SUBJECT: CDP 97-50 - BEACH ACCESS RECONSTRUCTION - Request for approval
of a Coastal Development Permit to allow for the reconstruction of two existing
beach access locations within the City’s Coastal Zone, within the Coastal
Commission Appeal area, located at the northern terminus of Ocean Street and at
Cherry Avenue within Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4211
APPROVING Coastal Development Permit CDP 97-50 based upon the findings and subject to
the conditions contained therein.
11. INTRODUCTION
Pursuant to Section 21.201.070(A)(l)(d) of the Carlsbad Municipal Code, the reconstruction of
two beach access stairways within the City’s Coastal Zone requires the processing and approval
of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency
with LCP policies and implementation. There are no unresolved issues. The staff recommended
approval with conditions is supported by the analysis as follows.
111. PROJECT DESCRIPTION AND BACKGROUND
As described above, two existing beach access stairways will be reconstructed to maximize the
public health, safety and welfare involved with accessing the beach in these two areas. The
project will be carried by the City of Carlsbad as a capital improvements project. The timefi-ame
for completion of this project is late spring so that the accessways will be fully rehabilitated by
the summer season of 1998.
IV. ANALYSIS
This project is a maintenance and repair effort for the long term upkeep of the two stairways
involved. The City’s coastal ordinance typically would exempt this project from the
requirements of a coastal development permit. However, section 2 1.201.070 (l)(d) requires a
coastal development permit if the presence of mechanized construction equipment (temporary or
permanent) is proposed for any sandy area, bluff, or within 20 feet of coastal waters or streams.

This project may involve the use of mechanized equipment on the bluff within the existing width
of the stairways located at the Ocean Street location. The Cherry Avenue location may use
mechanized equipment but not on the bluff. The project engineer has provided a memo
(attached) which explains the potential use of mechanized equipment on the bluff to perform the
reconstruction work. Because of the potential of mechanized equipment on the bluff, a coastal
development permit is required.
The project proposes to bring the stairways at the two subject locations up to current public
health, safety and welfare standards to provide long term, safe beach access. The project
complies with all applicable regulations and policies of the Mello I1 Local Coastal Program.

The project proposes the reconstruction of existing beach access stairways. The LCP
Land Use Plan designates the subject site for Open Space uses.
Conformance with uublic access and recreation policies of Chapter 3 of the Coastal Act.
(For Development located between the nearest public road and the sea or shoreline body
of water within the Coastal Zone).
The project will rehabilitate existing public access stairways at the two subject locations.
Coastal Overlay Zones.
Since the reconstruction of existing access stairways requires a Coastal Development
Permit, the typical requirements and additional studies required by overlay zones do
apply. Specifically, the Shoreline Development Overlay Zone requires geotechnical
analysis to ensure no geologic failure will result to the bluff area from the reconstruction
efforts.
ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemption listed below:
(1) Section 15301 of CEQA exemptions (Class l(d)) exempts the restoratiodrehabilitation of
deteriorated or damaged structures to meet current standards of health, safety and welfare.
A Notice of Exemption will be filed by the Planning Director upon project approval.

SUPPLEMENT TO ENVIRONMENTAL IMPACT ASSESMENT - PART I

MECHANICAL EQUIPMENT DURING CONSTRUCTION
Cherrv Avenue Stairs: During the construction phase of the project it is possible that mechanical
equipment such as a construction crane, a small tractor, a dump truck and/or pickup trucks could be
utilized by the contractor to assist in the work of reconstruction. These types of equipment are
anticipated to be located either in Carlsbad Blvd. adjacent to the stairs, on the sidewalk area at the top
of the stairs or possibly on the lower sidewalk of the seawall. Due to the steepness of the bluff it is not
practical for mechanized equipment to be physically located on the bluff itself. Additionally, the plans
and specifications for the project will prohibit the contractor from deploying any mechanized
equipment, like those mentioned above, on the bluff. Any mechanized equipment will be restricted to
the paved areas at the top and bottom of the existing stairs.
Ocean Street StairsDuring the construction phase of the project it is possible that mechanical
equipment such as a small front end loader, dump truck and/or pickup trucks may be utilized by the
contractor to assist in the stair reconstruction work. Due to the narrow width of the existing access
easement (I 2-feet) and the &foot width of the existing concrete stairs it is almost impossible to utilize
anything but a small front end loader, commonly called a bobcat, to assist in the removal of the
existing stairs. This type of mechanical equipment will be restricted to operating within the 6-foot strip
occupied by the existing concrete stairs.
