SUBJECT: CDP 97-47 - SAUNDERS RESIDENCE - Request for approval of a Coastal
Development Permit to allow for the construction of a single family residence
within the City’s Coastal Zone located at 4240 Skyline Road, between Tamarack
Avenue and Hillside Drive, in Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4231
APPROVING Coastal Development Permit CDP 97-47 based upon the findings and subject to
the conditions contained therein.
11. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single
family home within the City’s Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with LCP
policies and implementation. There are no unresolved issues. Staffs recommendation for
approval with conditions is supported by the following analysis.
111. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located at 4240 Skyline Road as shown on the attached Location
Map. The area of the vacant lot is 0.79 acres (34,506 square feet).
Proposed Residential Construction: New residential structure totaling 433 1 square feet with
associated site grading and landscaping.
Proposed GradindStreet Improvements: Estimated grading quantities are over 100 cubic yards
and a grading permit will be required for this project. The project will also be required to
provide street improvements along its frontage along Skyline Road.
IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 423 1.

The project proposes the construction of a single family residence in an area designated
for single family development. The LCP Land Use Plan designates the subject site for
low medium density development.
2. Inapplicable Coastal Overlav Zones
The project site is not located in the Coastal Agriculture Overlay Zone, according to Map
X of the Land Use Plan, certified September, 1980, and, therefore, is not subject to the
provisions of the Coastal Agriculture Overlay Zone (Chapter 21.202 of the Zoning
Ordinance).
The project site is not located between the sea and the first public road parallel to the sea
and, therefore, is not subject to the provisions of the Coastal Shoreline Development
Overlay Zone (Chapter 2 1.204 of the Zoning Ordinance).
The project is not located within the Mello I LCP Segment and is, therefore, not subject
to the provisions of that segments Coastal Resource Overlay Zone as described in Chapter
21.205 of the Zoning Ordinance.

3. Coastal Resource Protection Overlay Zone.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location and the absence of slopes steeper than 25% inclination and/or native
vegetation, additional submittals, standards or requirements do not apply.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
(1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land
including grading on land with a slope of less than 10% from environmental
review.
(2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single
family residences in urbanized areas from environmental review.
Notices of Exemption will be filed by the Planning Director upon project approval.
