SUBJECT: CDP 98-32 - KEVIN STURDY LOT 20 - Request for approval of a Coastal
Development Permit to allow for the construction of a single-family residence
within the City's Coastal Zone, located near the terminus of Navigator Circle in
the Rosalena subdivision of the Poinsettia Shores Master Plan, within Local
Facilities Management Zone 9.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 4361
APPROVING Coastal Development Permit CDP 98-32 based upon the findings and subject to
the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the construction of a single
family home within the City's Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with LCP
policies and implementation. There are no unresolved issues. The staff recommended approval
with conditions is supported by the analysis as follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: Infill lot located near the terminus of an existing street as shown on the
attached location map. The lot area is .18 acres (7,680 square feet).
Proposed Residential Construction: New residential structure totaling 2,508 square feet.
Proposed Grading: No grading is proposed.
Impact on Coastal Resources: None.
IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 4361.

Review of Required Coastal Findings
1. Conformance with the Certified Local Coastal Program and all applicable policies.
The project is located in the West Batiquitos Local Coastal Program Segment.
The project proposes the construction of a single-family residence in an area designated
for single family development. The LCP Land Use Plan designates the subject site for
RM (Residential Medium) density development. The proposed project is in compliance
with the Certified Local Coastal Program in that the project complies with all applicable
requirements of the Poinsettia Shores Master Plan, which is the approved coastal zone
land use implementation document for the site.
2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
The subject site is located between the nearest public road and the sea or shoreline body
of water within the Coastal Zone. The proposed project is in compliance with the
Certified Local Coastal Program in that the project complies with all applicable
requirements of the Poinsettia Shores Master Plan, which contains implementation
measures for compliance with Chapter 3 of the Coastal Act. Specifically, the Poinsettia
Shores Master Plan requires the construction of a minimum 10 foot wide public bluff top
trail along the north side of Batiquitos Lagoon. This trail as proposed would extend
along the rear of Lot 20. Consistent with the provisions of the Master Plan, the project
applicant has been conditioned to dedicate a 10' wide trail easement prior to the issuance
of a building permit for this residence. Additionally, there exists a 45' open space
easement over the rear portions of the subject property. Consistent with a previous
Coastal Commission action, minor accessory structures are allowed within this 45' open
space (setback) area. However, no accessory structures are permitted prior to the
construction of the bluff top trail. This project has been appropriately conditioned.

3. Coastal Overlay Zones.
The subject site is located in the Coastal Resource Protection Overlay Zone, however,
because the site was previously graded, there is an absence of slopes steeper than 25%
inclination and/or native vegetation, additional submittals, standards or requirements do
not apply.
V. ENVIRONMENTAL REVIEW
This project is exempt from CEQA per the exemptions listed below:
(1) Section 15304 of CEQA exemptions (Class 4) exempts minor alterations to land
including grading on land with a slope of less than 10% from environmental
review.
(2) Section 15303 of CEQA exemptions (Class 3) exempts the construction of single
family residences in urbanized areas from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
