Request for approval of a site development plan and coastal development permit
to allow the construction of a 12,363 square foot child day care center located on a
vacant, pre-graded 3.37 acre infill parcel on the east side of Paseo del Norte
between Palomar Airport Road and Encinas Creek in the R-P zone in Local
Facilities Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4366
APPROVING a Negative Declaration and Planning Commission Resolutions No. 4367 and
4368 APPROVING SDP 98-02 and CDP 98-11 based on the findings and subject to the
conditions contained therein.
II. INTRODUCTION
The applicant is requesting Planning Commission approval of a site development plan and
coastal development permit to allow finish grading and the construction of a 12,363 square foot
child day care center on a vacant, 3.37 acre parcel located immediately north of Encinas Creek on
Paseo del Norte in the R-P zone. The project, which also requires administrative approval of a
child day care permit, is subject to the development regulations of Specific Plan 184, the
Residential-Professional (R-P) Zone, and the Coastal Overlay Resource Protection Zone.
Findings required to approve a site development plan and coastal development permit can be
made, and the project is consistent with all applicable development standards and relevant LCP
policies.
III. PROJECT DESCRIPTION AND BACKGROUND
The proposed project consists of 1,000 cubic yards of grading on a vacant, pre-graded lot located
in the R-P zone and Mello II Local Coastal Program (LCP) segment boundaries and the
development of a child day care center which includes the requisite onsite circulation, parking,
play areas, and landscaping. The proposed development is located within the northern portion of
the property and would occupy approximately 40% of the 3.37 acre site. Development is limited
to this previously disturbed area due to development constraints on the southern portion of the
site consisting of utility easements and the Encinas Creek deed-restricted wetland area. The
proposed development would, therefore, not disturb steep coastal slopes containing sensitive

biological resources. The project is surrounded by existing uses including an office in the R-P
zone to the north, Costco in the C-2 zone to the east. Paseo del Norte to the west, and open space
and multi-family residential development to the south
The site is subject to a combined Travel Recreation/Office (TR/0) General Plan land use
designation requiring a Specific Plan to regulate the site. Specific Plan 184 dated June 15. 1982.
was adopted by the City Council to implement the combined designation through the regulation
of uses and provision of development standards for this area. SP 184 requires approval of a site
development plan for new development in accordance with Chapter 21.06 (Qualified Overlay
Zone) of the Carlsbad Municipal Code and specifies the types of office, limited retail, and school
uses permitted within the area. The Specific Plan also gives the Planning Commission authority
to determine that other similar uses fall within the intent and purpose for the area, are compatible
with surrounding uses, and could, therefore, be considered for approval on the site.
The proposed project consists of a 12,336 square foot single story child day care center, a 24"
wide driveway aisle providing access to 40 parking spaces, landscaped front and side yard
setbacks, and 15,000 square feet of landscaped play areas. A single driveway from Paseo del
Norte would provide access to the project. The rectangular-shaped structure consists of 10
classrooms, each with its own exterior entry. The main entry consists of a portico (covered roof
supported by columns). All entries are surrounded by 9' high floor to ceiling windows that will
provide natural light to each room. Each entry is also accentuated by wooden trellises supported
by columns to provide shade and add architectural relief. The single story, 18' high structure has
a flat roof with decorative cornices incorporated into a 4' high parapet which will screen roof
equipment. The outdoor play areas, which surround the structure on three sides, are visible from
the center's interior through windows provided on all elevations. All play areas are directly
accessible from the center and enclosed by an ornamental iron fence. The applicant has indicated
that the facility will be licensed for a total of 240 children and hours of operation would be 6:45
a.m. - 6:00 p.m.. Monday through Friday. Due to the required parking standard, the maximum
number of children permitted at the facility would be 200 or fewer.
The proposed project is subject to the following standards and policies:

