SUBJECT: CDP 98-12(A) - FORTH RESIDENCE - Request for an amendment to a
Coastal Development Permit to allow a minor modification (room addition) to an
approved yet unconstructed single-family residence within the City's Coastal
Zone, located near the terminus of Navigator Circle in the Rosalena subdivision of
the Poinsettia Shores Master Plan, within Local Facilities Management Zone 9.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4861
APPROVING CDP 98-12(A) based upon the findings and subject to the conditions contained
therein.
II. INTRODUCTION
Pursuant to Sections 21.201.030 & 21.201.060 of the Carlsbad Municipal Code, the construction
of a single-family home or the improvement to an existing single-family residential building
within 50 feet of the edge of a coastal bluff within the City's Coastal Zone requires the
processing and approval of a Coastal Development Permit (CDP). The CDP for this single-
family residence on this site was originally approved in 1998. The residence is currently being
constructed and the applicant is proposing a modification to the approved plans to add an office
above the garage. The CDP amendment application was reviewed for consistency with Local
Coastal Program (LCP) policies and implementation and with all applicable requirements of the
Poinsettia Shores Master Plan which is the approved coastal zone land use implementation
document for the project site. There are no unresolved issues. The staff recommended approval
with conditions is supported by the analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located near the terminus of an existing street as shown on the
attached location map. The lot area is .23 acres (9,997 square feet) and a residence is currently
being constructed on the site.
Proposed Residential Construction: A 236 square foot room addition above an attached garage.
Coastal Development Permit (CDP 98-12) approved a 3,595 square foot single-family residence
on the project site. The residence is currently being constructed. The applicant is proposing a
modification to the approved plans to add an office above the garage. The room addition will be
under the maximum height limit and meet all applicable building setbacks.

IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 4861.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the West BatiquitosLagoon/Sammis Properties Local Coastal
Program Segment.
The project proposes the addition of a room to an approved yet unbuilt single-family
residence in an area designated for single-family development. The LCP Land Use Plan
designates the subject site for RM (Residential Medium) density development. The
proposed project is in compliance with the Certified Local Coastal Program and complies
with all applicable requirements of the Poinsettia Shores Master Plan, which is the
approved coastal zone land use implementation document for the site.
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
The subject site is located between the nearest public road and the sea or shoreline body
of water within the Coastal Zone. The proposed project is in compliance with the
Certified Local Coastal Program in that the project complies with all applicable
requirements of the Poinsettia Shores Master Plan, which contains implementation
measures for compliance with Chapter 3 of the Coastal Act. Specifically, the Poinsettia
Shores Master Plan and the resolution of approval for CDP 98-12 required the
construction of a minimum 10-foot wide public bluff-top trail along the north side of
Batiquitos Lagoon. This trail as proposed would extend along the rear of this Lot.

Consistent with the provisions of the Master Plan and CDP 98-12, the project applicant
has dedicated a 10' wide trail easement for the construction of this trail segment.
Additionally, there exists a 45' open space easement over the rear portions of the subject
property. The proposed room addition is located in the front of the approved structure
and will not encroach into this open space easement.
3. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
because the site was previously graded, there is an absence of slopes steeper than 25%
inclination and/or native vegetation, additional submittals, standards or requirements do
not apply.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
(1) Section 15301(e) of CEQA exemptions (Class 1) exempts minor additions to
existing structures from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
