project
developer has also paid the required "Agricultural Conversion Mitigation Fee" to the California
Coastal Conservancy.
This proposed project must receive approval of a second Coastal Development Permit for the
placement and architecture of the proposed units to ensure compliance with the R-l-7500 zone
and for the minor lot grading associated with the expansion of rear yard pad areas on some of the

residential lots. As shown on the following table, the project complies with all applicable R-l
development standards.

Additionally, the proposed minor lot grading (into existing rear and side yard manufactured
slopes) and retaining wall construction for the purpose of increasing the rear and side yard pad
areas is consistent with the policies of the Mello II Local Coastal Program in that the slopes are
manufactured and therefore not subject to the steep slope preservation policies of the Mello II
Coastal Program, no sensitive coastal resources will be impacted by the proposed minor grading,
and adequate drainage and erosion control measures have been incorporated into the project.
V.ENVIRONMENTAL REVIEW
The Planning Director has determined that the proposed residential project is pursuant to and in
conformance with Specific Plan 203 for which an Environmental Impact Report was prepared,
therefore, the project is exempt under Section 15182 of the California Environmental Quality
Act.