IV. ANALYSIS
The recommendation of approval for this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of the regulations/policies utilizing both text and tables.
A/B. General Plan/Specific Plan 184
Specific Plan 184. adopted to implement the site's combined TR/O General Plan designation,
identifies the Office and Related Commercial (O) designation as the intended land use unless a
site within the specific plan is rezoned (C-T) allowing tourist or travel-serving uses. The Office
land use provides for office and professional uses as well as related commercial uses. One of the
intents of the "O" land use designation is that, where appropriate, office and related commercial
uses will buffer residential uses from retail commercial areas. The project site functions in this
manner by separating office and commercial uses to the north from residential uses to the south.
One of the implementing zones for the office land use designation is Residential-Professional (R-
P), which permits child day care centers with an administrative permit. Since the land use and
zoning designations are consistent and the day care center provides a buffer between commercial
and residential land uses, the proposed development is consistent with the "O" General Plan
designation.
In accordance with the provisions of Specific Plan 184 regarding permitted uses, the Planning
Commission is given authority to approve uses which are similar to those enumerated by the plan
if they are comparable in nature and compatible with surrounding development. Uses permitted
by right within the specific plan boundaries include professional and medical offices, limited
retail uses, and schools (business, vocational, dance, drama, music, and swimming). The
proposed child day care use is similar to the school types of uses which are permitted by right
with respect to traffic generation, facility design and appearance, and hours of operation.
Additionally, the proposed development would reduce development intensity in the area in that it
would be smaller in scale and generate less traffic than a multiple story commercial office such
as the existing development to the north. The proposed play areas would be separated from
existing development by the proposed landscaped setbacks, parking lot. and structure. The
project is consistent with Specific Plan 184 development regulations as shown in the following
table:

The total number of employees and children may not exceed a demand for 40 spaces in
accordance with the required parking standard.
C.Mello IILCP
The project, as proposed, is consistent with all development and resource preservation policies of
the Mello II Local Coastal Program and its implementing ordinances. Chapters 21.201 and
21.203 of the Carlsbad Municipal Code. The property carries the same LCP designations as the
City's General Plan and zoning. Therefore, the proposed use is allowed upon Planning
Commission approval of a coastal development permit pursuant to Chapter 21.201. The intent of
the Coastal Resource Protection Overlay policies and zoning (Chapter 21.203) is to provide
additional protective regulations. The proposed development is located within the previously
disturbed portion of the parcel outside the adjacent Coastal Commission deed-restricted open
space (dedicated as part of the previous Price Club application). No steep slopes or natural
vegetation would be disturbed. The applicable regulations of Chapter 21.203 focus on deterring
soil erosion and sedimentation through the provision of adequate drainage facilities. The site
was previously graded and drainage improvements consisting of a storm drain which outfalls into
a desiltation basin were constructed as part of the Price Club development to the east. A storm
drain connection into this existing system is proposed to convey the additional runoff thereby
avoiding erosion and sedimentation in the Encinas Creek floodplain. Additionally, the project
would be required to comply with NPDES standards to reduce surface pollutants to an acceptable
level prior to discharge into the storm drain. A grading permit is not required for the project,
however, the project would be conditioned to comply with the City's erosion control standards
during site preparation and project construction.

Dl. Qualified Overlay Zone
Specific Plan 184 requires Planning Commission approval of a site development plan in
accordance with the Qualified Overlay (Q) Zone for any proposed development within its
boundaries. Consistent with the requirements of the "Q" zone, the project is consistent with the
"O" General Plan designation as discussed under Sections A/B above. The proposed
development is located within the developable portion of the lot, will not significantly alter
existing topography, and will not encroach into sensitive biological habitats to the south. All
necessary onsite circulation, parking, and play areas are provided in accordance with City
Standards. The proposed architecture, which consists of a single story flat roof structure,
includes enhanced architectural detailing through the use of decorative cornices, multiple
windows and trellises to ensure interest and architectural compatibility with surrounding
development. Landscaped setbacks along Paseo del Norte and between the existing office
development to the north would visually buffer the facility from the street and adjacent
development. Also, the placement of play areas away from the street and existing development
within fenced and landscaped play areas that are adjacent to permanent open space should further
reduce potential impacts resulting from differing land uses. Paseo del Norte. which is a
circulation element roadway directly serving the project, currently operates at level of service A
and is adequate to handle traffic generated by the project. The additional 960 ADT generated by
the project would not significantly reduce the level of service on Paseo del Norte: therefore, no
additional mitigation such as roadway improvements would be required.
D2. Chapter 21.18 - Residential Professional Zone
The development regulations specified by Specific Plan 184 take precedence over the underlying
zones; however, underlying zoning applies to subjects not addressed in the specific plan. The
project complies with the development standards set forth by the R-P zone, however, the
proposed child day care use requires administrative approval of a Child Day Care Permit subject
to the provisions of Chapter 21.83. The project's consistency with this requirement is discussed
under Section D3. below.
D3. Chapter 21.83 - Child Care
As discussed in the previous sections, the proposed child day care use in the R-P zone requires
administrative approval of a Child Day Care Permit. The Planning Director has determined that
the proposed child day care facility is consistent with the development standards set forth by the
Child Care Ordinance in that proof of licensing would be required prior to occupancy. Outdoor
play areas enclosed by ornamental iron fencing are located adjacent to the structure, away from
existing development. All play areas are visible and accessible from inside the facility. The day
care center is designed with multiple windows to allow maximum natural lighting and visibility.
Parking facilities are located within the developable portion of the lot and a loading/unloading
area that is easily accessed from the center is provided.

