SUBJECT: CDP 98-17 - GUNTER RESIDENCE - Request for approval of a Coastal
Development Permit to allow for the construction of a single family residence and
a second dwelling unit within the City's Coastal Zone, located at 4160 Sunnyhill
Drive within Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4307
APPROVING Coastal Development Permit CDP 98-17 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single
family home and a second dwelling unit within the City's Coastal Zone requires the processing
and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for
consistency with LCP policies and implementation. There are no unresolved issues. The staff
recommended approval with conditions is supported by the analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located on the east side of Sunnyhill Drive between Tamarack
Avenue and Mac Arthur Avenue as shown on the attached location map. The lot area is .67 acres
(29,185 square feet) and is developed with an existing single family dwelling unit.
Proposed Residential Construction: New single family residential structure totaling 2,675 square
feet and the conversion of an existing single family residence into a 619 square foot second
dwelling unit.
Proposed Grading: Estimated grading quantities include 530 cubic yards (cy) of cut, and 530
cubic yards of fill to be balanced on-site. A grading permit will be required for this project.

V.ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 4307.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes the construction of a single family residence and a second dwelling
unit in an area designated for single family development. The LCP Land Use -Plan
designates the subject site for Residential Low Medium density development. Affordable
Housing Policy 1-1 of the Mello II LCP allows for the development of second dwelling
units subject to compliance with all applicable LCP provisions, with the exception of
base density. As discussed below, the proposed project complies with all applicable LCP
provisions.
2. Coastal Overlay Zones
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
due to its location on a previously graded lot and the absence of natural slopes steeper
than 25% inclination and/or native vegetation, additional submittals, standards or
requirements do not apply.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per Section 15303 of CEQA exemptions (Class 3) which
exempts the construction of single family residences in urbanized areas from environmental
review. A Notice of Exemption will be filed by the Planning Director upon project approval.
