AGENDA OF: December 3,1997 A REPORT TO THE PLANNING COMMISSION Application complete date: October 22, 1997 Project Planner: Eric Munoz Project Engineer: Frank Jimeno Single Family Coastal Development Permit SUBJECT: CDP 97-32 - TERRAMAR BEACH HOUSE - Request for approval of a Coastal Development Permit to allow for the construction of a single family residence within the City’s Coastal Zone located on a vacant, blufftop lot on the west side of Carlsbad Boulevard, north of Cerezo Drive on Assessor’s Parcel No. 210-120-31 within Local Facilities Management Zone 2. The project site is located in the Appeal area of the Coastal Zone and may be subject to an appeal by the Coastal Commission. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 4208 APPROVING Coastal Development Permit CDP 97-32 based upon the findings and subject to the conditions contained therein. 11. INTRODUCTION Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single family home within the City’s Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with LCP policies and implementation. There are no unresolved issues. The staff recommended approval with conditions is supported by the analysis as follows. 111. PROJECT DESCRIPTION AND BACKGROUND Proiect Sitelsetting: Idill lot located on a vacant blufftop site as shown on the attached Location Map. The lot area is . 53 acres (23,092 square feet). ProDosed Residential Construction: New residential structure totaling 3,767 square feet. Pronosed Grading: Estimated grading quantities include 760 cubic yards of fill with 760 cubic yards of import. A grading permit will be required for this project. Consistent with section 21.203.040(4)(e), no grading will be allowed between October 1 ,and April 1. This is reflected in condition of approval #4 of the attached Planning Commission Resolution. h CDP 97-32 - TERRAMAR LsEACH HOUSE December 3, 1997 Page 2 IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 4208, and after all applicable appeal periods have ended. Along the frontage of the proposed development, a vertical realignment will occur resulting in the need to modify the development’s access drive. The developer has requested that the modifications, as shown in the site plan, be included in the lien contract agreement for the future improvements of Carlsbad Boulevard as covered by Condition #lo. Review of Required Coastal Findings 1. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello I1 Local Coastal Program Segment. The project proposes the construction of a single family residence in an area designated for single family development. The LCP Land Use Plan designates the subject site for Residential-Low Medium (RLM) densityhingle family development. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. The bluff top section adjacent to the site has historically provided coastal access for beach users and area wave riders. The property to the south of the subject property received approvals (SUP 96-07/HDP 97-03/CDP 96-05) to construct a beach access stairway down the bluff. The stairway received building permit approvals and construction has commenced as of this date. The completion of this stairway will adequately provide beach access so no additional public access dedications will be required of this project’s subject site and the site to the south. 0 CDP 97-32 - TERRAMAR L~EACH HOUSE December 3, 1997 Page 3 3. Coastal Overlay Zones. The subject site contains steep slopes over 25% and/or native vegetation and is subject to the Coastal Resource Protection Overlay Zone. Due to the presence of a slope steeper than 25% inclination (coastal bluff), additional submittals were required in the form of geotechnical and drainage studies designed to protect the bluff as well as the proposed structure. Staff relied on the geotechnical reports plus a peer review and Engineering Department review of the subject reports to determine that the proposed 25 foot blufftop setback is acceptable. Coastal guidelines require that structural stability for at least 75 years be maintained with the development of a blufftop residence. Finally, the Engineering Department is supporting the proposed drainage design whereby all of the water would drain down the existing bluff face via a drain pipe at the northwest corner of the property. This design was supported by the Engineering Department after exhausting the feasibility of pumping drainage to the street (Carlsbad Boulevard). No blufftop modifications, grading, structures or improvements are allowed nor proposed. V. ENVIRONMENTAL REVIEW This project is exempt fiom CEQA per the exemptions listed below: (1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land including grading on land with a slope of less than 10% from environmental review. (2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single family residences in urbanized areas from environmental review.