V.ENVIRONMENTAL REVIEW
Staff has conducted an environmental impact assessment to determine if the project could have a
potentially significant effect on the environment pursuant to CEQA guidelines and the
Environmental Protection Ordinance (Title 19) of the Carlsbad Municipal Code. The General
Plan land use designation and zoning remain the same, and the project falls within the scope of
the City's MEIR for the City of Carlsbad General Plan update (EIR 93-01) certified in
September. 1994, in which a Statement of Overriding Considerations was adopted for cumulative
impacts to air quality and traffic. All feasible mitigation measures identified by the MEIR which
are appropriate to this project have been incorporated into the project. An additional 960 ADT
would be generated by the project, however, this increase is below traffic levels for office uses
analyzed by the MEIR and would not reduce the levels of service on Paseo del Norte and its
intersections at Palomar Airport Road and Poinsettia Lane to unacceptable levels. No additional
mitigation, in the way of roadway improvements, is necessary. The project site has been
previously disturbed and the portion of the property proposed for development is limited to the
previously-graded pad. thereby avoiding the adjacent Encinas Creek floodplain and Coastal
Commission deed-restricted open space. Based on findings that no significant environmental
impacts would result from the proposed development, the Planning Director issued a Negative
Declaration on August 1. 1998.

The City has completed a review of the application for a Child Day Care Permit for development
located east of Paseo Del Norte between Encinas Creek and Palomar Airport Road.
It is the Planning Director's determination that the project is consistent with the City's Child Day
Care regulations (Chapter 21.83) and with all other applicable City ordinances and policies. The
Planning Director, therefore, approves this request based on the following:
Findings:
1. All licenses and permits required by state law for operation of a child day care facility
will be obtained by the operator of the day care facility prior to occupancy.
2. The project is subject to and consistent with the zoning standards and regulations
specified by Specific Plan 184, the R-P zone (Chapter 21.18) and all other applicable
sections of the Carlsbad Municipal Code.
3. Indoor/outdoor areas will be adjacent to the center, accessible through the center,
enclosed by a minimum 5" high fence, and will not be located adjacent to residentially
zoned property.
4. Outdoor play space will be viewable from within the facility through windows located on
all elevations of the child care center.
5. The child care facility will provide a direct source of natural light in that nine foot high
windows are located along all elevations of the facility to maximize the ability for
children to see outdoors.

6. Parking will be provided at one space/employee and one space/ten children. Pedestrian
sidewalks and adequate on-site loading and unloading will be provided around the
perimeter of the facility.
7. The Planning Department has reviewed, analyzed and considered the environmental
impacts identified for this project and found no substantial evidence the project will have
a significant effect on the environment. The Planning Director issued a Negative
Declaration on August 1, 1998 and no public comment was received during the public
review period.
8. All findings of Planning Commission Resolutions No. 4367 and 4368 approving SDP 98-
02 and CDP 98-11 for Discovery Isle Child Day Care Center are incorporated herein by
reference.
Conditions;
1. Approval is granted for DC 98-01 as shown on Exhibits "A" - "E", dated September 2,
1998, on file in the Planning Department and incorporated herein by reference.
Development shall occur substantially as shown unless otherwise noted in these
conditions.
2. DC 98-01 is subject to all conditions contained in Planning Commission Resolutions No.
4367 for SDP 98-01 and 4368 for CDP 98-11 for the Discovery Isle Child Day Care
Center.
3. The Developer shall obtain and maintain in good standing all licenses, permits, and/or
approvals required by state law to operate as a Child Day Care Center, and shall file proof
of same with the Planning Director prior to issuance of the Certificate of Occupancy and,
thereafter filing proof of any extensions or modifications to the permit.
4. In accordance with Section 21.83.080(F) of the Carlsbad Municipal Code, the total
number of employees and children occupying this facility shall not exceed a demand for
40 parking spaces. The parking standard for a child day care center is 1 space/employee
and 1 space/10 students.
5. A crosswalk delineated by enhanced pavement shall be provided between the landscaped
parking island and child day care center to ensure safe pedestrian access across the
parking aisle to an entrance to the facility.
