SUBJECT: CDP 98-31 - LA VERCIA CONDOMINIUMS - Request for a Coastal
Development Permit to allow development of 5 single-family residences on a site
located on the South side of Tamarack Avenue between Garfield Street and the
AT&SF railway lines and within Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4380
APPROVING CDP 98-31 based upon the findings and subject to the conditions contained
therein.
II. INTRODUCTION
This application is for a Coastal Development Permit for a residential development on a single
small in-fill lot. The proposed development consists of five residential structures with associated
garages, guest parking, private yards, and a common recreation area.
The requested coastal development permit is associated with a previously approved tentative
tract map and condominium permit. Staff has reviewed the project and recommends that the
proposal is in compliance with the Mello IILCP segment and its implementing ordinances.
III. PROJECT DESCRIPTION AND BACKGROUND
This application is for a Coastal Development Permit for a 5-unit single-family residential
development. The project site is a .41-acre parcel located on the South side of Tamarack Avenue
between Garfield Street and the AT&SF railway lines. The proposed structures will be two-
story, split-level single-family attached units. The floor plans contain from 1,371 to 1,455 square
feet per unit. The project architecture will be contemporary Spanish style with stucco exteriors
and concrete tile roofs. Three of the units will have attached garages. The other two will have
detached garages. A trellised guest parking area is provided. The project also includes private
and common recreation areas.
The project is designed as a single-family attached condominium development on one lot. The
project complies with all CP (PUD) requirements, including the City's Small Lot Single Family
Architectural Guidelines. The proposed project has related valid project approvals dating back to
1992. A tentative tract map (CT 91-07) and condominium permit (CP 91-04) were approved on
December 2, 1992. A coastal development permit was not processed concurrent with those
permits because the City did not have Coastal permitting authority at that time.

The applicant has received several extensions for the approved tentative tract map over the years,
including the most recently approved 1-year extension granted by the Planning Commission on
January 21, 1998. That 1-year extension will keep the map active until January 21, 1999. No
new conditions were added to the approved tract map at that time, and none are required now.
Because this project application predates the adoption of the City's inclusionary housing
ordinance, the project is allowed to satisfy it's affordable housing requirements by the payment
of a housing impact fee. In March of 1998, the applicant revised the project slightly to eliminate
the roof decks shown on the original plans. This change, which resulted in structure height
reduction from 29' to 26', was found to be in substantial conformance with the original
approvals.
Pursuant to Section 21.58.020 of the Carlsbad Municipal Code, the approved CP automatically
remains a valid permit until the CT expires. The project design satisfied all requirements of the
condominium (CP/PUD) regulations at the time of approval and remains in compliance with
such requirements today. In turn, the City's applicable ordinances and regulations are consistent
with the Coastal Zone regulations.
The project site is a small (.41-acre), generally flat, in-fill site. It contains no sensitive resources
of any kind. The site is surrounded by existing single-family and multi-family residential
development. The General Plan and zoning designations for the project site and the surrounding
areas are as shown in Table 1 below.

IV. ANALYSIS
The recommendation for approval for this project was developed by analyzing the project's
consistency with the applicable City regulations and policies. The only applicable regulations in
this case are the Coastal Development regulations which are discussed in detail in the sections
below.
A. Coastal Development Regulations
This project is located within the Mello II segment of the City's Local Coastal Program and is
subject to the land use policies and implementing ordinances which are a part of that segment.
Those policies and ordinances address the preservation of agriculture and scenic resources,
protection of environmentally sensitive resources, provision of shoreline access, and prevention
of geologic instability and erosion.

The project site is an undeveloped .41-acre in-fill site. The site is flat and contains no scenic or
environmentally sensitive resources. The site is not a designated agricultural site. Since it also is
not along the coastline, provision of shoreline access is not an applicable requirement. Finally,
the grading for the proposed project must conform to all City of Carlsbad Engineering Standards.
Implementation of those standards will control potential impacts from erosion.
V. ENVIRONMENTAL REVIEW
This project (the Coastal Development Permit application) has been determined to be within the
scope of the previously approved environmental documents for the project. Consequently, a
Notice of Prior Compliance was issued on August 14,1998.
This project was originally approved with a Negative Declaration. The project site was, and
remains, an in-fill site containing no sensitive resources. The site is subject to noise impacts
from trains travelling on the nearby railway lines. The noise study prepared for the project
indicates that at only one point on the site (the face of Unit 1) would the noise level exceed the
allowable 60 dBA CNEL. At that point the noise level could reach 62 dBA CNEL. Therefore,
the balcony of Unit 1 has been designed with a plexiglass wall on the North side. No other
potential environmental impacts were identified. Current review indicates no changes to the
conditions of the site or the applicable regulations which would result in potential impacts not
previously identified.
